    Whose Who? The Case for a Kantian Right of Publicity

    Rapidly developing technological opportunities for unauthorized uses of identity-from virtual kidnapping to digitalcasting-coincide with growing demand for a preemptive federal right of publicity that can replace the existing welter of inconsistent state laws. Progress is impeded, however, by intractable doctrinal confusion and academic hostility to the right as allegedly inimical to society\u27s cultural need to manipulate celebrity images. Because the right of publicity is traditionally based on Lockean labor theory and analogized to intellectual property in created works, it is vulnerable to such attacks; to date, no serious attempt has been made to elaborate an alternative philosophical justification that can withstand them. In this Article, Dean Haemmerli uses Kantian philosophy to justify an autonomy-based right of publicity. In doing so, she challenges both the traditional approach to the right of publicity and its postmodernist critiques. First, the Article\u27s proposed reconception of the right of publicity rejects the existing doctrinal bifurcation of publicity and privacy rights and explicitly embraces both the economic and moral facets of the individual\u27s need to control the use of his identity. Second, by grounding the right in personal autonomy rather than purely pecuniary interests, the Article gives it greater weight in the balance against competing First Amendment considerations. At the same time, in order to contain potential abuses of a more expansive right, the Article considers First Amendment, fair use, and first sale doctrine limitations and incorporates various elements of these limitations into proposed legislative language establishing a preemptive federal right of publicity

    Internet-based support for infertile patients: a randomized controlled study

    This study aimed to evaluate the efficacy and patient acceptance of the first German-language Internet-based treatment for infertile patients. Infertile patients (N=124) were randomly assigned to either an 8-week Internet-based cognitive-behavioral treatment, or to a waiting-list control group. Participants were assessed at treatment start, post-treatment, and at a 5-month follow-up. Outcome measures included mental health and pregnancy rate. From pre- to posttest, treated participants in contrast to controls did not show significant improvement, although between-group effect sizes were in favor of the intervention group on all mental health measures (Cohen's d ranged from 0.16 to 0.38). The intervention significantly reduced the depression level of clinically distressed and depressed participants. No effects were found regarding pregnancy rate. The treatment was assessed as positive or very positive by 80% of the participants; this finding coupled with the high demand for such support confirm that Internet-based interventions are a promising new approach for infertile patients that needs more development and testin

    Heterologous Transplantation, Chromosome Analyses, and DNA Measurements of the Human Carcinoma Tissue Culture Line, H.Ep. #2

    The human epidermoid carcinoma No.2 (H.Ep. #2), which had been kept continuously in tissue culture since 1953, was transplanted into adult, conditioned golden hamsters. Morphologically, the transplanted tumors resembled closely the original tissue from the patient. Chromosome analyses were performed on two series of H.Ep. #2 cells, both originating from Fjelde stock cultures. The First series comprised the first stock culture from Fjelde (TCF), the corresponding First hamster tumor line (H.Ep. #2/H1), and material from the latter brought back into tissue culture (H.Ep. #2/H1-TC). The second series included the second tissue culture material (H.Ep. #2/TC2) and the ensuing second hamster tumor line (H.Ep. #2/H2). Chromosome numbers of cells of the first series varied between 69 and 80, with a large peak at 74-75 and a smaller peak at 77. Four marker chromosomes were present. In the second series, a large peak was found at 69-70 and a smaller peak at 74-75. Besides the 4 markers from the First series, the cells within these peaks possessed 2 new markers, each of them characteristic for one of the peaks. The different peaks in the frequency distribution of the chromosome numbers were interpreted as representing 2 stemlines. In the first series this assumption was based on chromosome numbers only, whereas in the second series it was corroborated by the presence of the individual marker chromosomes. DNA was measured on Feulgenstained nuclei of H.Ep. #2 cells grown in vivo and in vitro. Both tumor cell lines showed their DNA values to be aggregated in two peaks: one around 3.5c and the other around 7c. Thus a correlation was established between the amount of DNA and the hypertriploid chromosome number of H.Ep. #2 cell

    Parcours de vie et dynamiques migratoires au Vietnam

Dans le cas du Vietnam, depuis le Renouveau, une transformation des opportunitĂ©s, des modĂšles de mobilitĂ© et des normes sociales a eu lieu, et par consĂ©quent, une transformation des stratĂ©gies relatives aux moyens de subsistance des mĂ©nages. Par une mĂ©thode mixte ayant recours Ă  des donnĂ©es quantitatives et qualitatives, cette recherche s’intĂ©resse aux comportements migratoires, au cycle de vie des mĂ©nages et aux besoins (« care needs ») des mĂ©nages. Le point de dĂ©part et la question suivante : comment le cycle de vie du mĂ©nage et ses besoins, lesquels sont de nature multiple et fluctuent dans le temps, influencent-ils les comportements migratoires ? Le volet quantitatif de l’analyse mesure les besoins du mĂ©nage selon trois indicateurs : le rapport de dĂ©pendance, le niveau de dĂ©penses en santĂ© et le niveau de dĂ©penses en Ă©ducation. Cette analyse de la charge du mĂ©nage et de la migration montre que les besoins du mĂ©nage ne provoquent pas forcĂ©ment une migration. Les rĂ©sultats renforcent les observations selon lesquelles la migration requiert certaines conditions et qu’au niveau du mĂ©nage, les besoins immĂ©diats ont plutĂŽt tendance Ă  prĂ©venir qu’à provoquer la migration. Un seuil au-delĂ  duquel la charge du mĂ©nage devient trop importante fait que les probabilitĂ©s de migration diminuent. Cependant, les couts de l'Ă©ducation demeurent un moteur important de la migration au Vietnam. À partir de donnĂ©es ethnographiques originales, une analyse qualitative explore le seuil Ă  partir duquel les besoins du mĂ©nage commencent Ă  limiter les possibilitĂ©s de migrations d’un ou de plusieurs de ses membres. Les rĂ©sultats montrent que l’évolution des besoins du mĂ©nage et des capacitĂ©s des membres d’un mĂ©nage modifie la façon dont le mĂ©nage s’organise et dĂ©ploie sa force de travail au fil du temps.In Asia, internal and international migrations are essential to regional studies. A transformation of opportunities, mobility models and social norms occurred in the case of Vietnam since the Renewal and, consequently, a transformation of strategies pertaining to the livelihood of households as well. Through a mixed-method approach using quantitative and qualitative data, this research focuses on migratory behaviours, the life cycle of households and households’ care needs. The departing point and research question are the following: how does the life cycle of a household and their care needs, which are by nature multiple and in constant fluctuation, influence migratory behaviours? The quantitative component measures household care needs according to three indicators: the dependency ratio, the health expenses and the education expenses. This analysis of the household’s care needs and migration demonstrate that a household’s needs do not necessarily provoke migration. The results reinforce the observations according to which migration requires certain conditions and that the immediate care needs tend to prevent rather than provoke migration at the household level. At some point, a threshold whereby care needs prevent migration is present. However, the cost of education remains an important migration driver in Vietnam. From first-hand ethnographic data, a qualitative analysis explores the threshold from which the needs of a household begin to limit the migration possibilities in a household. The results show that the evolution of care needs and capacities of the household’s members modify the way a household organizes and deploys its workforce over time

    Pediatric patients with cancer are at high risk for severe infections. Changes in vital signs, triggered by infections, may be detected earlier by continuous recording with a wearable device than with discrete measurements. This prospective, observational single-center feasibility study consecutively recruited pediatric patients undergoing chemotherapy for cancer. The WD Everion¼ was used for 14 days in each of the 20 patients on study to continuously record vital signs. Nine different vital signs and health indicators derived from them, plus six quality scores. This resulted in 274 study days (6576 hours) with 85'854 measuring points, which are a total of 772'686 measurements of vital signs and health indicators, plus 515'124 quality scores. Additionally, non-WD data like side effects, acceptability of the WD and effort for investigators were collected. In this manuscript, we present the methods of acquisition and explanations to the complete data set, which have been made publically available on open access and which can be used to study feasibility of continuous multi-parameter recording of vital signs by a WD
