    Uncomfortable Bedfellows: Locke and the Libertarian Theory of Property

    Libertarians, such as Robert Nozick, have often appealed to Locke’s labor theory as the basis in which to defend full ownership rights to property. My central claim is that this is a mistake. Locke, I argue, is not a comfortable libertarian bedfellow for the following three reasons. (1) Locke’s account of property neither implies rights to full ownership, nor was Locke himself committed to the view. (2) The conditions Locke\u27s labor theory places on property rights would generate a state that more closely aligns with the welfare state than the libertarian minimal state. (3) Even when we ignore Locke’s theological commitments—commitments that tend to support (1) and (2)—and operationalize his labor theory on secular grounds, full ownership rights would not follow. I conclude that if libertarians are serious about defending rights to full ownership, it\u27s unlikely to be found in Locke

    Abstract: This study aims to determine the law and consequences of murder cases on the inheritance they leave. The research method used is the research library on the study of the jurisprudence school of heirs who kill and are killed. Research has found that Fuqaha agrees that killing is a barrier to inheritance. People who kill do not inherit people who are murdered. The Maliki School argues that deliberate killing because of anger is the cause of the obstruction of inheritance, as for those committed because of defending rights, is not absolutely a barrier to inheritanceAbstrak: Penelitian ini bertujuan untuk mengetahui hukum dan akibat dari kasus pembunuhan terhadap warisan yang ditinggalkannya. Metode penelitian yang digunakan library research terhadap kajian mazhab fikih terhadap waris yang membunuh dan dibunuh. Penelitian menemukan bahwa Fuqaha bersepakat bahwa membunuh adalah penghalang warisan. Orang yang membunuh tidak mewarisi orang yang dibunuh.     Thoughts on xenophobia, disruptive nation and “Man on Ground”

    Abstract: Stories of Africans displaced by war taking high risks to get to an often inhospitable Western Europe are frequently in the news. But sub-Saharan Africa is the region which hosts the largest population of refugees in the world. Refugees who flee to sub-Saharan African countries are also frequently subjected to xenophobic exclusion and violence by people who sometimes claim to be defending rights and privileges associated with national belonging. My aims are to point out new avenues for novel insights into the interrelations between xenophobia, disruption and nation by a) giving attractive detail and depth to the discussion using Director Akin Omotoso’s Man on Ground (2011), b) putting forward arguments against xenophobic stereotypes and violence, c) pointing out some pitfalls of nation-building, and by d) finding and imagining human ground amidst disruptive nationhood. What is offered is a new synthesis of philosophical insights that defies distinctions between African and Western philosophy. Going beyond nativism and xenophobia, this synthesis speaks of the need and possibility to craft common human ground that enables people to become the most they can be
