    Parker and Usery: Portended Constitutional Limits on the Federal Interdiction of Anticompetitive State Action

    This Article examines in detail the policies underlying these recent Supreme Court decisions interpreting the Sherman Act and shows that they have equal applicability to FTC enforcement of the Clayton and FTC Acts. The Article identifies the factual criteria used by the courts for distinguishing state and private conduct that is subject to the antitrust laws, and to congressional commerce dictates, from sovereign state regulatory conduct that is immune from antitrust sanction. The Article then focuses on the impact of Usery, which provides constitutional support for the so-called state action doctrine that was originated in Parker v. Brown. Finally, we conclude that the state action doctrine is not limited to the confines of the Sherman, Clayton, or FTC Acts but may well stand as a constitutional limitation on the substantive, economic powers of Congress and its regulatory agencies

    Long-range interactions and the sign of natural amplitudes in two-electron systems

    In singlet two-electron systems the natural occupation numbers of the one-particle reduced density matrix are given as squares of the natural amplitudes which are defined as the expansion coefficients of the two-electron wave function in a natural orbital basis. In this work we relate the sign of the natural amplitudes to the nature of the two-body interaction. We show that long-range Coulomb-type interactions are responsible for the appearance of positive amplitudes and give both analytical and numerical examples that illustrate how the long-distance structure of the wave function affects these amplitudes. We further demonstrate that the amplitudes show an avoided crossing behavior as function of a parameter in the Hamiltonian and use this feature to show that these amplitudes never become zero, except for special interactions in which infinitely many of them can become zero simultaneously when changing the interaction strength. This mechanism of avoided crossings provides an alternative argument for the non-vanishing of the natural occupation numbers in Coulomb systems.Comment: 10 pages, 4 figure

    Inactivation of cloned Na channels expressed in Xenopus oocytes

    This study investigates the inactivation properties of Na channels expressed in Xenopus oocytes from two rat IIA Na channel cDNA clones differing by a single amino acid residue. Although the two cDNAs encode Na channels with substantially different activation properties (Auld, V. J., A. L. Goldin, D. S. Krafte, J. Marshall, J. M. Dunn, W. A. Catterall, H. A. Lester, N. Davidson, and R. J. Dunn. 1988. Neuron. 1:449-461), their inactivation properties resemble each other strongly but differ markedly from channels induced by poly(A+) rat brain RNA. Rat IIA currents inactivate more slowly, recover from inactivation more slowly, and display a steady-state voltage dependence that is shifted to more positive potentials. The macroscopic inactivation process for poly(A+) Na channels is defined by a single exponential time course; that for rat IIA channels displays two exponential components. At the single-channel level these differences in inactivation occur because rat IIA channels reopen several times during a depolarizing pulse; poly(A+) channels do not. Repetitive stimulation (greater than 1 Hz) produces a marked decrement in the rat IIA peak current and changes the waveform of the currents. When low molecular weight RNA is coinjected with rat IIA RNA, these inactivation properties are restored to those that characterize poly(A+) channels. Slow inactivation is similar for rat IIA and poly(A+) channels, however. The data suggest that activation and inactivation involve at least partially distinct regions of the channel protein

    A quantitative comparison of the cost of employing EOR-coupled CCS supplemented with secondary DSF storage for two large CO2 point sources

    AbstractThis paper explores the impact of the temporally dynamic demand for CO2 for CCS-coupled EOR by evaluating the variable demand for new (i.e., non-recycled) anthropogenic CO2 within EOR projects and the extent to which EOR-coupled CCS is compatible with the need for baseload CO2 storage options for large anthropogenic point sources. A profile of CO2 demand over an assumed EOR project lifetime is applied across two different storage scenarios to illustrate the differences in cost associated with different EOR-coupled CCS configurations. The first scenario pairs a single EOR field with a DSF used to store any CO2 that is not used to increase oil recovery in the EOR field; the second scenario is designed to minimize storage in the DSF and maximize lower-cost EOR-based storage by bringing multiple EOR projects online over time as the previous project’s CO2 demand declines, making the source’s CO2 available for a subsequent project. Each scenario is evaluated for two facilities, emitting 3 and 6 MtCO2/y. Annual and lifetime average CO2 transport and storage costs are presented, and the impact of added capture and compression costs on overall project economics is examined.The research reported here suggests that the cost of implementing a CCS-coupled EOR project will be more than is typically assumed; in many cases a positive price on CO2 emitted to the atmosphere will be required to motivate deployment of these CO2-based EOR projects, except in the most idealized cases. The reasons for this conclusion are twofold. First, the costs of capitalizing, operating and monitoring a secondary DSF to provide backup storage for CO2 not demanded by the EOR operation can cut sharply into EOR revenues. Second, except in cases where a single firm figures both the CO2 source emissions and the associated EOR recovery on the same balance sheet, the oil production company is not likely to share a significant portion of revenues from the EOR field with the CO2 source. Thus, while EOR-coupled CCS may offer attractive early opportunities, these opportunities are likely only available to a small fraction of the CO2 source fleet in the U.S

    This article describes the underlying theory and practice of a Distinctly Jesuit Approach to Athletics, which was represented at the 2016 Vatican Conference, Sport at the Service of Humanity. The approach has been developed and implemented in a collaboration between the Institute for Excellence & Ethics (IEE) and the athletics departments at Le Moyne College and The University of Scranton. The article recounts the context that was the foundation for the work, the process for developing this distinct type of Athletics Department, and the early results of the ongoing work. The steps included here represent a rigorous and replicable model for unique formation and unique community through the athletics experience, which demonstrates the potential to advance mission without compromising excellence or margin

    Paleomagnetism and geochronology of the Ecstall pluton in the Coast Mountains of British Columbia: Evidence for local deformation rather than large-scale transport

    Samples for geochronologic, geobarometric, and paleomagnetic analyses were collected across the northern portion of the Ecstall pluton southeast of Prince Rupert, British Columbia. Al-in-hornblende geobarometry indicates pressures from 740 ± 10 to 840 ± 30 MPa corresponding to crystallization depths of ∼25 to ∼30 km. U/Pb analyses of zircons from western, central, and eastern localities within the pluton yield crystallization ages of 91.5 ± 1.0 Ma, 90.8 ± 1.0 Ma, and 90.5 ± 1.0 Ma, respectively. Rock magnetic experiments, reflected light microscopy, and thermal demagnetization behavior suggest that natural remanent magnetism is carried by low-Ti titanohematite. Unblocking temperatures of the characteristic remanent magnetization (ChRM) are dominantly in the 560°C to 630°C range, with age of magnetization approximated by the 40Ar/39Ar hornblende ages of 84.2 ± 0.10 Ma on the western margin and 76.4 ± 0.6 Ma in the center of the pluton. Site-mean ChRM directions were isolated for paleomagnetic samples from 23 sites and are distributed along a small circle with subhorizontal axis at ∼340° azimuth. ChRM directions from the central portion of the pluton are concordant with the expected Cretaceous magnetic field direction, while ChRM directions from the western margin are discordant by \u3e70°. Folding of the Ecstall pluton, either during Late Cretaceous west directed thrust transport above the convex upward Prince Rupert Shear Zone or during younger deformation of the pluton and underlying shear zone, can account for the paleomagnetic data and is consistent with the geochronologic, geobarometric, and structural geologic observations

    Superoxide dismutase downregulation in osteoarthritis progression and end-stage disease

    Oxidative stress is proposed as an important factor in osteoarthritis (OA). To investigate the expression of the three superoxide dismutase (SOD) antioxidant enzymes in OA. SOD expression was determined by real-time PCR and immunohistochemistry using human femoral head cartilage. SOD2 expression in Dunkin–Hartley guinea pig knee articular cartilage was determined by immunohistochemistry. The DNA methylation status of the SOD2 promoter was determined using bisulphite sequencing. RNA interference was used to determine the consequence of SOD2 depletion on the levels of reactive oxygen species (ROS) using MitoSOX and collagenases, matrix metalloproteinase 1 (MMP-1) and MMP-13, gene expression. All three SOD were abundantly expressed in human cartilage but were markedly downregulated in end-stage OA cartilage, especially SOD2. In the Dunkin–Hartley guinea pig spontaneous OA model, SOD2 expression was decreased in the medial tibial condyle cartilage before, and after, the development of OA-like lesions. The SOD2 promoter had significant DNA methylation alterations in OA cartilage. Depletion of SOD2 in chondrocytes increased ROS but decreased collagenase expression. This is the first comprehensive expression profile of all SOD genes in cartilage and, importantly, using an animal model, it has been shown that a reduction in SOD2 is associated with the earliest stages of OA. A decrease in SOD2 was found to be associated with an increase in ROS but a reduction of collagenase gene expression, demonstrating the complexities of ROS function

    Bose-Fermi mixtures in 1D optical superlattices

    The zero temperature phase diagram of binary boson-fermion mixtures in two-colour superlattices is investigated. The eigenvalue problem associated with the Bose-Fermi-Hubbard Hamiltonian is solved using an exact numerical diagonalization technique, supplemented by an adaptive basis truncation scheme. The physically motivated basis truncation allows to access larger systems in a fully controlled and very flexible framework. Several experimentally relevant observables, such as the matter-wave interference pattern and the condensatefraction, are investigated in order to explore the rich phase diagram. At symmetric half filling a phase similar to the Mott-insulating phase in a commensurate purely bosonic system is identified and an analogy to recent experiments is pointed out. Furthermore a phase of complete localization of the bosonic species generated by the repulsive boson-fermion interaction is identified. These localized condensates are of a different nature than the genuine Bose-Einstein condensates in optical lattices.Comment: 18 pages, 9 figure
