The Federal Rules of Civil Procedure (FRCP) are subject to a unique process also once used in revising the Federal Rules of Evidence (FRE). Today, this process is followed in revisions of the FRCP, the Federal Rules of Criminal Procedure and the Federal Bankruptcy Rules. This unique rulemaking process differs significantly from traditional notice and comment rulemaking required for a majority of federal regulatory agencies under the Administrative Procedure Act (APA).1 Most notably, rule-making for the federal courts’ procedural matters remain unaffected by the invalidation of legislative veto. It is still widely, but wrongly believed, that the legislative veto was completely invalidated by INS v. Chadda
Structural analysis of Salmonella enterica effector protein SopD
Salmonella outer protein D (SopD) is a type III secreted virulence effector protein from Salmonella enterica. Full-length SopD and SopD lacking 16 amino acids at the N-terminus (SopDDeltaN) have been expressed as fusions with GST in Escherichia coli, purified with a typical yield of 20-30 mg per litre of cell culture and crystallized. Biophysical characterization has been carried out mainly on SopDDeltaN. Analytical size exclusion chromatography shows that SopDDeltaN is monomeric and probably globular in aqueous solution. The secondary structure composition, calculated from the CD spectrum, is mixed (38% alpha-helix and 26% beta-strand). Sequence analysis indicates that SopD contains a coiled coil motif, as found in numerous other type III secretion system-associated proteins. This suggests that SopD has the potential for one or more heterotypic protein-protein interactions. Limited trypsin digestion of SopDDeltaN, monitored by both one-dimensional proton NMR spectroscopy and SDS-PAGE, shows that the protein has a large, protease-resistant core domain of 286 amino acid residues. This single-domain architecture suggests that SopD lacks a cognate chaperone. In crystallization trials, SopDDeltaN produced better crystals than either full-length SopD or trypsin-digested SopDDeltaN. Diffraction to 3.0 Angstrom resolution has so far been obtained from crystals of SopDDeltaN
Planetary protection issues and future Mars missions
A primary scientific theme for the Space Exploration Initiative (SEI) is the search for life, extant or extinct, on Mars. Because of this, concerns have arisen about Planetary Protection (PP), the prevention of biological cross-contamination between Earth and other planets during solar system exploration missions. A recent workshop assessed the necessity for, and impact of, PP requirements on the unmanned and human missions to Mars comprising the SEI. The following ground-rules were adopted: (1) Information needed for assessing PP issues must be obtained during the unmanned precursor mission phase prior to human landings. (2) Returned Mars samples will be considered biologically hazardous until proven otherwise. (3) Deposition of microbes on Mars and exposure of the crew to martian materials are inevitable when humans land. And (4) Human landings are unlikely until it is demonstrated that there is no harmful effect of martian materials on terrestrial life forms. These ground-rules dictated the development of a conservative PP strategy for precursor missions. Key features of the proposed strategy include: to prevent forward-contamination, all orbiters will follow Mars Observer PP procedures for assembly, trajectory, and lifetime. All landers will follow Viking PP procedures for assembly, microbial load reduction, and bio-shield. And, to prevent back-contamination, all sample return missions will have PP requirements which include fail-safe sample sealing, breaking contact chain with the martian surface, and containment and quarantine analysis in Earth-based laboratory. In addition to deliberating on scientific and technical issues, the workshop made several recommendations for dealing with forward and back-contamination concerns from non-scicntific perspectives

Cognitive Structure and Processing During Cognitive Behavioral Therapy vs. Pharmacotherapy for Depression
Background: Evidence has converged to suggest that cognitive processing and content covary with depression severity, whereas indices of cognitive structure exhibit greater stability and promise as markers of vulnerability for depression. The objective of the current study was to investigate the temporal dynamics and causal role of cognitive structure and processing in treatment for depression. Method: A total of 104 patients with major depressive disorder were randomized to receive cognitive behavioral therapy (CBT; n = 54) or pharmacotherapy (n = 50). Patients completed the Hamilton Depression Rating Scale (HAM-D), Beck Depression Inventory-II (BDI-II), Psychological Distance Scaling Task (PDST), Redundancy Card-Sorting Task (RCST), and Self-Referent Encoding Task (SRET) before, during, and after treatment. Results: Most cognitive indices exhibited change over treatment to a similar degree across both treatments. Evidence for the mediating role of cognition was limited, and not specific to CBT. Discussion: Results suggest that both cognitive structure and processing may be amenable to change, by both CBT and pharmacotherapy. The role of cognitive structure in the course of depression may require qualification
