    What Is Transnational Law?

    Is it important to conceptualize transnational law and “map” it as a new legal field? This article suggests that to do so might help both juristic practice and sociolegal scholarship in organizing, linking, and comparing disparate but increasingly significant types of regulation. To explore the idea of transnational law is to raise basic questions about the nature of both “law” and “society” (taken as the realm law regulates). This involves radically rethinking relationships between the public and the private, between law and state, and between different sources of law and legal authority. Taking as its focus Von Daniels's The Concept of Law from a Transnational Perspective and Calliess and Zumbansen's Rough Consensus and Running Code (both 2010), the article considers what approaches may be most productive, and what key issues need to be addressed, to make sense of broad trends in law's extension beyond the boundaries of nation-states.</jats:p

    Legal origin and social solidarity: the continued relevance of Durkheim to comparative institutional analysis

    By using the classic works of Durkheim as a theoretical platform, this research explores the relationship between legal systems and social solidarity. We found that certain types of civil law system, most notably those of Scandinavia, are associated with higher levels of social capital and better welfare state provision. However, we found the relationship between legal system and societal outcomes is considerably more complex than suggested by currently fashionable economistic legal origin approaches, and more in line with the later writings of Durkheim, and, indeed, the literature on comparative capitalisms. Relative communitarianism was strongly affected by relative development, reflecting the complex relationship between institutions, state capabilities and informal social ties and networks

    Elementary forms and their dynamics: revisiting Mary Douglas

    Mary Douglas's oeuvre furnishes the social sciences with one of the most profound and ambitious bodies of social theory ever to emerge from within anthropology. This article uses the occasion of the publication of Fardon's two volumes of her previously uncollected papers to restate her core arguments about the limited plurality of elementary forms of social organisation, about the institutional dynamics of conflict, and about conflict attenuation. In reviewing these two volumes, the article considers what those anthropologists who have been sceptical either of Douglas's importance or of the Durkheimian traditions generally, will want from these books to convince them to look afresh at her work. It concludes that the two collections will provide open-minded anthropologists with enough evidence of the creativity and significance of her achievement to encourage them to reopen her major theoretical works. An internal critique of some aspects of Douglas's handling of her arguments is offered, before the conclusion identifies the wider significance of her arguments for the social science

    Enhancing Participatory Strategies With Designerly Ways for Sociolegal Impact: Lessons From Research Aimed at Making Hate Crime Visible

    This paper draws the attention of impact-curious sociolegal researchers to the potential of participatory research strategies; and proposes that the effectiveness of those strategies can be enhanced by the introduction of ‘designerly ways’. It explores and evidences this proposition through the multi-country Facing All the Facts project which aimed to support and accelerate the process of making hate crime conceptually and empirically visible in Europe. The paper concludes that by pursuing the designerly strategy of making experiences, perceptions and expectations around hate crime reporting and recording visible and tangible in artefacts (formal graphics and collaborative prototypes), the project activities generated structured-yet-free spaces in which publics/stakeholders could more effectively participate in practical, critical and imaginative discussion about how things are, and how they might be; and that this has improved the relevance and rigour of the research, and its ability to generate meaningful change (‘impact’)

    Revolution postponed? Tracing the development and limitations of open content filmmaking

    Networked information technologies have brought about extensive changes in the production and distribution of creative cultural work. Inspired by the widespread success of Free-Libre/Open Source Software (FLOSS), many proponents of open access advocate reconceptualisation of existing legal protection frameworks in creative works. This paper traces the attempted appropriation of Creative Commons (CC) licences by filmmakers and the consequent formation of an Open Content Filmmaking (OCF) movement. OCF proponents articulated notions of technology-enabled transformation in content creation and distribution, similar to those that inspire the visions of FLOSS and CC advocates. It examines how these creators attempted to address the relevance of openness to their own activities and develop practical open models for filmmaking. Difficulties experienced in establishing viable livelihoods with OCF (as FLOSS developers had done), created tensions between those with a pragmatic or more ideological orientation. The initial vision of a consistent OCF movement, enabled by CC, thus became fragmented. In contrast to FLOSS, where many actors were able to find ways to develop sustainable careers within the industry while contributing to Open Source Software, such generic strategies have not readily emerged for OCF. Drawing insights from Sørensen’s (1996) Social Learning framework (Learning technology, constructing culture. Sociotechnical change as social learning: University of Trondheim, STS working paper 18/96) in this paper we untangle the elaborate but often messy strategies deployed by Open Content Filmmakers (OCFs) and trace the multiple and often partial ways they have worked out to utilise CC elements and tools in producing, monetising and distributing their films
