TAHAP AMALAN MASYARAKAT TERHADAP TANAH ADAT DAN UNDANG-UNDANG TANAH ADAT: KAJIAN DI NEGERI SEMBILAN

Tanah adat dan undang-undang tanah adat merupakan salah satu ciri utama dalam pewarisan harta mengikut adat perpatih yang memberikan amanah kepada kaum perempuan untuk mewarisi tanah adat. Namun, timbul persoalan tentang tahap pengamalan masyarakat terhadap undang-undang ini pada hari ini dan isu-isu yang timbul sepanjang perlaksanaan undang-undang tersebut. Justeru, objektif kajian ini adalah untuk mengenal pasti tahap amalan masyarakat di Negeri Sembilan terhadap tanah adat dan undang-undang tanah adat serta isu-isu yang berkaitan dengannya. Kajian kuantitatif ini menggunakan kaedah survei yang melibatkan 525 orang sampel berdasarkan teknik prosedur pensampelan rawak mudah. Hasil kajian mendapati bahawa tahap amalan masyarakat di Negeri Sembilan terhadap tanah adat dan undang-undang tanah adat masih lagi tinggi. Namun, terdapat beberapa isu yang timbul di sepanjang perlaksanaan undang-undang ini. Masalah yang timbul berpunca sama ada di pihak pejabat tanah mahupun pengamal tanah adat itu sendiri. Implikasi kajian ini ialah dapat meningkatkan kesedaran masyarakat terhadap tahap amalan dan isu-isu yang timbul berkaitan tanah adat dan undang-undang tanah adat. Kajian lanjutan boleh dilakukan untuk mengenal pasti kaedah yang terbaik untuk menangani masalah-masalah yang timbul agar amalan tanah adat dan undang-undang tanah adat boleh dilaksanakan dalam suasana yang lebih harmoni

Exploring financial exploitation of older persons in family setting

The main purpose of this study is to explore the experience on financial exploitation of older person by family members. This include to discover the meaning of financial exploitation among older persons as victim of financial exploitation and to explore the lived experience of financial exploitation incidents among older persons. Phenomenological approach is chosen to answer this the research question and using maximum and snowballing sampling, this study will employ in depth interview as method for collecting data This study will give weightage to the views of older persons through in-depth interview as the main instrument for data collection. The participants sampling in the study comprise of those older persons in community dwelling and institutionalised setting in Selangor. The findings of this study will be helpful for researchers to understand financial exploitation of older person’s phenomenon from the perspectives of older Malaysians. This study may contribute to the body of knowledge in discovering the experience and identifying the potential barriers that the older persons themselves face in detecting and disclosing financial exploitation in family setting in Malaysian context

Conceptualisation of financial exploitation of older people: a review

The concept of financial exploitation has gained much interest in the field of elder abuse. The purpose of this study is to review the conceptualisation of elder financial exploitation as a first step towards exploring how financial abuse is interpreted differently by different groups. The search strategy includes the use of the SCOPUS database, including PubMed, MEDLINE, and open access for articles published between 1997 and January 2019. This study includes prevalence studies regarding the analysis of perceptions and conceptualisation of financial exploitation. This study excluded studies published in languages other than English with no relevance regarding the focus of the study. Twentysix studies met the inclusion criteria with four categories (older people, professional, public, and family members) and a range of settings across studies. Three overarching themes emerged in this review. The sub-themes include values, expectations, cultural considerations, characteristics of older people, relationship dynamics, situational factors, knowledge, and attitudes. Current evidence supports the on-going discussion on the lack of uniformity in definitions and conceptualisations of the financial exploitation of older people. The lack of consideration from the views of older people and community members may add to the complexity of defining financial exploitation, which can result in problems in detection, disclosure, and underreporting incidences

Document forensic, the fiqh and the Syariah Courts

Technological progress has made falsification of documents increasingly sophisticated and the need for forensic experts or Ra'yu al-Khabir indispensable in the Syariah Courts. This paper discusses the concept and methods of forensic document authentication by experts according to the Islamic law (fiqh). This study combined quantitative and qualitative approaches whereby 181 key informants comprising randomly sampled syariah and civil law experts and practitioners underwent in-depth interviews . Content analysis of the study revealed that respondent knowledge of document authentication methods according to the Islamic law was at the intermediate level with the mean = 3.59 and sd = 0.63 which was not enough to help the Syariah Courts cope with the rapid increase in the falsification rate of documents. This situation needs urgent redress and calls for the establishment of a comprehensive forensic model to provide adequate guidelines for judges and practitioners of the Syariah Courts
