Organ wydający jako organ właściwy do dokonania sprostowania, uchylenia, zmiany lub zawieszenia skutków europejskiego poświadczenia spadkowego
Regulation (EU) No 650/2012 of the European Parliament and of the Council of
4 July 2012 on jurisdiction, applicable law, recognition and enforcement of decisions
and acceptance and enforcement of authentic instruments in matters o f succession and
on the creation of a European Certificate of Succession created a European Certificate
of Succession. According to the provisions of the above-mentioned regulation the issuing
authority shall rectify, modify, withdraw or suspend effects o f the of the European
Certificate of Succession. The determination of the authority that shall have the competence to rectify, modify, withdraw or suspend the effects o f the of the European
Certificate of Succession raises some serious questions particularly under Polish law.Rozporządzeniem Parlamentu Europejskiego i Rady (UE) nr 650/2012 z dnia 4 lipca
2012 roku w sprawie jurysdykcji, prawa właściwego, uznawania i wykonywania orzeczeń,
przyjmowania i wykonywania dokumentów urzędowych dotyczących dziedziczenia
oraz w sprawie ustanowienia europejskiego poświadczenia spadkowego ustanowiono
europejskie poświadczenie spadkowe. Zgodnie z przepisami wskazanego rozporządzenia
organ wydający europejskie poświadczenie spadkowe dokonuje sprostowania, zmiany,
uchylenia lub zawieszenia skutków europejskiego poświadczenia spadkowego. Ustalenie
organu, któremu przysługuje kompetencja do dokonania sprostowania, zmiany,
uchylenia lub zawieszenia skutków europejskiego poświadczenia spadkowego, budzi
istotne wątpliwości w szczególności na gruncie prawa polskiego

The Act of 14 April 2016 on Withholding the Sale of Properties in the State Treasury
Resources of Agricultural Properties and on Amending Certain Statutes has introduced
changes into the Polish legal system which significantly restrict trade in agricultural
properties. These changes concern, in ter alia, positive prescription of broadly understood
agricultural properties. In accordance with the amended law, agricultural properties
referred to in the provisions of the Act of 11 April 2003 on the Development of
the Agricultural System may be acquired through positive prescription only by individual
farmers in the meaning of this Act; furthermore, certain obligations have been
imposed on the parties acquiring agricultural properties through positive prescription
relating to their use of the properties they acquire, with far-reaching sanctions imposed thereupon. The law which has been introduced raises serious concerns, in ter alia, at the
level of its interpretation, including, in particular, in the context of the aims intended
to be attained by the legislator by significantly and comprehensively restricting trade in

Własności Rolnej Skarbu Państwa oraz o zmianie niektórych ustaw w polskim porządku
normatywnym wprowadzone zostały zmiany istotnie ograniczające szeroko pojęty
obrót nieruchomościami rolnymi. Zmiany te dotyczą między innymi nabywania nieruchomości
rolnych w drodze zasiedzenia. Zgodnie ze znowelizowanymi przepisami
nieruchomości rolne, o których mowa w przepisach Ustawy z dnia 11 kwietnia 2003 r.
o kształtowaniu ustroju rolnego, mogą być nabywane w drodze zasiedzenia jedynie
przez rolników indywidualnych w rozumieniu tej ustawy; nadto, na nabywców nieruchomości
rolnych w drodze zasiedzenia zostały nałożone pewne obowiązki związane
z korzystaniem z nabytych nieruchomości, obwarowane daleko idącymi sankcjami.

konstrukcyjnym, w tym w szczególności w kontekście celów, które zamierzał osiągnąć

One of the legal effects of the partition of succession is a change in
the heirs’ liability for the debts of succession from the joint and several
liability into the liability related to the shares in the undivided
property. Heirs’ liability for the debts of successions after the partition
of succession has no relation with the value of the proprietary rights
granted to heirs as a result of the partition of succession. What is more,
Polish civil law does not stipulate any relation between the value of the
proprietary rights granted to heirs as a result of the partition of succession
and the value of the heirs’ share in the undivided property. As this
may lead to the breach of interests of the creditors of the succession
grantor and some other parties, an amendment to the Polish civil code
is required. This amendment should consist in the introduction to the
Polish legal system heirs’ liability for the debts of succession related
to the value of the proprietary rights granted to heirs as a result of the
partition of succession

Does the mere deposit of funds originating from the personal property of a spouse in the bank account maintained for both spouses who share the matrimonial joint property regime results in increase of the joint property? Comments on the decision of the supreme courtof 20 February 2020, III CSK 235/19
In the discussed decision, the Supreme Court took a firm position (which at the same time is not supported by the justification accompanying the decision) that the mere deposit of funds belonging to the personal property of one of the spouses remaining in the matrimo-nial joint property regime in the bank account maintained for both spouses increases the joint property. The presented position, relevant to the issue of great practical importance, does not merit approval. Contrary, it should be assumed that a claim for payment of cash from the bank account arising from the inflow of cash to the bank account remains an element of the spouse’s personal property. It can be argued that this is determined by the very fact that the emergence of the such claim does not constitute the acquisition of an asset within the meaning of Article 31 § 1 sentence 1 of the Family and Guardianship Code. If the above view is rejected, the adopted position is supported primarily by the fact that the claim in question is part of the spouse’s personal property due to the application of the principle of subrogation in this property, as well as due the fact that the mere maintenance of a joint bank account for spouses remaining in matrimonial joint property regime does not mean subjecting an indicated claim to the rules of this regime
