When overseeing becomes overlooking : the post-GFC reconfigurations of international finance
This article draws on empirical evidence suggesting a shift of credit provision from banks to the alternative investment fund sector to argue that current deficiencies in fund regulation have not prevented such a shift, if not actually encouraged it. The evidence is drawn from the new Pan-European Private Placement Market, and first- and second-order analyses are undertaken to show a shift of credit risk (intermediation) into the hands of US funds in particular, and a concentration of risk amongst herds of smaller funds which have the potential to act as one. The data highlight defects in the scope of the macroprudential oversight mechanisms deriving from the Alternative Investment Fund Management Directive (AIFMD). These findings form the basis for proposals to remedy AIFMD as part of the move to a Capital Markets Union

The Tuna Bond Scandal : the continued lack of transparency in bank-to-state credit facilities agreements
The United Nations Conference on Trade and Development Principles on Promoting Responsible Sovereign Lending and Borrowing provide inter alia that creditors should ensure debt contracts are duly authorized; yet, the Mozambique Tuna Bond Scandal suggests that in the market for private bank-to-state credit facilities agreements, there is still work to do. This article presents empirical evidence suggesting growth in the amount of private bank-to-state loans and argues that this growth, combined with a lack of transparency, will lead to increasing numbers of legal disputes over want and abuse of official authority. The English law doctrines of ultra vires contracting in private international law and abuse of agent authority, usually applied in the context of corruption, are considered, and various reforms are proposed, including a transparency register and a legislative reversal of presumption of agent authority
Locke, Leibniz and the state space
The article explores the relationship between Locke and Leibniz's account of space and how this impacts on their understanding of possibility, and particularly practical choices between possibilities within a modal space. Using Borges' short story 'Pierre Menard, author of the Quixote' it argues that Locke's acquiescence to absolute space severely restricts his account of the power to do things. Leibniz's retention of relative space permits a much richer account of possible, yet he binds these worlds together under a universal set of principles which are morally true in every possible world. He calls these morally impossible (prohibited), echoing the Scholastic language of repugnance. 'Menard' is employed to critique this resort to universality, before an alternative possible truth structure is sketched as a response to the 'self-evident' truths defended by Leibniz

The Critical Legal Pocketbook provides the tools for law students to uncover the hidden intricacies of law. Law creates an ethical and rational facade for itself, but beneath the surface you will find that it has its monsters; the leviathan of the state, the golems of racism and misogyny, the hydra of coloniality, the vampire of capitalism. These roam throughout lawâs subterranean structures. At the same time, law is often painted as a heroic defence of the innocent against these terrors. Legal education likes to forget the ways that law was essential in generating structures of domination and subjection. The Critical Legal Pocketbook casts a different light on the law, illuminating some of the ways in which law (and legal education in particular) nourishes its monsters â and sometimes works to make these monsters look tame and docile. Drawing on recent developments in critical legal theory, it considers other dimensions of law: its ambiguity, susceptibility to capture, and its potential as a site of rupture
Staff-Family Communication Methods in Long-Term Care Homes: An Integrative Review
Context: Communication methods have been trialled to promote staff-family relations and facilitate person-centred care for residents living in long-term care homes. A review and synthesis of the common methods will inform the development of stafffamily communication methods, policy and best practice guidelines.
Objectives: 1) synthesise and summarise common communication methods, and types(s) of delivery, used for staff-family communication in long-term care homes; and 2) identify any challenges that impacted the implementation of the communication method(s).
Methods: An integrative review was employed to incorporate papers with diverse research designs. It involved a comprehensive database and grey literature search, and study selection based on inclusion criteria. Data from included studies were extracted, coded and categorised by common communication method, delivery type(s) and challenges; studies were assessed for quality.
Findings: A total of 3,183 potential papers were retrieved from seven international databases. Twenty-four original papers from six countries meeting inclusion criteria were reviewed and assessed for quality (M = 30; SD = 3.8). Common communication methods (structured education, meetings and takeaway resources) and challenges to implementation (confusion, misunderstanding and disagreement; lack of time; and technological difficulties) were identified and summarised. Limitations: The exclusion of papers published more than 20 years ago, geographical concentration of studies in high-income countries, and absence of stakeholder consultation may limit the generalisability and depth of the findings. Implications: Staff professional development and education, technology training and support, and accessibility of information in pamphlets and resources for family are crucial for facilitating staff-family communication in long-term care homes
Assessing wellbeing at school entry using the strengths and difficulties questionnaire: professional perspectives
<p>Background: Emotional and behavioural disorders in early childhood are related to poorer academic attainment and school engagement, and difficulties already evident at the point of starting school can affect a childâs later social and academic development. Successful transfer from pre-school settings to primary education is helped by communication between pre-school staff and primary school teachers. Typically, in Scotland, pre-school establishments prepare individual profiles of children before they start school around the age of five years, highlighting their strengths and development needs, for transfer to primary schools. There is, however, no consistent approach to the identification of potential social, emotional and behavioural problems. In 2010, in one local authority area in Scotland, the Strengths and Difficulties Questionnaire (SDQ) was introduced for children about to start school as a routine, structured, component of the transition process to help teachers plan support arrangements for classes and individual children. The SDQ assesses emotional, conduct, hyperactivity/ inattention and peer-relationship problems as well as pro-social behaviour. In order to be an effective means of communicating social and emotional functioning, the use of instruments such as the SDQ needs to be practicable. Finding out the views of pre-school education staff with experience of assessing children using the SDQ was, therefore, essential to establish its future utility.</p>
<p>Aim: The purpose of this study was to explore the views of pre-school education staff about assessing social and emotional wellbeing of children at school entry using the SDQ. The objectives were to examine the opinions of pre-school workers about completing the SDQ and to elicit their thoughts on the value of doing this and their perceptions of the usefulness of the information collected.</p>
<p>Method: Pre-school establishments were approached using a purposive sampling strategy in order to achieve a mix of local authority (n=14) and âpartnershipâ establishments (n=8) as well as different socio-economic areas. Semi-structured interviews (n=25) were conducted with pre-school head teachers (n=14) and child development officers (n=11) in order to explore the process of completing the SDQ along with perceptions of its value. The interviews were transcribed verbatim and analysed thematically.</p>
<p>Results: In general, staff in pre-school establishments viewed the use of the SDQ positively. It was seen as a chance to highlight the social and emotional development of children rather than just their academic or educational ability. Most felt that the SDQ had not identified anything they did not already know about a child. A minority, nevertheless, suggested that a previously unrecognised potential difficulty was brought to light, most commonly emotional problems. Completing the SDQ was felt to be relatively straightforward even though the staff felt under pressure from competing priorities. Concerns were, however, raised about the potential of labelling a child at an early stage of formal education.</p>
<p>Conclusion: The findings from this small scale study suggest that, from the point of view of pre-school education staff, it is feasible to assess children systematically for social and behavioural problems as part of the routine transition process at school entry.</p>
Cone-Beam Computed Tomographic Assessment of the Mandibular Condylar Volume in Different Skeletal Patterns: A Retrospective Study in Adult Patients
The aim of this study was to assess the condylar volume in adult patients with different
skeletal classes and vertical patterns using coneâbeam computed tomography (CBCT). CBCT scans
of 146 condyles from 73 patients (mean age 30 â 12 years old; 49 female, 24 male) were selected from
the archive of the Department of Dentistry and Maxillofacial Surgery of Fondazione IRCCS Caâ
Granda, Milan, Italy, and retrospectively analyzed. The following inclusion criteria were used: adult
patients; CBCT performed with the same protocol (0.4 mm slice thickness, 16 â 22 cm field of view,
20 s scan time); no systemic diseases; and no previous orthodontic treatments. Threeâdimensional
cephalometric tracings were performed for each patient, the mandibular condyles were segmented
and the relevant volumes calculated using Mimics Materialize 20.0â software (Materialise, Leuven,
Belgium). Right and left variables were analyzed together using randomâintercept linear regression
models. No significant association between condylar volumes and skeletal class was found. On the
other hand, in relation to vertical patterns, the mean values of the mandibular condyle volumes in
hyperdivergent subjects (688 mm3) with a postârotation growth pattern (625 mm3) were smaller than in
hypodivergent patients (812 mm3) with a horizontal growth pattern (900 mm3). Patients with an increased
divergence angle had smaller condylar volumes than subjects with normal or decreased mandibular
plane divergence. This relationship may help the clinician when planning orthodontic treatment
Talc-dominated seafloor deposits reveal a new class of hydrothermal system
The Von Damm Vent Field (VDVF) is located on the flanks of the Mid-Cayman Spreading Centre, 13?km west of the axial rift, within a gabbro and peridotite basement. Unlike any other active vent field, hydrothermal precipitates at the VDVF comprise 85â90% by volume of the magnesium silicate mineral, talc. Hydrothermal fluids vent from a 3-m high, 1-m diameter chimney and other orifices at up to 215?°C with low metal concentrations, intermediate pH (5.8) and high concentrations (667?mmol?kg?1) of chloride relative to seawater. Here we show that the VDVF vent fluid is generated by interaction of seawater with a mafic and ultramafic basement which precipitates talc on mixing with seawater. The heat flux at the VDVF is measured at 487±101?MW, comparable to the most powerful magma-driven hydrothermal systems known, and may represent a significant mode of off-axis oceanic crustal cooling not previously recognized or accounted for in global models
