    Rules of practice and procedure provide technical information in regard to perfecting appeals, but they do not explain how to win an appeal any more than how to win a trial. Advocacy is not an exact science; the skills which contribute to effective advocacy, whether in a trial or on appeal, have long been recognized as an art. We shall here deal with these skills at the appellate level, bearing in mind, of course, the limitations of formulating rules or precepts that can adequately instruct in any art. There is no single, prescribed method for writing a play or painting a picture. Similarly, there is no defined way to try a lawsuit or present an appeal. For the lawyer, like the artist, the approach is a matter of individual style, but there are nevertheless certain fundamental precepts. Other concepts herein asserted are the reflections of the writer based on personal experience during the course of some forty years of a practice that has been liberally sprinkled with appellate work and seasoned with a deep avocational interest in the rules of practice and procedure

    No relationships between the within-subjects' variability of pain intensity reports and variability of other bodily sensations reports

    Purpose: The subjective nature of pain assessment and its large variance negatively affect patient-health care provider communication and reduce the assay sensitivity of pain clinical trials. Given the lack of an objective gold standard measure, identifying the source (true or error) of the within-subject variability of pain reports is a challenge. By assessing the within-subjects variability of pain and taste reports, alongside with interoceptive measures, the current study is aimed to investigate if the ability to reliably report bodily sensations is a cross-modal characteristic. Patients and Methods: This prospective study enrolled healthy volunteers from local universities. After consenting, subjects underwent the Focus Analgesia Selection Task (FAST), to assess within-subjects variability of pain reports in response to experimental noxious stimuli; a taste task, which similarly assesses within-subjects variability of tastes (salty and sweet) intensity reports; and the heartbeat perception task, an interoceptive task aimed to assess how accurate subjects are in monitoring and reporting their own heartbeat. In addition, all subjects completed the Multidimensional Assessment of Interoceptive Awareness (MAIA), the Perceived Stress Scale (PSS), and Hospital Anxiety and Depression Scale (HADS). Spearman's correlations were used to assess relations between all measures. Results: Sixty healthy volunteers were recruited. Variability of intensity reports of different modalities were independent of each other (P > 0.05 for all correlations). The only correlation found was within modality, between variability of intensity reports of salt and sweet tastes (Spearman's r = 0.477, P < 0.001). No correlations were found between any of the task results and questionnaire results. Conclusion: Within-subjects variability of pain reports do not relate to variability of reports of other modalities or to interoceptive awareness.     Addressing client mental health within the personal training relationship

    I undertook this study to expand the literature regarding connections between mental and physical health to include ways in which client mental health arises and is addressed within the personal training relationship. My research was guided by an ethical framework with the purpose of improving best care practices for clients. The four research questions I posed concerned the frequency with which mental health issues are addressed, typical interventions personal trainers utilize in response to these issues, the reasons personal trainers choose specific interventions, and the training personal trainers receive regarding client mental health. Participants (N = 58) were recruited through athletic facilities, internet searches, and snowball sampling methods. They completed an online survey including demographic questions about themselves, their clients, and the facilities at which they work, as well as questions about their experiences working with clients, interventions they use, and their occupational training. My major findings were that participants encountered a variety of mental health issues from their clients. Participants used many interventions to address these issues, some that fell within their scope of practice, such as active listening, and some that did not, such as counseling. Many participants reported making referrals to mental health professionals. For those who did not, their main obstacle was lack of referrals to provide to their clients. In many cases, participants did not receive standardized training regarding best care practices for addressing client mental health, but relied on personal experiences or independently gained knowledge
