    Moral Practices: Assigning Responsibility in the International Criminal Court

    Who has the authority to assign responsibility for international crimes? There is a simple answer: international tribunals, in particular the International Criminal Court (ICC). Yet this obvious response obscures further questions regarding where the political authority to create international tribunals comes from, as well as the vital moral question regarding how courts are constituted as actors with the capacity to assign blame. In modern international politics, authority has traditionally rested with states, meaning that rightful legal institutions were created by states and justified by their consent. The ICC is granted authority in this way, because it was created through a treaty negotiated and signed by states. Such a procedural response, however, obscures as much as it reveals about the politics and morality of assigning responsibility for international crimes. Asking how a new international authority is constituted and justified as an actor with the political power to try state officials and other international criminals—and to thereby embody and defend supposedly emergent norms of global justice—is a more contentious and difficult question that takes us beyond questions of positive law

    Can\u27t You Smell That Smell? Clean Air Act Fixes for Factory Farm Air Pollution

    Massive facilities that keep large numbers of livestock have overtaken small, independent farms as the primary source of meat, eggs, and dairy in the United States. These concentrated animal feeding operations ( CAFOs) compare more to industrial manufacturing operations than to traditional farms, and emit huge quantities of air pollutants that are harmful to public health, sickening people and damaging the environment. The Environmental Protection Agency ( EPA ) possesses statutorily provided tools under the Clean Air Act that it uses to regular other polluting industries. However, this article - after reviewing the rise of CAFOs, examining the threats they pose, and surveying current regulation - suggests that the EPA\u27s approach to CAFOs is grossly inadequate. The article argues that the agency, under the Clean Air Act, should regulate the emissions of hydrogen sulfide and ammonia, two pollutants for which factory farms are major sources. This approach is incomplete, however. Pollutant-based regulation is both overbroad in that it will regulate other sources of these pollutants and underbroad because CAFO air pollution includes more than just these pollutants. The EPA should therefore additionally or alternatively rely on a more thorough and flexible pollution source-specific tool, the New Source Performance Standards ( NSPS ). NSPS are analogous to the rigorous source-specific approach used to regulate CAFO water pollution under the Clean Water Act, and will provide a comprehensive antidote to the ills of modern, industrial animal agriculture

    Burning Man Values Examined: Gratitude as a Culturally-Driven and Value-Based Organizational Mainstay

    Gratitude expression is examined as a culturally-derived principle that can be adopted as a best practices strategy that can make organizations more dynamic and human relationships more meaningful. Burning Man is presented as an exemplar of gratitude implementation by crafting the expression of gratitude into an elevated organizational phenomenon (including a cultural principal of unconditional gifting). Burning Man has also crafted a “Culture of Appreciation” as a set of organizationally-derived practices complementary to processes of gratitude implementation. The paper concludes with a discussion of gratitude and appreciation as an organizational mainstay

    Homogeneous shear flows (with constant strainrate du/dy) are generated with the Doll's and Sllod algorithms and compared to corresponding inhomogeneous boundary-driven flows. We use one-, two-, and three-dimensional smooth-particle weight functions for computing instantaneous spatial averages. The nonlinear stress differences are small, but significant, in both two and three space dimensions. In homogeneous systems the sign and magnitude of the shearplane stress difference, P(xx) - P(yy), depend on both the thermostat type and the chosen shearflow algorithm. The Doll's and Sllod algorithms predict opposite signs for this stress difference, with the Sllod approach definitely wrong, but somewhat closer to the (boundary-driven) truth. Neither of the homogeneous shear algorithms predicts the correct ordering of the kinetic temperatures, T(xx) > T(zz) > T(yy).Comment: 34 pages with 12 figures, under consideration by Physical Review

The possibility of using ships of opportunity for recovery operations is considered. Finally, the means by which money, manpower, and resources have been saved and longlines leased are delineated

    Space Station based options for orbiter docking/berthing

    Conceptual efforts to develop a Space Station based system for docking and/or berthing the NSTS Orbiter are described. Past docking and berthing systems are reviewed, the general requirements and options for mating the Orbiter and Space Station are discussed, and the rationale for locating the system on the Station is established. One class of Station-based system is developed in several variations and evaluated with respect to weight distribution, loads, safety, reliability, viewing, and maintainability. An evolutionary presentation of the variations provides insight into the development process and the problems encountered. An overall evaluation of the Station-based variations compared to an optimized Orbiter-based system demonstrates the potential benefits of this approach as well as the issues that must be resolved to realize the benefits

    Microscopic and Macroscopic Stress with Gravitational and Rotational Forces

    Many recent papers have questioned Irving and Kirkwood's atomistic expression for stress. In Irving and Kirkwood's approach both interatomic forces and atomic velocities contribute to stress. It is the velocity-dependent part that has been disputed. To help clarify this situation we investigate [1] a fluid in a gravitational field and [2] a steadily rotating solid. For both problems we choose conditions where the two stress contributions, potential and kinetic, are significant. The analytic force-balance solutions of both these problems agree very well with a smooth-particle interpretation of the atomistic Irving-Kirkwood stress tensor.Comment: Fifteen pages with seven figures, revised according to referees' suggestions at Physical Review E.     An appartus is described for scanning relatively small near sources of penetrating radiation to obtain the energy distribution thereof, wherein a collimator assembly is interposed between a radiation source and a radiation detector. The collimator assembly has a plurality of plates aligned in parallel planes with respect to a common axis normal to their centers. All the plates have similar random distribution of apertures. All apertures on each plate are the same size. The size of respective plates, the size of the apertures of said respective plates, and the spacing between said respective plates vary precisely according to a predetermined ratio to produce radiation channels which converge to a focal point. The radiation incident to the radiation detector is maximized when the focal point and the radiation source are co-incident
