EU-Australia trade relations-current stage and future challenges
Wobec zastoju negocjacji na forum WTO priorytetem dla UE stały się dwustronne umowy handlowe.
W przedstawionej w 2015 r. nowej strategii handlowej i inwestycyjnej EU “Trade for All”
wyraźnie podkreślono znaczenie Australii jako bliskiego partnera Europy, podzielającego europejskie
wartości oraz odgrywającego ważną rolę zarówno w regionie Azji Pacyfi ku, jak i na forach
wielostronnych. Zapisy tej strategii stały się punktem wyjścia do podjęcia konkretnych działań
w zakresie pełniejszego uregulowania stosunków handlowych EU z Australią w postaci przyszłej
wszechstronnej FTA. Ponadto, bieżąca sytuacja w handlu światowym (związana m.in. z amerykańskim
protekcjonizmem) powoduje, że UE dąży do pogłębiania współpracy z innymi, bardziej
przewidywalnymi partnerami handlowymi. Planowana umowa przyczyni się zatem do pobudzenia
wzajemnej wymiany, co jest szczególnie ważne w świetle podpisanych już przez Australię umów
FTA z innymi państwami, w tym także kluczowymi partnerami UE. Nie bez znaczenia pozostaje
również kwestia Brexit’u.
Słowa kluczowe: Australia, FTA, handel międzynarodowy, regionalizm handlowy, UEFaced with a visible stagnation in negotiations within the WTO, the EU prioritized bilateral trade
agreements. In the EU’s newly-developed trade and investment strategy from 2015 named “Trade
for All”, Australia’s signifi cance as Europe’s close partner sharing European values and playing
an important role both in the Pacifi c region and multilateral forums was clearly emphasized. The
main assumptions of this strategy have become the starting point for taking more specifi c actions in
the fi eld of regulating trade relations between the EU and Australia in the form of the forthcoming
“comprehensive and high-quality FTA.” Moreover, the current climate in the world trade (connected
with e.g. American protectionism) is the cause of the EU’s interest in developing partnership
with other, more predictable trade partners. Hence, the agreement planned by the EU would
contribute to the stimulation of reciprocal exchange, which is of great importance bearing in mind
Australia’s successfully signed FTAs with other countries, including those with EU’s key partners.
Finally, the question of Brexit is not without signifi cance in this context.

Will TPP undermine the multilateral trading system?
A crucial factor of ever-growing regionalization of the world trade is the lasting
negotiation impasse at the multilateral level. Finding a common ground among all WTO
members has proven to be a task beyond their capabilities, consequently, some countries
focused their efforts on concluding the Regional Trade Agreements (RTAs), which are of a
smaller or larger regional range and importance to the global economy. The last group includes
the Trans-Pacific Partnership. The TPP is not supposed to oppose the WTO regulations, on the
contrary, it is designed to create the opportunities to implement the rules and deepen
cooperation within the organization. Therefore, this partnership will surely affect not only the
world trade flows, but also the progress of negotiations in the ongoing Doha Development
Round and, in consequence, the further functioning of the WTO. It is the author’s belief that,
unlike other important negotiations taking place, TPP will not weaken, but may, in a way, even
support the multilateral trading system within the WTO.Istotnym czynnikiem narastającej regionalizacji handlu światowego jest
przedłużający się impas w rokowaniach na forum negocjacji wielostronnych. Znalezienie
wspólnej płaszczyzny porozumienia między członkami WTO okazało się być zadaniem
wykraczającym poza ich możliwości, a w konsekwencji część państw skupiła się na zawieraniu
handlowych umów dwu- lub kilkustronnych (RTAs), o mniejszym lub większym zasięgu
regionalnym oraz znaczeniu dla gospodarki światowej. Do tej ostatniej grupy należy Trans-
Pacific Partnership (TPP). Mimo że, zgodnie z założeniami, porozumienie to nie ma
przeciwstawiać się regułom WTO, a wręcz przeciwnie, nawet stworzyć nowe szanse dla
wdrażania zasad i pogłębiania współpracy na forum organizacji, można przypuszczać, że
będzie miało ona istotny wpływ zarówno na strukturę handlu międzynarodowego, jak i na
przebieg negocjacji w ramach trwającej Rundy Rozwoju, a w konsekwencji na dalsze
funkcjonowanie WTO
Mega-regional blocs in global trade – from noodle bowl to jigsaw puzzle – the RCEP case
The proliferation of RTAs in Asia is a response to trade regionalism in other parts
of the world as well as an answer to the slow progress in Doha negotiations, within the World
Trade Organization (WTO), which clearly cannot keep up with the changes ongoing in the
world economy. Since the turn of the century, trade regionalism has been the most frequently
adopted form of regulating economic cooperation. It manifests itself particularly in forming
new RTAs, of which mega-regional trade agreements (MRTAs) are of great importance to the
world economy as they may change the future structure of the world trade system. The emergence
of so many FTAs caused, however, the “noodle bowl” effect. Eliminating the problems
ensuing from the confusion, e.g. by the RCEP initiative, is a complex task and yet a vital one
but the creation of that MRTA is not effortless for the parties. Nevertheless, the creation of
RCEP may serve as a tool to put in order the net of intertwining agreements, especially in that
region.Proliferacja porozumień regionalnych w Azji jest odpowiedzią na regionalizm
handlowy w innych częściach świata, ale także na impas w negocjacjach wielostronnych na
forum WTO, które ewidentnie nie nadążają za zmianami zachodzącymi w gospodarce światowej.
Od przełomu wieków obserwujemy zatem stawanie się regionalizmu handlowego główną
formą współpracy gospodarczej między krajami. Przejawia się to szczególnie w powstawaniu
nowych RTAs, z czego kluczowe znaczenie dla gospodarki światowej mają megaregionalne
bloki handlowe, gdyż to właśnie one mogą wpłynąć na zmianę struktury światowego systemu
handlowego. Jednak powstawanie tak wielu porozumień, głównie w postaci stref wolnego
handlu, doprowadziło do wystąpienia efektu „noodle bowl”. Eliminacja problemów wynikających
z tego zamieszania, m.in. poprzez inicjatywę RCEP, jest zadaniem bardzo skomplikowanym
i jednocześnie postrzeganym jako ważne wyzwanie dla stron porozumienia. Niemniej jednak utworzenie RCEP może posłużyć jako narzędzie do uporządkowania gęstej sieci przeplatających się umów handlowych, szczególnie w tym regionie
Perspektywy rozwoju stosunków handlowych Polski z Kanadą w świetle umowy CETA
Trwające ponad pięć lat negocjacje w sprawie umowy CETA (Comprehensive
Economic Trade Agreement) między UE a Kanadą zaowocowały podpisaniem porozumienia
z końcem 2016 r. Wynikająca z umowy planowana eliminacja barier taryfowych oraz pozataryfowych
w przywozie do Kanady może okazać się bardzo korzystna dla unijnych, w tym
polskich, eksporterów i przyczynić się do rozwoju polsko-kanadyjskich stosunków handlowych.
Przemawia za tym fakt, że wielkość wymiany handlowej Polski z Kanadą sukcesywnie
wzrasta, a pozycja Polski jest w tym zakresie bardziej znacząca niż pozostałych państw
członkowskich UE z Europy Środkowo-Wschodniej. Dla Polski Kanada jest zatem istotnym
partnerem handlowym, szczególnie ze względu na potencjalny wzrost polskiego eksportu. Na
uwagę zasługuje również fakt, że w strategii Global Markets Action Plan na lata 2015-2017
Polska została wskazana przez rząd Kanady jako priorytetowy oraz perspektywiczny rynek
w zakresie możliwości rozwoju dwustronnej współpracy gospodarczej.The negotiations on the Comprehensive Economic Trade Agreement between the
EU and Canada, which had been in progress for five years, resulted in signing the agreement
at the end of 2016. The planned elimination of tariff and non-tariff barriers on exports to
Canada, which results from the signed agreement, may prove to be very beneficial for EU,
including Polish, exporters and may contribute to the development of Polish-Canadian trade
relations. This claim is supported by the fact that the Poland-Canada trade volume has been
increasing gradually and Poland’s position in this regard is more prominent as compared to
other EU Member States from the Central Eastern Europe. Canada is, thus, a key trade partner
for Poland, particularly in the context of the expected, potential increase of Polish exports.
It is also worth pointing out that Poland was indicated in the 2015-2017 Global Markets
Action Plan as a priority and prospective market for Canada in terms of opportunities for the
development of bilateral trade
Perspektywy działalności Światowej Organizacji Handlu w obliczu nowych tendencji w handlu światowym – efekty XI Konferencji Ministerialnej WTO
Od 2016 r. Światowa Organizacja Handlu (WTO) liczy już 164 członków, reprezentujących ponad
98% handlu światowego. Na jej forum, od 2001 r., trwa runda wielostronnych negocjacji
handlowych, której rozpoczęcie uzgodniono na Konferencji Ministerialnej w katarskim Doha.
Jest to dziewiąta runda negocjacyjna, biorąc pod uwagę cały system GATT/WTO, natomiast
pierwsza na forum Organizacji. Została ona nazwana Rundą Rozwoju, ze względu na duży nacisk
położony na poprawę sytuacji państw najbiedniejszych. Jednak negocjacje toczące się w ramach
Rundy z Doha nie nadążają za dynamicznymi zmianami zachodzącymi w systemie gospodarki
i handlu globalnego, co przekłada się na trwający już od ponad dekady impas negocjacyjny
na forum WTO. Szans na jego przełamanie upatruje się w Konferencjach Ministerialnych państw
członkowskich WTO, które zbierają się co dwa lata. Nadzieje takie pokładano też w XI KM,
która odbyła się w grudniu 2017 r. w Buenos Aires, szczególnie dlatego, że 4 lata wcześniej
wszystkim członkom WTO udało się podpisać pierwszą umowę dotyczącą ułatwień w handlu,
która ma dać odczuwalne korzyści uczestnikom systemu wielostronnego i być potwierdzeniem
spełnienia oczekiwań społeczności międzynarodowej o skutecznie realizowanym procesie liberalizacji
handlu światowego. Jednak fiasko uzgodnień XI KM, a właściwie ich braku, utwierdziło
w przekonaniu o kryzysie na forum wielostronnym. Nasuwa to pytanie o dalsze losy Organizacji
pełniącej rolę nadrzędnego forum negocjacyjnego w handlu światowym, zwłaszcza w kontekście proliferacji RTAs, co również przyczynia się do osłabiania jej pozycji. Pojawia się zatem dylemat
dotyczący roli, jaką WTO odgrywa i odgrywać będzie w przyszłości, szczególnie w kontekście
wniesionego przez WTO wkładu w rozwój gospodarki światowej i walki z protekcjonizmem, co
w obliczu bieżącej sytuacji w handlu globalnym (m.in. amerykańskiego protekcjonizmu i niebezpieczeństwa
wybuchu wojny handlowej) może być kwestią o znaczeniu priorytetowym.Since 2016 the World Trade Organization (WTO) consists of 164 members representing over
98% of the world trade. Under its aegis, the multilateral trade-negotiation round has been in
progress since its commencement at the Ministerial Conference in the Qatari city of Doha, in
2001. It has been the ninth negotiation round, taking into account the entire GATT/WTO system,
and the first within the organization. This round is referred to as the Development Round owing
to the great emphasis put on the improvement of the situation of the poorest countries. However,
the ongoing Doha Round negotiations cannot keep abreast of dynamic changes occurring in the
economic system and global trade, which translates into the WTO negotiation impasse lasting
over a decade. The Ministerial Conferences of WTO member states, held every two years, are
seen as a chance for breaking the deadlock. Such hope was also entertained in the case of the XI
MC, which took place in Buenos Aires, in 2017, particularly since four years earlier all WTO
members managed to sign the fi rst trade facilitation agreement, which is expected to bring tangible
benefi ts to participants of the multilateral system as well as confi rm meeting expectations
of the international community with regard to the effectiveness of implementation of the process
of world trade liberalization. However, due to the arrangements failure or, rather, lack thereof,
XI MC reaffi rmed the general conviction of the crisis of multilateral talks. This raises the question
of the future of the organization and its role as the overarching negotiation forum for the
world trade, particularly in the context of proliferation of RTAs, which also undermines its position.
Therefore, we are confronted with the dilemma of the present and future role of the WTO,
specifi cally in the context of the WTO’s contribution in the development of the world economy
and its fi ght against protectionism, which, in the face of the current situation in the global trade
(American protectionism and a threat of the outbreak of a trade war, among others) may become
an issue of paramount importanc
Trade Regionalism and its Relevance to the Multilateral System Within the WTO in Need of Reform – The Case of EVFTA
Rozszerzający się i postępujący kryzys w wypełnianiu kluczowych funkcji WTO, prowadzący
organizację w kierunku gruntownej reformy, jest głównym powodem proliferacji regionalnych
porozumień handlowych (Regional Trade Agreements, RTAs) na całym świecie. Zwyżkowy
trend w tym zakresie można zaobserwować również w działaniach podejmowanych przez Unię
Europejską. RTAs stanowią coraz bardziej istotny element polityki handlowej UE, a szczególnie
zauważalne jest w tym kontekście zainteresowanie regionem Azji Pacyfi ku. Celem artykułu jest
analiza i przedstawienie istoty umowy o wolnym handlu między UE a Wietnamem (EU-Vietnam
Free Trade Agreement, EVFTA) jako regionalnego porozumienia handlowego w kontekście relacji
z systemem wielostronnym w ramach WTO. Zawarta z Wietnamem umowa o wolnym handlu
może przyczynić się do umocnienia pozycji UE w regionie Azji Pacyfiku, a także stanowić podwaliny dla przyszłej umowy międzyregionalnej UE i ASEAN. Dzięki uwzględnieniu zagadnień
nienadających się jeszcze do dyskusji na szczeblu wielostronnym, RTAs, takie jak EVFTA,
będą również stanowiły podstawę dla następnego etapu wielostronnej liberalizacji handlu. Czerpanie
z dorobku organizacji potwierdza zatem, że reguły systemu stworzonego w ramach WTO,
z pewnością nie do końca doskonałego, stają się często podstawą współpracy również w wymiarze
regionalnym.The ever-expanding and progressive crisis in fulfi lling its key roles by the WTO, leading this organization
towards sweeping reforms, is the primary reason behind the proliferation of Regional Trade
Agreements (RTAs) all over the world. The growing trend in this regard could also be observed
in actions taken by the European Union. RTAs constitute an increasingly more signifi cant element
of the EU’s trade policy, with the region of Asia-Pacifi c being of particular interest in this context.
The aim of the paper is to analyze and present the essence of EU-Vietnam Free Trade Agreement
(EVFTA) as a regional trade agreement in the context of relations with the multilateral system under
the WTO. The free trade agreement concluded with Vietnam may contribute to strengthening
the EU’s position in the Asia-Pacifi c region, as well as lay the foundations for the future interregional
agreement between the EU and ASEAN. By including issues not yet suitable for discussion at the
multilateral level, RTAs, such as EVFTA, will serve as a stepping stone for the future liberalization
by building grounds for the next stage of multilateral liberalization. Building upon the work of the
organization, reaffi rms that the rules of the system created under the WTO, admittedly, not quite
perfect, often become the foundation for cooperation, also in the regional dimension

1 stycznia 2010 roku zaczęła działać nowa strefa wolnego handlu między Chinami a Stowarzyszeniem Krajów Azji Południowo-Wschodniej (ASEAN), czyli tzw. CAFTA (China-ASEAN Free Trade Agreement). Jest to aktualnie najbardziej rozległa i trzecia pod względem wielkości PKB strefa wolnego handlu (po UE i NAFTA). Podpisane porozumienie umożliwi krajom ASEAN uzyskanie swobodnego dostępu do najbardziej dynamicznie rozwijającego się rynku. Z kolei Chiny zwiększą swoje wpływy, zarówno polityczne, jak i i ekonomiczne w Azji Południowo-Wschodniej, co może dać im przewagę nad regionalnymi konkurentami. Ponadto duża skala zjawiska trójstronnej współpracy w regionie powoduje rozwój handlu partnerów uczestniczących w przedsięwzięciach, a finalnie pobudza handel światowy. on 1 January 2010. It is said to be the biggest and in the future the most developed
and powerful union in the world which will push aside other powers such as the
EU. CAFTA makes up a powerful economic area (inhabited by 1,9 bin people) with
its turnover of 200 bin dollars. Today it is the largest and the third biggest free
trade area as regards GDP (after the European Economic Area and North American
Free Trade Area).
The signed Agreement will enable the ASEAN members to have a free access to
the most dynamically developing economic market. Whereas China will increase
its impact, both political and economic, in Southeast Asia which can give it an advantage
over local competitors
