    [Excerpt] Howe and Strauss (2007) propound the theory that there is a clear nexus between the significant events youth face and their attitudes in later life. This is relevant in looking at the evolution of industrial relations, especially in Sri Lanka. One could say that the historical context of Sri Lanka has played a major role in the current behaviour of management and labour—from the nationalist revival in 1956 and the culture change which gripped the country until the insurgency of 1971 which can be identified as the coming to a head of the frustrations created in relation to emancipated, educated youth who had no prospects of proper employment. The language policy introduced under the cultural revolution created a hostile divide between the English-speaking managers, who in colonial times and for several decades thereafter came from elite schools, and the ‘swabasha’1 educated workers. Since the language of management and business transactions continued to be English, it was difficult for those receiving education in the local languages to claim higher positions in the private sector although often they were better technically qualified, at least on paper, than the English- peaking candidates selected. With educated youth finding that they could not access the higher echelons without English the obvious reaction was to resent the language as well as the system which used it. The policy in the government was to use the swabasha for official transactions and this led to graduates educated by local universities moving mostly into public sector management positions, seldom securing employment in the private sector. The tension created by Sinhala-educated youth not having adequate access to jobs compatible with their education led to the insurrection in 1971. The youth of that era are now mature citizens and legislators and are therefore anxious to give fair opportunity to youth coming into the labour market by helping them acquire language skills needed for employment

The European Court of Justice issued its long-anticipated decision in the three Google AdWords cases referred to it by the French Cour de Cassation. The ruling only answers the questions posed to it by the Cour de Cassation. Nevertheless, the ECJ\u27s decision should be favorable to Google and other keyword advertising vendors throughout Europe

    Debunking Dilution Doctrine: Toward a Coherent Theory of the Anti-Free-Rider Principle in American Trademark Law

    This Article argues that while American dilution law purports to be about preventing dilutive harm, it really is about preventing free-riding on famous marks. Because of this mismatch between dilution\u27s stated purpose and hidden goal, it is a clumsy and largely incoherent doctrinal device. It does not allow judges to turn the anti-free-riding impulse into a carefully circumscribed set of principles with identifiable limits. This Article argues that it would be better to scrap dilution altogether and replace it with an independent cause of action that explicitly prevents free-riding in appropriate circumstances

    Natural resources are an assured source of government revenue, but this does not always translate into more jobs, better productivity or an increased demand for that country. Traditionally, the role of government in a resource-rich country has always been to act in the best interests of its citizens. In the case of natural resource-rich nations, this role also includes ensuring that jobs in the extractive sector are safe – both in the physical and financial sense. In such competitive environments, the private sector also has a fiduciary responsibility to ensure that all employees are fairly treated. However, it is evident that almost all African nations that are rich in resources are affected by lack of human development. This article examines the current state of affairs in the resource-rich African nations and their impact on human development. It focuses on how these resource-dependent economies are experiencing economic growth and why this growth does not directly translate into higher and better employment for the local populations. The article examines growth and human development from the perspectives of both the private- and public-sector actors. It recommends that private actors should have a complementary approach, through foreign direct investors or other modes, to the long-term policies and plans set out by the state. This approach would allow for successful intersectoral linkages and community development through higher job creation. It argues that the state is responsible for managing these natural resources and highlights the role of governance in this management. Governance issues, challenges, such as developmental gains, job creation, transparency and accountability are all addressed in the article. Finally, the article strongly recommends developing both human and institutional capital and regulating production.Keywords: Resource development, resource curse, Africa, governance,management

    An Investigation Of The Relationship Between Racial Identity Developme

    The purpose of this study was to investigate the relationship between racial identity development and career thoughts for Black seniors at an urban high school. The available population was 557 Black senior students at a high school in Orange County, Florida. With respect to this population, socioeconomic status, influences on career interest, parental level of education, parental occupations, post-secondary intentions, and plans to take the SAT or ACT were some of the specific demographic variables that were analyzed. Results from a variety of simple regression analyses revealed significant positive relationships between Black seniors\u27 perceptions of their racial identity development and their career thoughts. By way of simple regression analysis, the five variables (domains) of the Black Racial Identity Attitude Scale were analyzed in relation to the three variables (domains) of the Career Thoughts Inventory and demographic variables. With the exception of the internalization stage of Black racial identity development, statistically significant relationships were found between each of the stages of Black racial identity development (preencounter, encounter, and immersion /emersion) and the measures of the Career Thoughts Inventory (decision making confusion, external conflict, commitment anxiety). Results of the data suggest that individuals in the preencounter, encounter, and immersion /emersion stages of Black racial identity development will have moderate to high scores with respect to decision making confusion, external conflict, commitment anxiety, and negative career thoughts overall. In other words, the less developed one\u27s racial identity, the greater the likelihood of a higher degree of negative thoughts about career and career choice. As well, the results, for the most part, supported the proposed hypotheses. This initial investigation should be replicated using a large sample size and other statistical analyses in order to ascertain more and in order to more accurately determine the nature of the relationship between racial identity development and career development for Blacks
