Kaidah Kemudaratan dalam Prosesi Penyelenggaraan Jenazah Transgender (Studi Analisis Kaidah Lā Ḍarara Wa Lā Ḍirāra)

Hasil penelitian ini menjelaskan bahwa prinsip Islam adalah menghilangkan kemudaratan sebisa mungkin. Oleh sebab itu, dalam Islam terdapat kaidah-kaidah kemudaratan dengan kaidah induk “lā ḍarara wa lā ḍirāra”. Adapun transgender merupakan perilaku menyerupai lawan jenis dalam penampilan dan perbuatan serta terjadinya pergantian kelamin dari laki-laki menjadi perempuan atau sebaliknya. Transgender yang mengganti jenis kelamin merupakan kajian utama pada penelitian ini. Berdasarkan analisis kaidah kemudaratan dapat disimpulkan bahwa jenazah transgender diselenggarakan sesuai dengan jenis kelamin asalnya sebab kemudaratan yang ditimbulkan lebih bersifat khusus dan ringan. Selain itu, pada prosesi memandikan jenazah hukumnya dikiaskan dengan hukum khunsa musykil yaitu dengan ditayamumkan untuk menjaga auratnya dan menghindari kaum muslimin melihat dan menyentuh aurat tersebut. Proses tayamum sebaiknya dilakukan oleh keluarga (mahram) jenazah jika ada. Kedua kemudaratan akhirnya dapat dihilangkan dengan memberlakukan solusi ini, sebab kemudaran wajib dicegah dan dihilangkan sebisa mungkin. Petugas penyelenggaraan jenazah sebaiknya menyampaikan secara terbuka kepada pihak keluarga dan masyarakat sebelum jenazah transgender tersebut diselenggarakan tentang larangan melakukan perbuatan transgender dan mudarat yang ditimbulkan baik ketika masih hidup maupun setelah meninggal. Dijelaskan pula bahwa jenazahnya dihukumi sesuai dengan jenis kelamin asalnya. Adapun prosesi memandikan jenazah diganti dengan tayamum untuk menghindari petugas dari mudarat menyelenggarakan jenazah yang berbeda dengan gender mereka

Toleransi yang Bijak sebagai Solusi Islam dalam Menyikapi Pluralitas

Humans live in plurality, which is an unavoidable phenomenon that can encourage conflict and has the potential to divide people. To realize unity based on existing differences, one of the values that must be upheld is the value of tolerance. This research aims to find out Islam's attitude towards plurality, what kind of tolerance is taught, and examples of its implementation. This research is qualitative literature research with a normative theological approach. The results of the research show that Islam's attitude towards plurality is to apply wise tolerance, not the excessive tolerance that is often applied in Indonesia. Wise tolerance means responding to religious plurality with each party continuing to follow its religion, upholding the principles of faith, which are the most basic things in religion, and not disturbing the existence of other parties. It is hoped that with wise tolerance, people can live in peace and tranquility without having to sacrifice the principles of faith that are embedded in their religion

Poligami dalam Perspektif Kader Muslimah Wahdah Islamiyah Makassar

This study aimed to determine the concept of polygamy in Islam and to identify polygamy from the perspective of the Muslimah Wahdah Islamiyah's cadres in Makassar. The problems that the authors raise in this study are; First, what is the concept of polygamy in Islam. Second, what is the perspective of Muslimah Wahdah Islamiyah Makassar's cadres on polygamy. To find answers to these problems, the author employed a quantitative approach which is designed as survey research using a questionnaire for data collection. Then the understanding of the results of the analysis is interpreted descriptively. The results of the study found that the perspective of Muslimah Wahdah Islamiyah's cadres in Makassar on polygamy can be seen based on two things, namely the level of knowledge and understanding of the Muslimah Wahdah Islamiyah's cadres in Makassar towards polygamy which is in the medium category and the level of agreement of statements regarding the perceptions and attitudes of Muslimah Wahdah Islamiyah Makassar's cadres against polygamy which is classified as positive and falls into the "approved" categor
