    Canada – renewable energy : implications for WTO law on green and not-so-green subsidies

    In the first dispute on renewable energy to come to WTO dispute settlement, the domestic content requirement of Ontario’s feed-in tariff was challenged as a discriminatory investment-related measure and as a prohibited import substitution subsidy. The panel and Appellate Body agreed that Canada was violating the GATT and the TRIMS Agreement. But the SCM Article 3 claim by Japan and the European Union remains unadjudicated, because neither tribunal made a finding that the price guaranteed for electricity from renewable sources constitutes a ‘benefit’ pursuant to the SCM Agreement. Although the Appellate Body provides useful guidance to future panels on how the existence of a benefit could be calculated, the most noteworthy aspect of the new jurisprudence is the Appellate Body’s reasoning that delineating the proper market for ‘benefit’ analysis entails respect for the policy choices made by a government. Thus, in this dispute, the proper market is electricity produced only from wind and solar energy

    A major regional air pollution event in the northeastern United States caused by extensive forest fires in Quebec, Canada

    During early July 2002, wildfires burned ∌1 × 106 ha of forest in Quebec, Canada. The resultant smoke plume was seen in satellite images blanketing the U.S. east coast. Concurrently, extremely high CO mixing ratios were observed at the Atmospheric Investigation, Regional Modeling, Analysis and Prediction (AIRMAP) network sites in New Hampshire and at the Harvard Forest Environmental Measurement Site (HFEMS) in Massachusetts. The CO enhancements were on the order of 525–1025 ppbv above low mixing ratio conditions on surrounding days. A biomass burning source for the event was confirmed by concomitant enhancements in aerosol K+, NH4+, NO3−, and C2O42− mixing ratios at the AIRMAP sites. Additional data for aerosol K, organic carbon, and elemental carbon from the Interagency Monitoring of Protected Visual Environments network and CO data from Environmental Protection Agency sites indicated that the smoke plume impacted much of the U.S. east coast, from Maine to Virginia. CO mixing ratios and K concentrations at stations with 10-year or longer records suggested that this was the largest biomass burning plume to impact the U.S. east coast in over a decade. Furthermore, CO mixing ratios and aerosol particles with diameters 2.5) mass and scattering coefficients from the AIRMAP network and HFEMS indicated that this event was comparable to the large anthropogenic combustion and haze events which intermittently impact rural New England. The degree of enhancement of O3, NOy, NO3−, NH4+, and SO42− in the biomass plume showed significant variation with elevation and latitude that is attributed to variations in transport and surface depositional processes

    A determination of the spin-orbit alignment of the anomalously dense planet orbiting HD 149026

    We report 35 radial velocity measurements of HD 149026 taken with the Keck Telescope. Of these measurements, 15 were made during the transit of the companion planet HD 149026b, which occurred on 2005 June 25. These velocities provide a high-cadence observation of the Rossiter-McLaughlin effect, the shifting of photospheric line profiles that occurs when a planet occults a portion of the rotating stellar surface. We combine these radial velocities with previously published radial velocity and photometric data sets and derive a composite best-fit model for the star-planet system. This model confirms and improves previously published orbital parameters, including the remarkably small planetary radius, the planetary mass, and the orbital inclination, found to be Rp/RJup = 0.718 ± 0.065, Mp/MJup = 0.352 ± 0.025, and I = 86.1° ± 1.4°, respectively. Together the planetary mass and radius determinations imply a mean planetary density of 1.18(-0.30)(+0.38)g cm(-3). The new data also allow for the determination of the angle between the apparent stellar equator and the orbital plane, which we constrain to be λ = -12° ± 15°

    Intraoperative near-infrared spectroscopy cerebral oxygenation monitoring assists intraoperative decision-making in environments without extracorporeal membrane oxygenation (ECMO), left ventricular assist device (LVAD) or access to cardiac transplantation. We report a case of an anomalous left coronary artery arising from the pulmonary artery (ALCAPA), undergoing cardiac surgery. A 4-month-old infant presented in extremis with cardiac failure.
