    Striking a Balance: Exploring Harmony in Indonesian Criminal Law and Islamic Jurisprudence

    The long-established the Indonesian Criminal Code follows a liberal individual's tradition of Dutch criminal law that has always changed. The old criminal code is based on classical and neo-classical thinking, emphasising systematic criminal law structures and legal certainty. The basis of balance in the new criminal code is a response to a base that does not reflect the nation's values. For example, Pancasila is included as a foundation, including the value of the most exquisite element of divinity in its formulation. With the value of divinity, it is necessary to review from the perspective of religious teachings, including Islam. Islamic criminal law reflects the spirit of balance in the criminal provisions of hudud, qisas, and takzir. This article uses a comparative approach and a type of normative research. The results of the article show that the relevance of the primary balance in the new criminal code and Islamic Criminal Law is seen in several aspects, such as the relevancy of the pillar values of the balance in Pancasila, the relevancy of the fundamental balance of the mono-dualistic; the significance of the idea of a balance between the protection of victims and the individualization of criminals; and the fundamental relevance to the balance between formal and material criteria.Hukum pidana Indonesia yang sudah lama digunakan mengikuti tradisi individu bebas dari hukum pidana Belanda yang selalu berubah. Hukum Pidana lama didasarkan pada pemikiran klasik dan neo-klasik, menekankan struktur hukum pidana yang sistematis dan kepastian hukum. Dasar keseimbangan dalam Hukum Pidana baru adalah respons terhadap basis yang tidak mencerminkan nilai-nilai bangsa. Misalnya, Pancasila dimasukkan sebagai fondasi, termasuk nilai unsur ilahi yang paling indah dalam formulasinya. Dengan nilai ilahi, perlu untuk meninjau dari perspektif ajaran-ajaran agama, termasuk Islam. Hukum pidana Islam mencerminkan semangat keseimbangan dalam ketentuan pidana hudud, qisas, dan takzir. Artikel ini menggunakan pendekatan komparatif dan jenis penelitian normatif.     Beyond Optimism and Skepticism about North Korean Denuclearization: A Case for Conditional Engagement

    South Korean President Moon took a bold initiative to establish peace on the Korean peninsula while denuclearizing North Korea. Though negotiations with North Korea are on the move, controversy about how to deal with North Korea never ends. Optimists argue that Kim Jong Un has made up his mind to give up nuclear weapons and concentrate on economic development They argue that, though slow and conditionally, North Korea is reciprocating to the US and South Korean demands. Thus, optimists take a position of trust and engage. On the other hand, skeptics argue that North Korean goals have never changed and that Kim Jong Un will never give up nuclear weapons. What they are trying to do is delay, deceive, and buy time for nuclear enforcement. Skeptics take a position of coerce and verify. This paper takes a position that we had better test Kim seriously and push to the limit until his ultimate decision can be discerned. Engagement is a viable option than other alternatives like dovish engagement, strategic patience, coercive sanctions, or war. However, there is a proper way to engage North Korea, what the author calls conditional engagement. Engage and verify should be a principle of conditional engagement. Tough and strict conditionalities should be attached to engagement.     A Reminiscence on the Formation of the East Asian Consortium of Japanese Studies

    This article is a revised and translated version of the authors Korean article Tongasia Ilbon Yŏnguja Hyŏbŭihoe kuchuk kwa unyŏng e kwanhan tansang, published in Ilbon pipŏng [Korean journal of Japanese studies] 22 (2020), with the permission of Sŏul Taehakkyo Ilbon Yŏnguso [Institute for Japanese Studies, Seoul National University].This essay describes the ideas and concerns that led to the formation of the East Asian Consortium of Japanese Studies (hereafter EACJS), and records its development since 2016. I first conceived of the consortium after the 2013 East Asia Forum for Japanese Studies. In 2014, I made an official proposal at the Awajishima East Asia Forum, and introduced plans for the realization of the EACJS at a seminar hosted by the Atsumi International Scholarship Foundation in 2015. The Tianjin Meeting in 2016 was the final check point prior to launching the EACJS, and the first conference of the EACJS was inaugurated in Songdo, South Korea on November 30, 2016. Since then, an EACJS conference has been held successfully for four consecutive years. The core values of the EACJS are transnationalism, the promotion of interdisciplinary integration across the humanities and social sciences, and a concern to nurture the next generation of specialists on Japan. These visions are embodied in three critical policies: a rotating host formula to prevent monopoly by a single state or institution; an outof-pocket system to support the operation of panel sessions and lessen the financial burden for host institutions; and an open door policy to encourage the widespread participation of a diverse range of scholars.
