    Against Imperialism in Legal Concepts

    The authority of government—and that of its politicians, judges, regulators, and other specific authorities—continues to grow more imperialistic. This is partly due to the imperialism of legal concepts as facilitated by Wittgenstein’s famously non-essentialist treatment of concepts through family resemblance theory. Although non-essentialism or anti-essentialism can be highly valuable in forming religious and literary concepts, and in describing the sometimes incoherent everyday usage of concepts and terms, all legal concepts should be scientific-style essentialist concepts. Such essentialism combats the broad discretion granted and obscured by non-essentialist approaches that allow concepts to absorb contradictory elements and harmfully hold them together, thus allowing legal authorities to choose from among only those elements that suit their purposes in any given case. Instead of arguing for the total exclusion of family resemblance and similar theories from use in legal concepts, I argue for translating non-essentialist concepts into essentialist ones while still using the former’s theory forms. Precise essentialist concepts, with core and non-contradictory properties clearly delineated, are necessary for maximizing the rational and moral legitimacy of law, which coercively regulates the behavior of ordinary citizens at the command of political and legal authorities. Legal rules and commands must be as clear and consistent as reasonably possible not only for optimal rationality and morality, but also for legitimacy in the eyes of those subject to law. This is especially important in an increasingly diverse society of incompatible perspectives and decreasing conscious and unconscious adherence to the Anglo-American legal tradition

    Pharmacy and Empathy: Evaluating the Impact of a Pharmacy Student\u27s Project in a Service-Learning Course

    Background: Empathy is taking on a larger role in the pharmaceutical field as pharmacists place emphasis on patient centered care. Service-learning courses can expose pharmacy students to future patients, allowing them to interact and develop empathy. While this study suggests service-leaming can foster empathy, further research is needed to assess the specific outcome of empathy as a result of incorporating a project in a service-learning course for pre-pharmacy students. Objective: To evaluate the effect on a pharmacy student\u27s empathy after completing a one-on-one patient interview project during a service-learning experience. A secondary objective is to assess tile validity of a rubric designed to evaluate empathy in reflection papers. Methods: The specific assignment of interviewing a patient was assigned to one PX200 section, while two other PX200 sections were assigned a chronic disease project. A validated Likert scale-based survey was given to all three PX200 sections at the beginning and tile end of tile semester. Students\u27 reflective writing papers were analyzed using a newly constructed rubric by blinded investigators. Results: Students in both groups had an increase in scores from pre- to post-survey; however, results were not statistically significantly different between tile two groups. Average rubric scores in tile project group were higher than in tile control group (p = 0.037). Scores from tile rubric also correlated well to results of the post-survey. Conclusion: Although results of the survey component did not show evidence of a statistically significant change between tile two groups, an interview project within a service-learning course may still be beneficial for pre-pharmacy students. In addition, the newly designed rubric can be considered a useful measuring device to evaluate empathy within a group of pre-pharmacy students

    Ticket scalping is a growing epidemic that has become more specialized in the online market. The online secondary ticket market thrives on consumer demand. It has been discovered that this demand in the online market is driven by factors such as trust, risk, time (availability), and popularity of the website. A cross sectional survey, using St. John Fisher students, faculty, and staff, uncovered what online secondary ticketing platform consumers use most, and why. Being able to understand what causes consumers to buy online is coveted by businesses’ and marketers. The results showed that consumers had more trust and less presumed risk in the primary ticketing websites, however, Stubhub was the most used platform among respondents

    The effects of parental divorce on the views of romantic relationships and marriages of the children involved

    The purpose of this study was to determine if the occurrence of parental divorce resulted in negative views and experiences regarding the romantic relationships of the offspring. Four surveys were administered to undergraduate students enrolled in psychology courses at Rowan University. The first survey was used for informational purposes to group participants into two group (those from intact families and those from non-intact families) and to determine the current relationship status of all participants. The following three surveys addressed avoidant behaviors, anxiety level, the presence of conflict, and satisfaction regarding past or present romantic relationships. The data was analyzed for correlations. No significant differences were found between the two groups
