    Land Dispute Resolution: Village Deliberation and Consensus to Establish Public Order

    Land disputes are common in society, and the village head, as witnessed by the family, resolved the matter in congruent with the parties' will and good intention. Purpose to investigate the arrangement of land dispute resolution in Indonesia; and to investigate its application through consensus deliberation in villages to realize public order. Methodology an socio-legal approach, involving primary data gathered from the interview. Furthermore, the study was also conducted in Kuningan Regency. Findings in Indonesia, land disputes resolution have been completely regulated, ranging from laws to derivative regulations and is carried out through community discourse and consensus. However, deliberation method is more common than going to the court. The deliberations include bringing the parties together; if peace arrangements can be made, they will be made. It can, however, only function optimally if both sides (the family and the community) agree to deliberate. The method is thought to be more efficient in terms of time, cost, and mechanism.  Conclusion in the village, there are two procedures for resolving land conflicts through consensus deliberation: mediation and family negotiation. Recommendation at the village level, it is critical to provide a legal framework for deliberation so that the outcomes are more equitable and mutually beneficial to all partie

    The process of transferring bengkok land ownership rights through land swap agreements is frequently done, but due to lack of understanding of the legislations, the transfer of land rights often experiences various problems. This study aims to find out the mechanism of transferring bengkok land ownership rights through land swap agreements based on the legislations as well as the process of certifying bengkok land into proprietary land. This descriptive-analytic study applied an empirical juridical approach. The results showed that the mechanism of transferring bengkok land ownership rights through land swap agreements in Kuningan District is regulated in Kuningan District Regulation No. 44 of 2017 concerning Management of Village Assets. Meanwhile, the process of certifying bengkok land into proprietary land is regulated in Article 17 of Government Regulation No. 27 of 2014 concerning Management of State/Regional Property. In conclusion, the process of transferring land ownership rights, especially state-owned land, shall to be done in a written form and is based on the applicable legislation. Peralihan Hak Milik Tanah Bengkok Melalui Perjanjian Tukar Guling Proses peralihan hak milik tanah bengkok melalui perjanjian tukar guling sering dilakukan namun karena ketidak pahaman terhadap peraturan perundang-undangan, peralihan hak milik atas tanah tersebut mengalami berbagai permasalahan. Tujuan penelitian adalah untuk mengetahui mekanisme peralihan tanah bengkok melalui perjanjian tukar guling menurut perundang-undangan dan proses pensertifikatan tanah bengkok menjadi tanah hak milik. Jenis penelitian deskriptif-analistis dengan pendekatan yuridis empiris. Hasil penelitian mengemukakan bahwa Mekanisme peralihan tanah bengkok melalui perjanjian tukar guling di Kabupaten Kuningan diatur dalam Peraturan Bupati Kuningan Nomor 44 Tahun 2017 tentang Pengelolaan Aset Desa dan Proses pensertifikatan tanah bengkok menjadi tanah hak milik diatur dalam Pasal 17 Peraturan Pemerintah Nomor 27 Tahun 2014 adalah pengalihan kepemilikan barang negara/daerah. Kesimpulannya Dalam proses perjanjian tukar menukar tanah terutama tanah milik negara perlunya dilakukan secara tertulis dan sesuai dengan peraturan perundangan yang berlaku

    The Implementation of the Agreement of Water Pipeline Installation Between Regional Water Companies with CV. Tenjo Laut

    Abstract : The present study aims to analyze the arrangement and implementation of the agreement of water pipeline installation between Tirta Kamuning Regional Water Company and CV. Tenjo Laut. This descriptive-analytical study applied an empirical juridical approach. The results showed that the agreement of water pipeline installation between Tirta Kamuning Regional Water Company and CV. Tenjo Laut was based on the legislations, especially Article 64 of Law No. 13 of 2003, Article 65 Paragraph 3 of Law No. 13 of 2003, Presidential Regulation No. 70 of 2012, Article 1320 of the Civil Code, and Article 1338 of the Civil Code. Thus, in general, the implementation of the agreement of water pipeline installation between Tirta Kamuning Regional Water Company and CV. Tenjo Laut didasarkan atas peraturan perundang-undangan yang diatur oleh Pasal 64 Undang-Undang Nomor 13 Tahun 2003, Pasal 65 Ayat 3 Undang-Undang Nomor 13 Tahun 2003, Peraturan Presiden Nomor 70 Tahun 2012, Pasal 1320 Kitab Undang-Undang Hukum (KUH) Perdata, dan Pasal 1338 Kitab Undang-Undang Hukum Perdata; dan implementasi perjanjian pemasangan pipa air minum antara Perusahaan Daerah Air Minum Tirta Kamuning dengan CV.     The cases of Copyright infringement in the form of plagiarism is done on the internet at the current often take place between them on social media, blogs and websites done by academics and non-academics by internet users. Copyright infringement is very harmful form of plagiarism is certainly given to copyright are moral rights and economic rights that need to be protected, and should receive protection. This study was conducted to examine and analyze the legal protection of the papers on the internet media if the legal consequences of copyright infringement against papers on the internet media and remedies that can be done if the creators of written works was plagiated by others . In order to achieve the objectives and obtain the data, this research using normative juridical approach qualitatively using secondary data in the form of legislation , legal documents and other legal materials. The results of this study stated that the papers found on the internet is protected by Article 12 of the Law of Copyright and reinforced by Article 25 of the Law on Information and Electronic Transactions . If plagiarism is used by a person or a group of academics then used Minister of Education Regulation  No. 40 of 2010 regarding the prevention of plagiarism . Due to the law of copyright infringement can be a claim for damages , fines and or imprisonment in accordance with the rules of the Copyright Act and, where academics will be subject to administrative sanctions and when done in social media it will be socially sanctioned .     Regulation of Physical Data on Land Destroyed by Natural Disasters

    Natural disaster has a multifaceted impact on the environment, the land for instance. The demolition of land boundaries and the loss of legal footing ownership intricate problem surrounding reconstruction. Not to mention the massive losses suffered by citizens as a result of natural disasters that exacerbate the situation. The study employed socio-legal method, referring to library sources such as books, journals, statutory regulations and literature reviews. According to the findings, tangible data on destroyed land caused by natural disaster is fairly organized. Furthermore, the legal position of land rights affected by an earthquake is not removed; nonetheless, the abrasion-caused is discarded. Accordingly, the government, notably the National Land Agency, should create regulations that control and streamline the procedure for victims who have lost their civil rights, land boundaries-disaster that have been lost or cannot be recognize

    The Legal Protection of House Ownership Credits

    The purpose of this study is to analyze the arrangement and the application of House Ownership Credits known as KPR based on the prevailing laws and regulations. This study employed a juridical-empirical approach. The juridical approach was used to analyze various laws and regulations. Meanwhile, the empirical approach was used to analyze the law which was viewed as a patterned community behavior in people’s lives that continually interacts and relates to social aspects. Reffering to the state regulation of public housing number 6 of 2011, the findings revealed the procurement of housing and settlements was supported by housing and financial aid in the form of housing subsidies through credits/home ownership financing. In addition, it is also required to submit a collateral in each application of a mortgage agreement with the bank. This collateral provides an assurance to the bank that the credit granted to the customers returns according to mutually agreed terms and minimizes the possible risk involved and arise in any credit disbursement. Meanwhile, in terms of providing credits to prospective debtors, the bank must have a confidence in the debtors’ ability or capability to repay the loan. In conclusion, credit is a loan-borrowing agreement between the bank and the other party that requires the borrower to pay off his debt with the amount of interest, compensation or profit sharing within a certain period of time. Besides, in the implementation of legal aspects for credit applicants, a general home ownership credit applicant is an individual or human who is not a legal entity. Humans who are not legally incorporated are legal subjects. Thus, a credit analyst and an authorized officer who work in a credit unit must be able to fully understand the ins and outs of the credit applicant’s legal aspects.Tujuan penelitian yaitu menganalisis Pengaturan dan Pelaksanaan Perjanjian Kredit Pemilikan Rumah (KPR) Berdasarkan Peraturan Perundang-Undangan. Metode Penelitian yang digunakan dalam penelitian ini adalah Pendekatan Yuridis Empiris. Pendekatan Yuridis digunakan untuk menganalisis berbagai peraturan perundang-undangan. Sedangkan pendekatan empiris digunakan untuk menganalisis hukum yang dilihat sebagai perilaku masyarakat yang berpola dalam kehidupan masyarakat yang selalu berinteraksi dan berhubungan dalam aspek kemasyarakat. Hasil penelitian yaitu peraturan menteri negara perumahan rakyat nomor 6 tahun 2011 tentang perumahan rakyat menyebutkan bahwa pengadaan perumahan dan pemukiman dengan dukungan bantuan pembiayaan perumahan dalam bentuk subsidi perumahan melalui kredit/pembiayaan pemilikan rumah. Setiap pelaksanaan perjanjian kredit pemilikan rumah pada bank, disyaratkan untuk menyerahkan jaminan. Fungsi jaminan ini adalah untuk memberikan keyakinan kepada bank bahwa kredit yang diberikan kepada nasabah dapat diterima kembali sesuai dengan syarat-syarat yang telah disepakati bersama, dan itu juga untuk meminimalisir resiko yang terkandung dan senantiasa dimungkinan dapat timbul dalam setiap pelepasan kredit.Berkaitan dengan pemberian kredit kepada calon debitur, maka pihak bank harus mempunyai keyakinan atas kemampuan atau kesanggupan pengembalian pinjaman kredit oleh debitur. Simpulan bahwa kredit adalah persetujuan atau kesepakatan pinjam-meminjam antara bank dan pihak lain yang mewajibkan peminjam untuk melunasi utangnya setelah jangka waktu tertentu dengan jumlah bunga, imbalan atau pembagian hasil keuntungan. Pelaksanaannya aspek hukum bagi pemohon-pemohon kredit. Pada umumnya pemohon kredit pemilikan rumah adalah perorangan atau manusia dan tidak berbadan hukum.     Abstrak : Desentralisasi yang berkembang di Indonesia memiliki suatu tujuan dalam perkembangan ekonomi di Indonesia, yaitu meningkatkan perekonomian dari sector terkecil yang terdapat di daerah. Berdasarkan hal tersebut pemerintah daerah mendapatkan delegasi kewenangan dari pemerintahan pusat untuk membentuk suatu kebijakan yang mendukung peningkatan perekonomian daerah. Tujuan penelitian ini adalah untuk mengetahui dan menganalisis bagaimana pengaturan tentang Bangunan yang melanggar ketentuan Garis Sempadan Jalan di Pasar Darma Kabupaten Kuningan sesuai Peraturan Daerah Nomor 8 Tahun 2013 tentang Garis Sepadan Jalan dan Bagaimana Implementasi dari Pasal 6 Peraturan Daerah Nomor 8 tahun 2013 tentang Garis Sempadan Jalan di Pasar Darma Kecamatan Darma Kabupaten Kuningan?. Penelitian ini dilakukan dengan metode pendekatan yuridis emipis dengan spesifikasi penelirian deskriptif analitis yang melibatkan penelitian kepustakaan dan penelitian lapangan dengan menggunakan data primer dan data sekunder serta metode penarikan kesimpulan analisis yuridis kualitatif, data yang terkumpul kemudian dianalisis secara kualitatif. Hasil penelitian ini menemukan bahwa ketidaksesuaian fungsi ruang garis sempa dan jalan yang itu terdapat bangunan di area garis sempadan jalan tersebut. Peraturan Daerah Nomor 8 Tahun 2013 tentang Garis Sepadan Jalan terdapat ketentuan pidana bagi pelanggar area garis sempadan jalan. Selain itu implementasi dari Pasal 6 Peraturan Daerah Kabupaten Kuningan Nomor 8 Tahun 2013 tidak sesuai dengan yang diharapkan aturan tersebut, yaitu jarak garis sempadan jalan yang seharusnya 14.5 meter dari garis tengah jalan ditemukan hanya kurang dari 10 meter dari garis tengah jalan. Kesimpulannya perlunya dilakukan penataan dan sosialisasi kepada masyarakat terkait dengan garis sepadan jalan.Kata Kunci  : izin, jalan, pelanggaran THE IMPLEMENTATION OF REGIONAL REGULATION NUMBER 8 YEAR 2013 ABOUT BOUNDARY LINE IN KUNINGAN  REGENCY Abstract : The decentralization that developed in Indonesia has a goal in economic development in Indonesia is to improve the economy of the smallest sector in the region. The purpose of this study is to find out and analyze how the arrangement of the building that violates the provisions of the boundary line in Pasar Darma Kuningan district according to Local Regulation No. 8 of 2013 on the boundary line and how to implementation of Article 6 of Regional Regulation No. 8 of 2013 on boundary line in Darma Market, Darma District, Kuningan Regency. This research using the method of juridical emipis approach with descriptive analytical specification involving library research and field research using primary, secondary data and method of conclusion of qualitative juridical analysis, analyzed qualitatively. The results of this study found that the mismatch of boundary line and building space functions in the area of the boundary line. In the regional regulations there is a criminal provision for offenders of the boundary line area. The implementation of Article 6 of Regional Regulation of Kuningan Regency Number 8 of 2013 is not in accordance with the regulation, ie the distance of the boundary line  that should be 14.5 meters from the center line of the road is found to be less than 10 meters from the center line of the road.
