    The “Right to the Event”: the legality and morality of revolution and resistance

    The rights of modernity, first and foremost the right to resistance against oppression and domination, were created by revolution. The philosophical rejection and the removal of this right from law was an attempt to foreclose radical change by making a particular conception of legal rights the insurance policy for the established order. The attempt was doomed to fail. This essay examines the legal, jurisprudential and moral arguments for the right to resistance. It concludes that a “right to the event” has always accompanied legal rights in a ghostly form ensuring that the law is regularly shaken to its core and not allowed to become sclerotic

However, important philosophical and ontological issues are involved this theme. If you are given rights to beings because of their "humanity", the nature "human", to their needs, characteristics and desires is the normative source of rights.     Transitional Justice, implemented in societies that seek to overcome an armed conflict, provides the essential duty of States to strengthen respect for the victims of serious human rights violations and breaches of international humanitarian law committed within its territory, which leads to the identification of those responsible, impose sanctions and provide the victims of their right to truth, justice and  reparation. Consequently, the aim is to ensure the implementation of mechanisms simultaneously fulfill their duty to repair limited in time in accordance with the guidelines of the American System of Human Rights, to which belongs the Colombian state for constitutional development as enshrined in Article 93 that Constitutionality is the block.La Justicia Transicional, implementada en las sociedades que pretenden superar un conflicto armado, establece el deber esencial de los Estados de fortalecer el respeto a las víctimas de las graves transgresiones de los derechos humanos y las infracciones al DIH, cometidas dentro de su territorio, lo cual conlleva a la identificación de los responsables, la imposición de sanciones y el aseguramiento a las victimas de su derecho a la verdad, a la justicia y a la reparación. En consecuencia la finalidad es lograr simultáneamente la implementación de mecanismos que cumplan con su deber de reparar limitados en el tiempo en concordancia con los lineamientos del Sistema Interamericano de Derechos Humanos, al cual pertenece el Estado colombiano, por desarrollo constitucional consagrado en el Articulo 93 que constituye el Bloque de Constitucionalidad
