    Enforcing foreign arbitral awards in Australia against non-signatories of the arbitration agreement

    This article investigates two questions that may arise in Australian proceedings for the enforcement of a foreign arbitral award where the award-debtor is not named in the relevant arbitration agreement and asserts that it is not a party to that agreement. The first question that may be contested in those circumstances is whether the award-debtor is for some reason precluded from denying its privity to the relevant arbitration agreement. Where this is not the case, the allocation of the onus of proof with regard to the award-debtor’s privity to the agreement may become relevant. In the context of investigating these two questions, this article discusses the views expressed in IMC Aviation Solutions Pty Ltd v Altain Khuder LLC, decided in 2011 by Croft J as trial judge and then by the Victorian Court of Appeal

    First Result of Net-Charge Jet-Correlations from STAR

    We presented results on azimuthal correlation of net-charge with high pTp_T trigger particles. It is found that the net-charge correlation shape is similar to that of total-charge. On the near-side, the net-charge and total-charge pTp_T spectra have similar shape and both are harder than the inclusives. On the away-side, the correlated spectra are not much harder than the inclusives, and the net-charge/total-charge ratio increases with pTp_T and is similar to the inclusive ratio

    How do the environmental extremes of Siberian permafrost soils shape the composition of the bacterial soil community?

    Microbial communities in permafrost soils of the Siberian Arctic are exposed to extreme environmental conditions. The soils are frozen throughout the entire year except for the short summer period, when thawing of the uppermost 20 to 50 cm of the permafrost sediment allows for the formation of a so-called active layer. Active layers show steep temperature gradients between 10 to 18 °C near the surface and 0 to 1 °C near the permafrost table. Additionally, seasonal freezing and thawing processes lead to the formation of patterns of low-centered polygons. Low-centered polygons determine a pronounced small-scale heterogeneity with regard to their physical and chemical properties between the elevated polygon rims and the depressed polygon centers.Within the active layer of a polygon rim, vertical profiles of potential methane oxidation rates in respond to different temperatures indicated a shift in the temperature optimum from 21 °C near the surface to 4 °C near the permafrost table [1]. This temperature shift could not be shown in samples of the polygon center. Based on these results we used 16S rDNA clone libraries as well as in-situ cell counting to compare the bacterial, in particular the methane oxidizing, community near the surface and near the permafrost table in samples of the polygon rim. The phylogenetic analyses show that the composition of the bacterial community near the surface is significantly different from the bacterial community near the permafrost table. The results also show that bacterial diversity and abundance in Siberian permafrost soils are comparably high as in temperate terrestrial environments.[1] Liebner. S. and Wagner, D.     Sedan Ă„r 2006 har den syntetiskt framstĂ€llda drogen spice existerat i Sverige, men först Ă„r 2008 blev drogen populĂ€r och tidningar började rikta uppmĂ€rksamhet mot den. Genom att drogen kan byta skepnad i uppbyggnaden kan den förbli laglig, dĂ€rför kan egentligen namnet “spice” inte betraktas som ett enhetligt begrepp. VĂ„rt syfte med denna studie blev att granska hur drogen spice beskrivs i tidningar och forskning. Även hur drogen betraktas gĂ€llande psykosociala och medicinska avseenden. Detta i förhĂ„llande till socialkonstruktivistiskt perspektiv. Den metod som vi valde att anvĂ€nda oss av i studien var kvantitativ innehĂ„llsanalys. Genom analys av 80 stycken svenska tidningsartiklar hĂ€mtade ur databasen mediearkivet, samt vetenskapliga artiklar och litteratur har vi besvarat vĂ„ra frĂ„gestĂ€llningar. De resultat vi fick frĂ„n analyser visade pĂ„ att tidningar kan vara av betydande roll för ungdomars attityder. Tidningar kan utföra bland annat skrĂ€mselpropaganda för att upplysa och förhindra brukandet av spice, dessvĂ€rre visar resultatet en motsatt effekt. Forskning visar att bruk av spice kan pĂ„verka relationer och arbete negativt. Dessutom Ă€r nĂ„gra bieffekter av spice bröstsmĂ€rtor, vanförestĂ€llningar, sjĂ€lvmordstankar och hjĂ€rtstopp

The analysis in this brief finds that neglected children whose caregivers struggle with substance abuse and mental health problems are at significant risk for out-of-home placement. Risk factors for out-of-home placement for neglected children are discussed, as well as a multifaceted approach to services to prevent neglect and out-of-home placement

    Increasing Opportunities for Older Youth in After-School Programs

    Few after-school programs have developed strategies for attracting large numbers of teens, especially older and harder-to-serve youth. In response to this need, Madison Square Boys & Girls Club in New York City and Boys & Girls Clubs of Boston participated in a three-year initiative to enhance services to underserved teens. This report documents the successes and challenges the Clubs experienced as the initiative unfolded. They recruited large numbers of teens, involved them in a variety of activities, and provided them with emotional support, leadership opportunities, and programming in two critical areas: academics and job training
