Appunti sui brevia di XI e XII secolo

Among the early middle ages documentary heritage, really poor is the quantity of brevia we can examine; but it doesn't mean this kind of record was unusual, as is shown by some formulae of Chartularium langobardicum (10th century). Nevertheless, they begun to frequently appear since mid 11th Century, in order to resolve new claims that changes in politics and social relations brought out (feudal relations as well as, later, legal activity of cities government, and overall extra-judicial settlement of disputes). This survey has the purpose to analyze summarily the phase, between XIth and XIIth Century, in wich recording per breve became a normal option in these circumstances, when a clean pattern was developed by notarial culture - also provided of courts experience - giving breve a form that remind, in some respects, the previous pleas writing schemes

ITALIANO: Scopo del saggio è illustrare un gruppo di brevia milanesi di età carolingia, la cui tipologia è pressoché assente in altre aree del Regno. Con queste scritture venivano descritte e registrate le modalità di presa della vestitura di beni acquisiti (dal monastero di Sant’Ambrogio anzitutto) per vendita o donazione, allo scopo di stabilirne e rendere pubblica la legittimità. Pratiche che prevedevano la presentazione e la lettura pubblica, in loco, dei documenti che accompagnavano il trasferimento del diritto di proprietà. Scritture da valutare con un occhio rivolto agli interventi normativi di quegli anni (tra Carlo III e Guido da Spoleto) e alla standardizzazione documentaria e processuale della ostensio chartae. / ENGLISH: The aim of the essay is to illustrate a group of Milanese brevia dating from the Carolingian period, a type of document that is almost absent in other areas of the Kingdom. These writings described and recorded the methods of taking investiture of goods acquired (firstly by the monastery of Sant'Ambrogio) through a sale or donation, in order to establish and make public its legitimacy. Practice provided for the presentation and public reading, on site, of the documents that accompanied the transfer of the right of ownership. These writings should be considered against the backdrop of the normative changes occuring in the same period (from the reign of Charles III to Guido of Spoleto) and to the documentary and procedural standardization of the ostensio chartae

Does really mean a progress in scientific methods and quality of charters editions the employ of digital standard such as XML or TEI? In last years confidence has improved - among young scholars above all -, but practice and projects are not adequate till now. In this survey are fixed some points about context and by adjusting the focus on the specificity of this kind of document, to put back in its right perspective the significance and the utility of digital editions
