    Much Ado About Nothing: The Limits of Liability for Item 303 Omissions and the Circuit Split That Never Was

    The implied private action for violations of SEC Rule 10b-5 has a contentious history. When plaintiffs base such actions on representations of forward-looking information, however, the stakes are even higher. Recently, the federal circuit courts revisited this divisive issue while deciding whether an omission from required disclosure of Management’s Discussion and Analysis (MD&A) of financial conditions and results of operations. The apparent disparity between the federal circuit courts has caused great consternation and uncertainty in the corporate legal sphere. This Note will examine the origins and controversial history of Rule 10b-5 private actions, discuss the treatment of MD&A omissions throughout the various federal circuits, offer a harmonized reading that resolves the perceived difference between the circuits, and explain how this reading satiates the concerns of both proponents and opponents of increased securities disclosure

    Three-way fungal interactions affect the potential biological control of Himalayan balsam, Impatiens glandulifera

    Himalayan balsam (Impatiens glandulifera) is one of the most invasive weeds across Europe. The rust fungus, Puccinia komarovii var. glanduliferae has been introduced as a biological control agent, but success has been patchy. Here, we investigated whether mycorrhizal and endophytic fungi can affect rust efficacy and plant growth. Over three experiments we found that AM fungi and the rust alone or together consistently reduced plant growth, but this depended on the identity of species in the AM inoculum. Meanwhile, AM fungi increased infection frequency of the endophyte Colletotrichum acutatum. Rust inoculation had no detrimental effects on mycorrhizal colonisation or C. acutatum infection, but the latter two fungi reduced rust sporulation. However, plant size was reduced when all three fungal types were present, suggesting that a combined fungal inoculum offers a promising approach for the control of this weed

    Dysregulation of glucocorticoid metabolism in murine obesity: comparable effects of leptin resistance and deficiency

    In obese humans, metabolism of glucocorticoids by 11β-hydroxysteroid dehydrogenase type 1 (11β-HSD1) and A-ring reduction (by 5α- and 5β-reductases) is dysregulated in a tissue specific manner. These changes have been recapitulated in leptin resistant obese Zucker rats but were not observed in high-fat fed Wistar rats. Recent data from mouse models suggest that such discrepancies may reflect differences in leptin signalling. We therefore compared glucocorticoid metabolism in murine models of leptin deficiency and resistance. Male ob/ob and db/db mice and their respective littermate controls (n=10–12/group) were studied at the age of 12 weeks. Enzyme activities and mRNA expression were quantified in snap-frozen tissues. The patterns of altered pathways of steroid metabolism in obesity were similar in ob/ob and db/db mice. In liver, 5β-reductase activity and mRNA were increased and 11β-HSD1 decreased in obese mice, whereas 5α-reductase 1 (5αR1) mRNA was not altered. In visceral adipose depots, 5β-reductase was not expressed, 11β-HSD1 activity was increased and 5αR1 mRNA was not altered in obesity. By contrast, in subcutaneous adipose tissue 11β-HSD1 and 5αR1 mRNA were decreased. Systematic differences were not found between ob/ob and db/db murine models of obesity, suggesting that variations in leptin signalling through the short splice variant of the Ob receptor do not contribute to dysregulation of glucocorticoid metabolism

    Enhancing the social issues components in our computing curriculum: Computing for the social good

    The acceptance and integration of social issues into computing curricula is still a work in progress twenty years after it was first incorporated into the ACM Computing Curricula. Through an international survey of computing instructors, this paper corroborates prior work showing that most institutions include the societal impact of ICT in their programs. However, topics often concentrate on computer history, codes of ethics and intellectual property, while neglecting broader issues of societal impact. This paper explores how these neglected topics can be better developed through a subtle change of focus to the significant role that ICT plays in addressing the needs of the community. Drawing on the survey and a set of implementation cases, the paper provides guidance by means of examples and resources to empower teaching teams to engage students in the application of ICT to bring about positive social outcomes – computing for the social good

    A Cretaceous‐Eocene depositional age for the Fenghuoshan Group, Hoh Xil Basin: Implications for the tectonic evolution of the northern Tibet Plateau

    The Fenghuoshan Group marks the initiation of terrestrial deposition in the Hoh Xil Basin and preserves the first evidence of uplift above sea level of northern Tibet. The depositional age of the Fenghuoshan Group is debated as are the stratigraphic relationships between the Fenghuoshan Group and other terrestrial sedimentary units in the Hoh Xil Basin. We present new radiometric dates and a compilation of published biostratigraphic data which are used to reinterpret existing magnetostratigraphic data from the Fenghuoshan Group. From these data, we infer an 85–51 Ma depositional age range for the Fenghuoshan Group. U‐Pb detrital zircon age spectra from this unit are compared to age spectra from Tibetan terranes and Mesozoic sedimentary sequences to determine a possible source terrane for Fenghuoshan Group strata. We propose that these strata were sourced from the Qiangtang Terrane and may share a common sediment source with Cretaceous sedimentary rocks in Nima Basin. Field relationships and compiled biostratigraphic data indicate that the Fenghuoshan and Tuotuohe Groups are temporally distinct units. We report late Oligocene ages for undeformed basalt flows that cap tilted Fenghuoshan Group strata. Together, our age constraints and field relationships imply exhumation of the central Qiangtang Terrane from the Late Cretaceous to earliest Eocene, followed by Eocene‐Oligocene deformation, and shortening of the northern Qiangtang and southern Songpan‐Ganzi terranes. Crustal shortening within the Hoh Xil Basin ceased by late Oligocene time as is evident from flat‐lying basaltic rocks, which cap older, deformed strata.
