    Mental health, subjectivity and the city: an ethnography of migrant stress in Shanghai.

    Ethnography, with its focus on everyday experience, can yield significant insights into understanding migrant mental health in contexts where signs of severe mental distress remain largely imperceptible, and more generally, into how stresses and strains are lived through the spaces, times and affective atmospheres of the city. Migrant ethnography can help us reconsider the oft-made connection between everyday stress and mental ill health. In this contribution, drawing on field evidence in central and peripheral Shanghai, we highlight the importance of attending to the forms of spatial and temporal agency through which migrants actively manage the ways in which the city affects their subjectivity. These everyday subjective practices serve to problematize the very concept of 'mental health'. The paper engages in a critical dialogue with sociological and epidemiological research that assesses migrant mental health states through the lens of the vulnerability or resilience of this social group, often reducing citiness to a series of environmental 'stressors'. Distinct from methods ascertaining or arguing against the prevalence of mental disorders among urban migrants, the insight of urban ethnography is to open up a space to explore the mediations that operate dialogically between the city as lived by migrants through particular places and situations and forms of distress

    This study analyzes same-sex marriage and interfaith marriage in the perspective of HumanRights and Islamic Law. This research is a library research using the juridical-normative approachand descriptive analysis data. The results of the study show that same-sex marriage by nature hasagainst the nature of human life that is born to establish mental and biological bonds between theopposite sex, namely between men and women. The Positive Legal Review emphasizes that in theMarriage Law, it is stated that marriage is a physical and spiritual bond between a man and a womanto form a family or household and to carry on offspring and aim at upholding religious teachingsand carrying out customs. On the other hand, Islamic religious law also explicitly prohibits same-sexmarriage. As for the relation to interfaith marriage, if it is legalized, it is a violation of the constitution.Article 29 of the 1945 Constitution states that the State is based on the One Godhead (paragraph 1).The state guarantees the freedom of every resident to embrace his own religion and worship accordingto his religion and belief (verse 2). This article clearly states that the State guarantees every citizento practice his religious teachings. One form of freedom of religious worship is manifested in theimplementation of marriage. Religion regulates the procedures for marriage, including what is allowedand not done. Six religions recognized in Indonesia reject interfaith marriage. The legalization ofinterfaith marriage means that the government does not respect the prevailing rules in religion

    This study aims to analyze the result of Supreme Court ruling Number 163 K/AG/2011 AboutNasab’s Refusal Of a Legitimate Son By The Oat Of Li’an and how Islamic law and legislationgoverned it. And to explain what the status of the denied children’s passages is. This study usesinductive research methods and this type of research is a research library and the research approachemploys both qualitative and descriptive approaches. The results of the study show that the use ofother oaths to refuse the children's text in the Supreme Court Decision No. 163 K / AG / 2011 is inaccordance with the rules of Islamic law and statutory regulations, even though the wife is not willingto take the li'an oath, it still falls under the law. In accordance with the opinion of Imam Syafii that ifthe husband has completed his part, even though the wife does not do li'an. As well as changing thechild's nasab status which is denied by the father and only has a civil relationship with the mother andthe mother's family, while the father is free from the right to provide a living, this is in accordance withArticle 162 of the KHI

    The marriage desired by all prospective husbands and wives is a sakinah, mawaddah, warrahmah marriage, but in practice the road to marriage often experiences various obstacles and leads to divorce. Cases of divorce or divorce lawsuits continue to increase every year, a factor indicating this phenomenon is caused by various factors such as economic conditions, the environment, the presence of infidelity, the unpreparedness of a candidate to domestic violence. The solution for handling this case is by providing guidance on premarital education as an implementation of the readiness of the prospective husband and wife to get married. This activity is a form of student service to the community in the Real Work Lecture program with the Community Education method, namely using a socialization approach, mentoring or monitoring and providing webinars as exposure to premarital education and community consultation. The results of this activity are expected to be able to overcome problems that occur in the community and minimize the level of divorce to domestic violence in the community

    This study examines the legal considerations in settling inheritance disputes involving land distribution in Selong Religious (Islamic) Court of East  Nusa Tenggara. The data in this study were obtained from interviews and court decision analysis. This study shows that the practice of granting property before the death of the muwārith (testator) can cause inheritance-based land disputes in the future. Disputes usually arose when the land was distributed only to particular heirs, neglecting the others, especially the daughters and their descendants. In deciding the land disputes in inheritance cases, judges evermore considered the legal validity of the land distribution. Besides that, the judges use Islamic legal sources such as the Quran, Hadith, opinions of scholars, and fiqh in their legal considerations. However, the use of these multiple references does not necessarily lead to a diverse outcomes.   Abstrak: Penelitian ini membahas praktik pemberian mahar dalam perkawinan masyarakat Aceh, Indonesia dan Selangor, Malaysia. Studi ini mengkaji ketentuan kadar mahar dalam perundang-undangan Indonesia dan Malaysia serta penerapannya di tengah masyarakat. Sumber data dalam penelitian hukum empiris ini adalah wawancara dan studi dokumen. Data-data tersebut kemudian diolah menggunakan teori realisme hukum dan teori ‘urf. Temuan dalam penelitian ini menjelaskan bahwa ketentuan kadar mahar dalam perundang-undangan Indonesia berdasarkan asas kesederhanaan dan kemudahan. Namun, dalam praktiknya aturan adat Aceh menjadi pilihan masyarakat dalam menentukan dan menetapkan kadar mahar. Penetapan kadar mahar di Aceh ditentukan oleh pihak keluarga perempuan yaitu mahar mitsl, yang diberikan dalam bentuk emas dengan sebutan mayam. Berbeda dengan kadar mahar Negeri Selangor yang ditentukan oleh Pemerintah Kerajaan Negeri dengan kadar minimum RM 300.00 yang merupakan kesatuan antara mahar dan hantaran untuk gadis maupun janda. Kenyataannya di masyarakat terdapat beberapa orang Selangor yang masih menetapkan sendiri nilai hantaran yang harus diserahkan kepada pihak perempuan

    Fostering a sakinah family is the dream of all people who are building a household, efforts to make it happen is not an easy matter, because it requires hard work and support from all parties in the family, both father, mother and child. Not a few families who have problems and even fail in the middle of the road, because some family members do not have a sense of responsibility and do not carry out their obligations as they should in the family. For this reason, marriage guidance is needed as a preventive measure so that there are no disputes in the household. The implementation method in this activity is counseling to the community directly with resource persons in accordance with their fields. The results of this activity indicate an increase in public awareness of the importance of building and implementing a sakinah family in their respective families

    This study analyzes the fatwa of the Indonesian Ulema Council in imposing three divorces at once and the factors that influence the fatwa of the Indonesian Ulema Council so that it imposes three simultaneous divorces. This research is qualitative, with a descriptive analysis method supported by normative law or literature study. Data collection, namely the fatwa of the Indonesian Ulema Council Three Divorces at Once, and books, journals, articles, and so on. The study's results explained that the decision of the fatwa of the Indonesian Ulema Council stated that divorces that occurred with three divorces at the same time resulted in one divorce law. In this decision, the Indonesian Ulema Council considered the opinion of the majority of scholars and Law no. 1 Marriage and the Compilation of Islamic Law as stated in article 115 KHI "Divorce can only be carried out before the trial of the Religious Court after the Religious Court has tried and failed to reconcile

In addition, this mentoring activity can help parents in conducting targeted and structured home learning coaching. Assistance in basic literacy activities during the COVID-19 pandemic for children aged 6-12 years in RT 05 RW 17 can increase motivation and help with learning difficulties at home for children aged 6-12 years in RT 05 RW 17. This can be seen from the enthusiasm, enthusiasm, and seriousness of the children in the RT 05 RW 17 environment during the program activities
