Human Rights and Social Development in the Chinese White Papers on Human Rights

In 1991, the Information Office of the State Council of the People’s Republic of China launched a Chinese national version of human rights issuing the first White Paper on Human Rights. Since 1991, the Chinese Government has issued several specific White Papers (the latest one in October 2016) describing the overall approach to human rights and two National Human Rights Action Plans (2009, 2012). The paper presents the Chinese official stance on human rights emerging from an in-depth analysis of the Chinese White Papers on Human Rights in the period 1991-2018

Il diritto al clima. Una prima concettualizzazione

The paper offers a conceptualization of the subjective right to climate, taking in considerations the European Climate Change Litigation (the Urgenda Climate Case) and the International Climate Law. The paper considers human and/or fundamental rights as claims and briefly describes the bottomup trajectory of the rights, highlighting the role of social activists, lawyers and courts. Then the paper analysis the reasons supporting the claim aimed at recognizing a specific right to climate. Finally, the paper proposes a first general definition of the subjective right to climate

Il contributo muove da una riflessione arendtiana per svolgere un ragionamento sullo human rights gap come fattore di spinta dei fenomeni migratori. La riflessione, inoltre, si articolerà intorno al ruolo dello Stato nei processi di implementazione dei diritti avendo come metro il mutamento di prospettiva che, a partire dal fine del secondo conflitto mondiale, ha spostato il piano normativo dei diritti dall'ambito domestico a quello internazionale. Verrà così ribadita l'importanza del principio di uguaglianza nell'effettivo riconoscimento dei diritti, anche nella prospettiva cosmopolitica, facendo ricorso ad elementi utili a fotografare la profondità dello human rights gap

Guerra e cambiamento climatico. Non c'è contrasto al cambiamento climatico senza pace

ItLa lotta al cambiamento climatico è una priorità dell'agenda politica internazionale. Da un lato i report dell'International Panel on Climate Change sottolineano la necessità di adottare misure mitigative capaci di produrre effetti tangibili nei prossimi anni. Dall'altro lato il regime giuridico dei cambiamenti climatici è stato promosso negli ultimi trent'anni dalle Nazioni Unite con l'adozione della Convenzione Quadro sui Cambiamenti Climatici (1992), del Protocollo di Kyoto (1997) infine dell'Accordo di Parigi (2015). Il contributo si interroga sulle prospettive del contrasto al cambiamento in seguito all'invasione russa dell'Ucraina evidenziando l'impatto del conflitto sulle condizioni di sistema necessarie per realizzare una efficace governance globale del contrasto al cambiamento climatico.EnThe fight against climate change is a priority on the international political agenda. On the one hand, the reports of the International Panel on Climate Change underline the need to adopt mitigative measures able to reach tangible effects in the next years. On the other hand, the international climate change regime has been promoted in the last thirty years by the United Nations through the adoption of the Unite Nations Framework Convention on Climate Change (1992), the Kyoto Protocol (1997) and the Paris Agreement (2015). The paper analyses the consequences of the Russian invasion of Ukraine on the international climate change regime, highlighting the impact of the conflict on the systemic conditions needed to fight against climate change in the perspective of global governance

Potere avvocatile e processualità dei diritti

The paper describes the growing role of lawyers in the field of human and fundamental rights, specifically in the European Multilevel System. Firstly, the paper proposes a conceptualization of the lawyers’ power as political power, also underlying the s.c. “social function” aimed at guaranteeing human rights and empowering the rule of law. Then a more general reflection on the related Trial nature of rights will be developed, specifically taking in consideration Francesco Viola’s approach to human rights as social practice. Consequently, the bottom-up trajectory of human and fundamental rights will be better defined, pointing out the strategic role of litigation and lawyers in the human rights enforcement mechanisms
