The Research Journey as a Challenge Towards New Trends
The academic community of the department of Risaralda, in its permanent interest in evidencing the results of the research processes that are carried out from the Higher Education Institutions and as a product of the VI meeting of researchers of the department of Risaralda held in November 2021 presents its work: “The journey of research as a challenge towards new trends”, which reflects the result of the latest research and advances in different lines of knowledge in Agricultural Sciences, Health Sciences, Social Sciences and Technology and Information Sciences, which seek to solve and meet the demands of the different sectors.
This work would not have been possible without the help of each of the teachers, researchers and authors who presented their articles that make up each of the chapters of the book, to them our gratitude for their commitment, dedication and commitment, since their sole purpose is to contribute from the academy and science to scientific and technological development in the search for the solution of problems and thus contribute to transform the reality of our society and communities. Peasant Reserve Zone at the upstream of the Orteguaza and San Pedro rivers. A setting of environmental, economic, and agrarian rights conflict
ilustraciones, tablasEn el departamento del Caquetá se pretende constituir una Zona de Reserva Campesina (ZRC) que involucra los municipios de Florencia, La Montañita, El Paujil y El Doncello, con una extensión de 161.000 hectáreas. La ZRC se traslapa con regulaciones ambientales, solicitudes de exploración y explotación de hidrocarburos, así como con la construcción de una hidroeléctrica. La creación de la ZRC busca equilibrar la balanza frente a los diferentes intereses que existen dentro del territorio, que han generado este conflicto por la tierra. Así, la colisión entre los derechos constitucionales al ambiente sano, el desarrollo económico y el acceso progresivo a la propiedad rural, se pretende superar realizando un ejercicio de ponderación de principios, con el fin de no limitar ninguno, sino de darle su justa proporción, teniendo en cuenta que se debe propender por el goce efectivo de derechos a las comunidades rurales, quienes han vivido condiciones inequitativas y de desigualdad exacerbadas por el conflicto armado. A pesar de que la política agraria para las comunidades campesinas ha tenido desarrollos normativos y constitucionales, estos no han sido suficientes para garantizar el goce efectivo de derechos, incluso el acuerdo de paz propone soluciones para que dichas comunidades puedan acceder efectivamente a sus derechos.The communities aim to create a Peasant Reserve Zone (ZRC in Spanish) in the Colombian Caquetá region involving a size area of around 161,000 hectares, which comprises the municipalities of Florencia, La Montañita, El Paujil, and El Doncello. The Peasant Reserve Zone is overlapped by several constraints including environmental regulations, hydrocarbon search and exploitation permissions, along with a hydroelectric project. The Peasant Reserve Zone aims to restore the territory’s harmony, which has been broken by different interests on the land. There is a need for overcoming the collision between environmental human rights, economic development, and rural land access. Therefore, this research objective is to carry out a weighting process of the collision forces to avoid biases, conversely, promote objective justice, including the rural communities' wellbeing and human rights since these communities have faced unequal conditions and the consequences of armed conflict. Although the agrarian policy has included constitutional regulations underpinning peasant communities, the normative enforcement has been limited, as well as the communities' rights fulfilment.
