Community Property Considerations in Ohio Estate Planning: Expecting the Unexpected
For the lawyer in the community property state, the laws peculiar to community property are familiar ground, having in all probability made up at least a part of the law school curriculum. For the lawyer in the common law state, community property laws are generally something to be read about in the newspaper when the husband or wife of a movie star lands a huge divorce settlement due to the operation of the community property laws in California. But it is quite realistic to state that whether the attorneys in the common law states know it or not, they are in fact likely to encounter the operation of community property laws at some time during their practice. Indeed, if they fail (or worse, have failed) to determine whether any community property laws operate on the estate plans of any of their clients, such failure might amount to malpractice, if the client suffers economic detriment. The more positive side of the picture, of course, is that given the fact that a substantial percentage of those persons who move from state to state are executives and sales personnel of large multi-state corporations, special opportunities arise for the attorneys they leave behind, or the attorneys they consult upon their arrival at their new locations, for intelligent estate planning. This note will outline the basic problems of moves to and from community property states, and will point toward the solutions of these problems
Impact of persisting amblyopia on socio–economic, health and well–being outcomes in adult life: findings from the UK Biobank study
Objectives:
This study aimed to investigate associations between persisting amblyopia into adulthood and its “real-life” impacts and inform the current debate about the value of childhood vision screening programs.
Methods:
Associations between persisting amblyopia and diverse socioeconomic, health, and well-being outcomes were investigated in multivariable-adjusted (sex, age, ethnicity, deprivation) regression models, with 126 400 participants (aged 40-70 years) of the UK Biobank with complete ophthalmic data. Analysis by age group (cohort 1, 60-70 years; cohort 2, 50-59 years; cohort 3, 40-49 years) assessed temporal trends.
Results:
Of 3395 (3%) participants with confirmed amblyopia, overall 77% (2627) had persisting amblyopia, declining from 78% in cohort 1 to 73% in cohort 3. The odds of persisting amblyopia were 5.91 (5.24-6.66) and 2.49 (2.21-2.81) times greater in cohort 1 and cohort 2, respectively, than cohort 3. The odds were also higher for more socioeconomically deprived groups and for white ethnicity. Reduced participation in sport, adverse general and mental health, and well-being were all independently associated with persisting amblyopia, with the strongest associations in the youngest cohorts. Associations with lower educational attainment and economic outcomes were only evident in the oldest cohort.
Conclusions:
There has been a decline in the overall frequency of persisting amblyopia since the introduction of universal child vision screening in the United Kingdom. Nevertheless, most adults treated for amblyopia in childhood have persisting vision deficits. There was no evidence that persisting amblyopia has vision-mediated effects on educational, employment-related, or economic outcomes. The observed adverse outcomes were largely those not directly mediated by vision. Patients undergoing treatment should be counseled about long-term outcomes

A cohort study of the effectiveness of influenza vaccine in older people, performed using the United Kingdom general practice research database.
BACKGROUND: The effectiveness of influenza vaccination against hospitalization and death can only ethically be assessed in observational studies. A concern is that individuals who are vaccinated are healthier than individuals who are not vaccinated, potentially biasing estimates of effectiveness upward. METHODS: We conducted a historical cohort study of individuals >64 years of age, for whom there were data available in the General Practice Research Database for 1989 to 1999 in England and Wales. Rates of admissions for acute respiratory diseases and rates of death due to respiratory disease were compared over 692,819 person-years in vaccine recipients and 1,534,280 person-years in vaccine nonrecipients. RESULTS: The pooled effectiveness of vaccine against hospitalizations for acute respiratory disease was 21% (95% confidence interval [CI], 17%-26%). The rate reduction attributable to vaccination was 4.15 hospitalizations/100,000 person-weeks in the influenza season. Among vaccine recipients, no important reduction in the number of admissions to the hospital was seen outside influenza seasons. The pooled effectiveness of vaccine against deaths due to respiratory disease was 12% (95% CI, 8%-16%). A greater proportionate reduction was seen among people without medical disorders, but absolute rate reduction was higher in individuals with medical disorders, compared with individuals without such disorders (6.14 deaths due to respiratory disease/100,000 person-weeks vs. 3.12 deaths due to respiratory disease/100,000 person-weeks). Clear protection against death due to all causes was not seen. CONCLUSIONS: Influenza vaccination reduces the number of hospitalizations and deaths due to respiratory disease, after correction for confounding in individuals >64 years of age who had a high risk or a low risk for influenza. For elderly people, untargeted influenza vaccination is of confirmed benefit against serious outcomes
Hydrogenation of Magnesium Nickel Boride for Reversible Hydrogen Storage
We report that a ternary magnesium nickel boride (MgNi_(2.5)B_2) mixed with LiH and MgH_2 can be hydrogenated reversibly forming LiBH_4 and Mg_2NiH_4 at temperatures below 300 °C. The ternary boride was prepared by sintering a mechanically milled mixture of MgB_2 and Ni precursors at 975 °C under inert atmosphere. Hydrogenation of the ternary, milled with LiH and MgH_2, was performed under 100 to 160 bar H_2 at temperatures up to 350 °C. Analysis using X-ray diffraction, Fourier transform infrared, and ^(11)B magic angle spinning NMR confirmed that the ternary boride was hydrogenated forming borohydride anions. The reaction was reversible with hydrogenation kinetics that improved over three cycles. This work suggests that there may be other ternary or higher order boride phases useful for reversible hydrogen storage
Macroscopic behavior of bidisperse suspensions of noncolloidal particles in yield stress fluids
We study both experimentally and theoretically the rheological behavior of
isotropic bidisperse suspensions of noncolloidal particles in yield stress
fluids. We focus on materials in which noncolloidal particles interact with the
suspending fluid only through hydrodynamical interactions. We observe that both
the elastic modulus and yield stress of bidisperse suspensions are lower than
those of monodisperse suspensions of same solid volume fraction. Moreover, we
show that the dimensionless yield stress of such suspensions is linked to their
dimensionless elastic modulus and to their solid volume fraction through the
simple equation of Chateau et al.[J. rheol. 52, 489-506 (2008)]. We also show
that the effect of the particle size heterogeneity can be described by means of
a packing model developed to estimate random loose packing of assemblies of dry
particles. All these observations finally allow us to propose simple closed
form estimates for both the elastic modulus and the yield stress of bidisperse
suspensions: while the elastic modulus is a function of the reduced volume
fraction only, where is the estimated random loose
packing, the yield stress is a function of both the volume fraction and
the reduced volume fraction

Fragility and hysteretic creep in frictional granular jamming
The granular jamming transition is experimentally investigated in a
two-dimensional system of frictional, bi-dispersed disks subject to
quasi-static, uniaxial compression at zero granular temperature. Currently
accepted results show the jamming transition occurs at a critical packing
fraction . In contrast, we observe the first compression cycle exhibits
{\it fragility} - metastable configuration with simultaneous jammed and
un-jammed clusters - over a small interval in packing fraction (). The fragile state separates the two conditions that define
with an exponential rise in pressure starting at and an exponential
fall in disk displacements ending at . The results are explained
through a percolation mechanism of stressed contacts where cluster growth
exhibits strong spatial correlation with disk displacements. Measurements with
several disk materials of varying elastic moduli and friction coefficients
, show friction directly controls the start of the fragile state, but
indirectly controls the exponential slope. Additionally, we experimentally
confirm recent predictions relating the dependence of on . Under
repetitive loading (compression), the system exhibits hysteresis in pressure,
and the onset increases slowly with repetition number. This friction
induced hysteretic creep is interpreted as the granular pack's evolution from a
metastable to an eventual structurally stable configuration. It is shown to
depend upon the quasi-static step size which provides the only
perturbative mechanism in the experimental protocol, and the friction
coefficient which acts to stabilize the pack.Comment: 12 pages, 10 figure
Mathematics of random growing interfaces
We establish a thermodynamic limit and Gaussian fluctuations for the height
and surface width of the random interface formed by the deposition of particles
on surfaces. The results hold for the standard ballistic deposition model as
well as the surface relaxation model in the off-lattice setting. The results
are proved with the aid of general limit theorems for stabilizing functionals
