    Trends in the Use of Extrinsic Aids in Statutory Interpretation

    As evidenced by the increasing numbers of court decisions which involve statutes,\u27 and by the large and continually growing literature in the field, the subject of statutory interpretation is one of the most important in modern law. Although it is a field in which exact rules of automatic application can very seldom be formulated, only recently a member of the Supreme Court pointed out the great need for a set of consistently accepted principles of interpretation. Since the primary purpose of all statutory interpretation is to ascertain the meaning and to effectuate the purposes of the legislature, and since words are merely symbols without inherent meaning, every statute upon which a court is required to rule must, in some sense, be construed and interpreted

    Miniature Latching Valve

    A miniature latching valve has been invented to satisfy a need for an electrically controllable on/off pneumatic valve that is lightweight and compact and remains in the most recently commanded open or closed state when power is not supplied. The valve includes a poppet that is moved into or out of contact with a seat to effect closure or opening, respectively, of the flow path. Motion of the poppet is initiated by electrical heating of one of two opposing pairs of nickel/titanium shape-memory alloy (SMA) wires above their transition temperature: heated wires contract to their remembered length, applying tension to pull the poppet toward or away from the seat. A latch consisting mainly of a bistable Belleville washer (a conical spring) made of a hardened stainless steel operates between two stable positions corresponding to the fully closed or fully open state, holding the poppet in one of these positions when power is not applied to either pair of SMA wires. To obtain maximum actuation force and displacement, the SMA wires must be kept in tension. The mounting fixtures at the ends of the wires must support large tensile stresses without creating stress concentrations that would limit the fatigue lives of the wires. An earlier design provided for each wire to be crimped in a conical opening with a conical steel ferrule that was swaged into the opening to produce a large, uniformly distributed holding force. In a subsequent design, the conical ferrule was replaced with a larger crimped cylindrical ferrule depicted in the figure. A major problem in designing the valve was to protect the SMA wires from a bake-out temperature of 300 C. The problem was solved by incorporating the SMA wires into an actuator module that is inserted into a barrel of the valve body and is held in place by miniature clip rings

    Worry Is Good for Breast Cancer Screening: A Study of Female Relatives from the Ontario Site of the Breast Cancer Family Registry

    Background. Few prospective studies have examined associations between breast cancer worry and screening behaviours in women with elevated breast cancer risks based on family history. Methods. This study included 901 high familial risk women, aged 23–71 years, from the Ontario site of the Breast Cancer Family Registry. Self-reported breast screening behaviours at year-one followup were compared between women at low (N=305), medium (N=433), and high (N=163) levels of baseline breast cancer worry using logistic regression. Nonlinear relationships were assessed using likelihood ratio tests. Results. A significant non-linear inverted “U” relationship was observed between breast cancer worry and mammography screening (P=0.034) for all women, where women at either low or high worry levels were less likely than those at medium to have a screening mammogram. A similar significant non-linear inverted “U” relationship was also found among all women and women at low familial risk for worry and screening clinical breast examinations (CBEs). Conclusions. Medium levels of cancer worries predicted higher rates of screening mammography and CBE among high-risk women

    Behavioural compensation by drivers of a simulator when using a vision enhancement system

    Technological progress is suggesting dramatic changes to the tasks of the driver, with the general aim of making driving environment safer. Before any of these technologies are implemented, empirical research is required to establish if these devices do, in fact, bring about the anticipated improvements. Initially, at least, simulated driving environments offer a means of conducting this research. The study reported here concentrates on the application of a vision enhancement (VE) system within the risk homeostasis paradigm. It was anticipated, in line with risk homeostasis theory, that drivers would compensate for the reduction in risk by increasing speed. The results support the hypothesis although, after a simulated failure of the VE system, drivers did reduce their speed due to reduced confidence in the reliability of the system

    This paper questions the usefulness of the rights-based approach to ameliorating the social situation of disabled people in Britain and advances two criticisms. First, that rights and self-de? ned needs have been under-theorised by disability theorists to the extent that they have insuf? ciently appreciated the problems that these approaches pose. The paper suggests that rights to appropriate resources to satisfy self-de? ned needs will generate vast numbers of competing rights claims and that the resulting tendency of rights to con? ict has been under-appreciated. Secondly, that there has been little consideration of how these con? icts might be reconciled. The ? rst two sections of the paper look at the concepts of ascribed and self-de? ned needs, respectively, whilst the ? nal one looks at some of the problems of the rights approach and some of the dif? culties of making self-de? ned need the basis of rights claims

    The use of body language in public speaking

    This research examined various methods of body language, gestures, and expressions used during public speeches. Numerous public speakers have used different techniques during their speeches to improve their presentations. Certain objectives of the research explain how body language can enhance public speech. The third objective was to examine how to prepare and implement various uses of body language into a public speech. Lastly, the research sought to identify the advantages of implementing different hand and arm movement methods while using assorted levels of voice ranges. The study was conducted by observing public speeches at expositions, seminars, government official public speeches, award acceptance speeches, and university professor lectures. Multiple prerecorded public speeches were also evaluated with the use of the internet. The primary results are that using different methods of hand gestures, arm movements, facial expressions, a strong voice, and maintaining a good posture significantly benefits public speeches. It was also established that preparing for a public speech by selecting the type of body language that will support your style of presentation will improve the success of your speech. The recommendation is that public speakers maintain a good posture and respect the audience while maintaining eye contact with all members attending the event. Additionally, the speakers should keep their hands and arm moving at all times while occasionally returning their hands to their waistline area and use various facial gestures and expressions to help entice the audience. Lastly, public speakers should use a strong voice during their speeches as it helps audience members focus during the presentation

    A field study of team working in a new human supervisory control system

    This paper presents a case study of an investigation into team behaviour in an energy distribution company. The main aim was to investigate the impact of major changes in the company on system performance, comprising human and technical elements. A socio-technical systems approach was adopted. There were main differences between the teams investigated in the study: the time of year each control room was studied (i.e. summer or winter),the stage of development each team was in (i.e. 10 months), and the team structure (i.e. hierarchical or heterarchical). In all other respects the control rooms were the same: employing the same technology and within the same organization. The main findings were: the teams studied in the winter months were engaged in more `planning’ and `awareness’ type of activities than those studies in the summer months. Newer teams seem to be engaged in more sharing of information than older teams, which maybe indicative of the development process. One of the hierarchical teams was engaged in more `system-driven’ activities than the heterarchical team studied at the same time of year. Finally, in general, the heterarchical team perceived a greater degree of team working culture than its hierarchical counterparts. This applied research project confirms findings from laboratory research and emphasizes the importance of involving ergonomics in the design of team working in human supervisory control
