Isolated Wetland Commons and the Constitution

Isolated wetlands provide great ecological and economic value to the United States. While some states provide protection for isolated wetlands, a great many do not. These wetlands are also left outside the ambit of federal wetland regulatory protections under the Clean Water Act, with its murky jurisdictional reach. Notwithstanding jurisdictional questions under current federal statutes, the U.S. Supreme Court has gone so far as to call into question the constitutionality of federal isolated wetland regulation. This Article makes a normative argument that, in the absence of state or local programs providing holistic isolated wetland protection, federal action is needed. The Article further provides the legal foundation—despite doubts manifested by the nation’s highest court—for the constitutionality of federal isolated wetlands regulation. This legal foundation is based upon commons analysis, which ties developers of isolated wetlands engaged in interstate commerce to those wetlands within a single act of appropriation. Such acts of appropriation are economic transactions that in the aggregate substantially affect interstate commerce—thus meeting one of the tests established by the Supreme Court for determining the constitutionality of federal legislation

Perceptions of Counseling Integration: A Survey of Counselor Educators

Counselor educators were surveyed in order to assess their knowledge of integrative counseling approaches, their views regarding the importance of such approaches, and how much emphasis on integrative counseling is given in their counseling courses. A large majority of participants reported that integration in counseling is very important and that they emphasize it in their teaching of counseling theories and/or methods courses. Implications of these findings are discussed, including suggestions for counselor educators and counseling journals

Nonconsumptive Effects of Crustaceans and an Echinoderm on Spat of the Eastern Oyster Crassostrea virginica (Gmelin, 1791)

Predation by crustaceans and echinoderms is a significant driver of mortality for sessile invertebrates in near-shore marine ecosystems. As a response, shellfish growers use predator exclusion cages to grow their product. Oysters grown in these cages and clams in and under nets have been observed to exhibit thinner, brittle shells, which is not optimal for market, nor for those being grown for restoration purposes. Here, the nonconsumptive predator effects of several native and nonnative predators on shell morphology of Crassostrea virginica oyster spat. Juvenile (1–3 mm) seed oysters were exposed separately to chemical cues of five different predators and one nonpredator crab were investigated and compared with control (no exposure) spat. Significant effects of predator presence on the total wet weight (g) of the spat was demonstrated, with the highest increase for spat exposed to black-fingered mud crabs (Panopeus, 1.70 mg d−1) and the biggest decreases for spat exposed to the European green crabs (Carcinus maenas—1.34 mg d−1) and the sea stars (Asterias rubens—1.47 mg d−1). Changes to oyster length (mm) and shell density (crushing resistance) were not significant. Implications for aquaculturists and wild bivalve populations are that growth could be negatively affected by the lack of predators on these important organisms

Bioactive properties and clinical safety of a novel milk protein peptide

Milk protein fractions and peptides have been shown to have bioactive properties. This preliminary study examined the potential mechanisms of action and clinical safety of novel milk protein peptide (MP). A novel MP mixture inhibits the tyrosine kinase activity of epidermal growth factor receptor (EGFR), vascular endothelial growth factor receptor 2 (VEGFR2), and insulin receptor (IR) with IC50 of 9.85 μM, 7.7 μM, and 6.18 μM respectively. In vitro, this multi-kinase inhibitor causes apoptosis in HT-29 colon cancer cells, and in a C. elegans worm study, showed a weak but significant increase in lifespan. A six week double-blind, placebocontrolled study involving 73 healthy volunteers demonstrated that the MP mixture is safe to consume orally. All clinical blood markers remained within normal levels and no clinically significant side effects were reported. There was some evidence of improved insulin sensitivity, neutrophil-to-lymphocyte ratio (NLR), and quality of life assessment of role of physical function. These data in combination with the observed in vitro anti-cancer properties warrant further clinical studies to investigate this MP mixture as a potential clinical nutrition intervention for improving the quality of life and clinical outcomes in cancer patients

How do informal self-care strategies evolve among patients with chronic obstructive pulmonary disease managed in primary care? A qualitative study

Background: There is much description in the literature of how patients with chronic obstructive pulmonary disease (COPD) manage their breathlessness and engage in self-care activities; however, little of this is from the perspective of those with less severe disease, who are primarily managed in primary care. This study aimed to understand the self-care experiences of patients with COPD who are primarily managed in primary care, and to examine the challenges of engaging in such behaviors. Methods: Semistructured interviews were carried out with 15 patients with COPD as part of a larger project evaluating a self-management intervention. Thematic analysis was supported by NVivo software (version 8, QSR International, Melbourne, Australia). Results: Three main themes are described, ie, experiencing and understanding symptoms of COPD, current self-care activities, and the importance of family perceptions in managing COPD. Conclusion: Self-care activities evolved spontaneously as participants experienced symptoms of COPD. However, there was a lack of awareness about whether these strategies would impact upon symptoms. Perceptions of COPD by family members posed a challenge to self-care for some participants. Health care professionals should elicit patients' prior disease experiences and utilize spontaneous attempts at disease management in future self-management. These findings have implications for promoting self-management and enhancing quality of life
