Determinación de la nacionalidad de la entidad jurídica sobre la base de la teoría del control

The purpose of this article is to analyze the theory of control as a specific method of determining the nationality of a legal entity in international private law. The search for the definition and content of the control theory is usually accompanied by the statement that, unlike all other theories, the application of this theory takes into account not the legal entity itself as a whole, but the nationality of natural persons behind it (founders, participants). On the basis of the present study, it can be concluded that the theory of control is an exceptional and the only method guaranteeing the determination of the real nationality of the legal person with a view to conferring on it certain rights (benefits, privileges). This also coincides with the protection of state sovereignty and national security as confirmed by numerous examples from practice.El propósito de este artículo es analizar la teoría del control como un método específico para determinar la nacionalidad de una entidad jurídica en el derecho privado internacional. La búsqueda de la definición y el contenido de la teoría de control suele ir acompañada de la afirmación de que, a diferencia de todas las demás teorías, la aplicación de esta teoría no tiene en cuenta la entidad jurídica en sí, sino la nacionalidad de las personas físicas que la respaldan (fundadores, participantes). Sobre la base del presente estudio, se puede concluir que la teoría del control es un método excepcional y único que garantiza la determinación de la nacionalidad real de la persona jurídica con el fin de conferirle ciertos derechos (beneficios, privilegios). Esto también coincide con la protección de la soberanía estatal y la seguridad nacional, como lo confirman numerosos ejemplos de la práctica

Voluntad conjunta de los cónyuges en la legislación rusa y extranjera: una investigación comparativa

We made a comparative analysis between the legislation of Russia and some foreign countries on the joint will of spouses by methods of scientific knowledge in order to draw conclusions about the prospects of development of Russian legislation using foreign experience. We also considered the legislation on the general will of spouses and checked the the features of the joint will of spouses under the legislation of Germany, England, Ukraine and other countries. We prepared some proposals for improving the legislation of the Russian Federation on the joint will of spouses. The result of the study is the conclusion that the joint will in Russian law is a logical and justified innovation, reflecting a conceptual approach to the disposal of common property of spouses, based on the expansion of the dispositivity in inheritance law.Hicimos un análisis comparativo entre la legislación de Rusia y algunos países extranjeros sobre la voluntad conjunta de los cónyuges por métodos de conocimiento científico con el fin de sacar conclusiones sobre las perspectivas de desarrollo de la legislación rusa utilizando la experiencia extranjera. También consideramos la legislación sobre la voluntad general de los cónyuges y verificamos las características de la voluntad conjunta de los cónyuges según la legislación de Alemania, Inglaterra, Ucrania y otros países. Preparamos algunas propuestas para mejorar la legislación de la Federación de Rusia sobre la voluntad conjunta de los cónyuges. El resultado del estudio es la conclusión de que la voluntad conjunta en la ley rusa es una innovación lógica y justificada, que refleja un enfoque conceptual para la disposición de la propiedad común de los cónyuges, basada en la expansión del dispositivo en la ley de herencia

Magnetic Properties of Chain Antiferromagnets RbFeSe2, TlFeSe2, and TlFeS2

Single crystals of ternary ion chalcogenides RbFeSe2, TlFeSe2, and TlFeS2 are studied by X-ray diffraction, SQUID magnetometry, and Mossbauer spectroscopy. Common structural units of these chalcogenides are tetrahedra of FeCh4 (chalcogen Ch = Se, S), arranged in chains by sharing an edge. It is found that RbFeSe2, TlFeSe2, and TlFeS2 undergo transition to a collinear antiferromagnetic state below temperatures TN = 248, 290, and 196 K, respectively. Their magnetic moments are oriented perpendicular to the axes of the chains of FeCh4 tetrahedra

СОВЕРШЕНСТВОВАНИЕ МОТИВАЦИОННЫХ МЕХАНИЗМОВ НА БАЗЕ СИСТЕМЫ КЛЮЧЕВЫХ ПОКАЗАТЕЛЕЙ ЭФФЕКТИВНОСТИ (КPI)

Цель исследования. Целью исследования является разработка методических и практических рекомендаций, ориентированных на развитие мотивационных механизмов в трудовой деятельности на базе системы КPI. Подобная целевая установка обусловила следующий круг задач: проанализировать зарубежный опыт стимулирования трудовой деятельности; разработать технологию создания системы показателей эффективности; предложить комплекс мер, способствующих созданию совершенной, с точки зрения мотивации персонала, системы оплаты труда.Методы исследования. В работе применены методы: обобщения, анализа, научной абстракции, сравнения, наблюдения, эмпирического описания. Для улучшения восприятия информации использован графический прием ее визуализации.Результаты исследования. В рамках осуществленного исследования было получены следующие результаты: систематизирован зарубежный опыт стимулирования трудовой деятельности; разработана 7-этапная процедура создания системы показателей эффективности; намечены направления совершенствования механизмов мотивации.Заключение. В современных условиях вопросы, связанные с наращиванием качества внутрикорпоративного управления, особенно актуальны для компаний, которые своей основной целью видят повышение конкурентоспособности. Одна из наиболее перспективных технологий управления хозяйствующими субъектами, основанная на создании системы показателей эффективности, требует дальнейшего развития и совершенствования.Научная новизна. В числе наиболее значимых, обладающих научной новизной результатов, следует выделить: авторскую 7-этапную процедуру внедрения системы показателей эффективности; комплекс мер, нацеленных на совершенствование механизмов мотивации персонала российских хозяйствующих субъектов
