    Zivotofsky v. Kerry: Of Passports, Politics, and Foreign Policy Powers

    This commentary profiles the upcoming Supreme Court decision in Zivotofsky v. Kerry, which will decide, for the first time in United States history, the dividing line between legislative and executive authority to recognize foreign nations. Though it emanates from a seemingly-benign passport disagreement about a place-of-birth designation, this case will address an unprecedented and extremely controversial issue about separation of powers that has somehow evaded a Supreme Court decision. The Author profiles the case history and applicable legal precedent and analyzes the arguments for both sides before recommending that the Court should not find the President\u27s power in this area of foreign policy to be either supreme or exclusive

    What was behind the M2 breakdown?

    A deterioration in the link between the M2 monetary aggregate and GDP, along with large errors in predicting M2 growth, led the Board of Governors to downgrade the M2 aggregate as a reliable indicator of monetary policy in 1993. In this paper, we argue that the financial condition of depository institutions was a major factor behind the unusual pattern of M2 growth in the early 1990s. By constructing alternative measures of M2 based on banks’ and thrifts’ capital positions, we show that the anomalous behavior of M2 in the early 1990s disappears. Specifically, after accounting for the effect of capital constrained institutions on M2 growth, we are able to explain the unusual behavior of M2 velocity during this time period, obtain superior M2 forecasting results, and produce a more stable relationship between M2 and the ultimate goals of policy. Our work suggests that M2 may contain useful information about economic growth during periods of time when there are no major disturbances to depository institutions.Monetary policy

    MOJAVE: Monitoring of Jets in AGN with VLBA Experiments. IV. The Parent Luminosity Function of Radio-Loud Blazars

    (Abridged) We use a complete sample of active galactic nuclei (AGN) selected on the basis of relativistically beamed 15 GHz radio flux density to derive the parent radio luminosity function (RLF) of bright radio-selected blazar cores. We use a maximum likelihood method to fit a beamed RLF to the observed data and thereby recover the parameters of the intrinsic (unbeamed) RLF. We analyze two subsamples of the MOJAVE sample: the first contains only objects of known FR II class, with a total of 103 sources, and the second subsample adds 24 objects of uncertain FR class for a total of 127 sources. Both subsamples exclude four known FR I radio galaxies and two gigahertz-peaked spectrum sources. We obtain good fits to both subsamples using a single power law intrinsic RLF with pure density evolution function. We find that a previously reported break in the observed MOJAVE RLF actually arises from using incomplete bins (because of the luminosity cutoff) across a steep and strongly evolving RLF, and does not reflect a break in the intrinsic RLF. The derived space density of the parent population of the FR II sources from the MOJAVE sample (with L>1.3e25 W/Hz) is approximately 1600/Gpc^3.Comment: 31 pages, 7 figures and 2 tables. Housing becomes increasingly important as people get older. In a report on housing from the 1971 White House Conference on Aging it was stated aside from his spouse, housing is probably the single most important element in the life of an older person. . .. Most of his satisfactions are house oriented. He spends more time in his home than almost anyone else over the age of five. And just as more of his satisfactions are bound up in his sense of home, so more and more of his problems are house generated. There is a severe shortage of low-rent housing for the poor elderly in the United States

    Hate Exposed to the Light of Day: Determining the Boy Scouts of America\u27s Expressive Purpose Solely from Objective Evidence

    In the 1980s, the U.S. Supreme Court took considerable steps toward decreasing the uncertainty surrounding an organization\u27s associational freedoms by requiring an organization seeking to exclude individuals solely based on status to prove that its expressive purpose would be undermined if it included such members. However, these Supreme Court cases failed to establish any consistent approach to determining an organization\u27s expressive purpose. Problems have arisen most acutely with the claims of gays seeking to be included in the Boy Scouts of America (BSA), an organization with a multifaceted and vague message. As the law now stands, courts have broad discretion to decide what facts are relevant in determining the BSA\u27s expressive purpose. Unfortunately, this broad discretion has led to some courts\u27 accepting the homophobic views of individual BSA members and leaders as the expressive purpose of the entire organization. This Comment proposes that the BSA\u27s expressive purpose be determined only from objective evidence. If the BSA seeks constitutional protection to hate, its expressive purpose must be clearly defined in position statements, written in recruiting brochures, announced to sponsors, and referred to in either the original or amended bylaws

    Predicting Gross Revenue Using Online Movie Reviews

    Today, many people check the ratings and reviews of a movie before they watch it. A review can be easily published online and seen by thousands of people, and this can change a person’s opinion on whether or not they see the film. With the increasing presence of online platforms, it has changed the way people express their thoughts and feelings. There are many different platforms people can go to find varying opinions on a particular movie. This research will consider the problem of predicting a movie’s overall gross revenue. We focus on ratings, reviews and information given on the IMDb Website. (https://www.imdb.com) A list of 4,265 movies and their corresponding reviews were collected between January 2005 and December 2019. In our research, we use RStudio and sentiment analysis to determine a review’s emotions and opinions. We investigate whether the sentiment in a movie’s reviews can predict overall gross revenue, as well as other predictors given on the IMDb website

    A game theory model of the physician preference item supply chain

    Many types of medical devices (e.g., orthopedic implants, stents, and pacemakers) have significantly higher costs and more frequent product innovations than commodity items. These physician preference items (PPI) are procured through a unique supply chain, in which physicians select which products updates to adopt, based upon clinical preference. PPI manufacturers are motivated to update products frequently to remain competitive and enhance revenues by incorporating new product features embedded in the PPI. Due to the PPI updates, physicians must progress through a learning curve after adopting a new product generation. Often, manufacturers will employ sales representatives to assist physicians with PPI learning. However, hospitals are left to address the increasing costs associated with the new product generation. This work uses a game-theoretic approach to understand how an average physician\u27s learning curve affects the manufacturer\u27s optimal product update pace. Additionally, the impacts of sales representatives and hospital cost control efforts are studied. Results indicate that not only is the manufacturer\u27s product update pace dependent upon physician learning, but also both the manufacturer and the physician benefit when a new PPI product generation requires a shorter amount of time to be mastered. Finally, we see that a hospital\u27s PPI cost control strategy may need to vary for different devices, based upon their objectives as either a value-focused or research-focused hospital
