INTERNATIONAL COOPERATION IN GOOD TAX GOVERNANCE
In times of crisis and uncertainty the countries look for solutions that will protect tax revenues from tax base erosion. In attempts of increasing the level of tax collection they try to fight tax avoidance and tax evasion. Among the difficult challenges faced by governments, there are also aspects of maintaining their competitive position and keeping measures to stimulate countries’ economic development. Among the issues related to fiscal policy there are also the matters of good tax governance, defined as standards of transparency, exchange of tax information and fair tax competition. The article presents basic issues related to good governance in the tax matters. The analysis of initiatives of international organisations and the European Union points to the need for double-track action: the implementation of the standards in the developed countries and simultaneous action towards the third countries, so that the standards of good governance in the tax matters can spread at the wide geographical area.</p
Wymiana informacji z terytoriami stosującymi szkodliwą konkurencję podatkową – stan obecny i perspektywy rozwoju
The goal of the article is presenting the national and international efforts aimed at neutralising the growing popularity of tax havens and reducing the “flight capital” phenomenon. The paper analyses countermeasures implemented in order to increase the transparency of international financial markets. First, the article examines the current state of Polish agreements that can form the legal basis for the international exchange of tax information. Next parts of the paper analyse the statistical data provided by the Polish Office of Tax Information Exchange in Konin, in order to answer the research question, whether the available solutions constitute tools that allow for the efficient exchange of tax information with “uncooperative” territories. The final part of the paper includes concluding remarks, together with attempts to predict the direction of future development in international tax information exchange.Celem artykułu jest zaprezentowanie rozwiązań krajowych i międzynarodowych zmierzających ku zneutralizowaniu rosnącej popularności rajów podatkowych i ograniczeniu zjawiska „kapitału ucieczkowego”. W pracy skupiono się na inicjatywach nakierowanych na zwiększenie transparentności rynków, a także umożliwienie wymiany informacji podatkowych pomiędzy administracjami podatkowymi poszczególnych terytoriów. Metodą analityczno-porównawczą zbadano aktualny stan prawny porozumień mogących stanowić podstawę do wymiany informacji podatkowych między Rzecząpospolitą Polską a terytoriami „niewspółpracującymi”. W celu oceny skuteczności dostępnych rozwiązań przeanalizowano dane statystyczne dostarczone przez Biuro Wymiany Informacji Podatkowych w Koninie. Artykuł zakończono wnioskami i próbami przewidzenia kierunków rozwoju międzynarodowej współpracy w zakresie wymiany informacji podatkowych
Mokesčiių lengvatos besivystančios ekonomikos šalyse
Emerging economies have introduced tax incentives for various reasons. In
some countries in transition, such instruments may be seen as a counterweight to the investment
disincentives inherent in the general tax system. In other countries, the incentives are
intended to offset other disadvantages that investors may face, such as a lack of infrastructure,
complicated and antiquated laws, bureaucratic complexities and weak administration. The article
brings closer the issue of tax incentives offered by developing countries in order to attract
foreign capital. After presenting the natural order of deduction, which assumes that tax incentives
enhance foreign direct investments and as such have a positive influence on economic
growth, which – as a consequence – strengthens development, the author reverses the order of
deduction and asks the question, whether such instruments are really efficient solutions in the
process of strengthening the states’ competitive position. To answer the question, the author
analyses chances and threats of including tax incentives into fiscal policy, identifies the main
restrictions, and tries to list some solutions which can be helpful in the process of implementing
such instruments into the tax systems of developing countries. The article also focuses on the
main aspects of developing countries’ fiscal policy. It presents problems and challenges of the
taxation area (both at the domestic and international level) which developing countries face in
their attempts to increase tax revenues.Naujosios sparčiai augančios ekonomikos šalys pradėjo taikyti mokesčių lengvatas
dėl įvairių priežasčių. Kai kuriose pereinamosios ekonomikos šalyse tokios priemonės
gali būti vertinamos kaip atsvara investicijas varžančioms priemonėms, kurios neatskiriamos
nuo bendrosios mokesčių sistemos. Kitose šalyse lengvatos yra skiriamos kompensuoti
trūkumus, su kuriais investuotojai gali susidurti, kaip infrastruktūros trūkumas, sudėtingi ir
pasenę teisės aktai, biurokratinis sudėtingumas bei silpnas administravimas. Straipsnis iškelia
mokesčių lengvatų, kurias siūlo besivystančios šalys, siekdamos pritraukti užsienio kapitalą,
klausimą. Panagrinėjusi paprastai daromą prielaidą, kad mokesčių lengvatos gali padidinti tiesiogines
užsienio investicijas ir turėti teigiamą įtaką ekonomikos augimui, kurio pasekmė yra
stipri plėtra, autorė atsisako tokios prielaidos ir kelia klausimą, ar tokios priemonės yra tikrai
efektyvios ir stiprina valstybių konkurencinę poziciją. Siekdama atsakyti į šį klausimą autorė
analizuoja mokesčių lengvatų naudojimo fiskalinėje politikoje galimybes ir grėsmes, nustato
pagrindinius apribojimus ir bando išvardyti kai kuriuos sprendimus, kurie galėtų padėti
įgyvendinti minėtas priemones besivystančių šalių mokesčių sistemoje. Straipsnyje taip pat kalbama
apie pagrindinius besivystančių šalių fiskalinės politikos aspektus. Pateikiamos problemos
ir iššūkiai mokesčių srityje (tiek vidaus, tiek ir tarptautiniu lygmeniu), su kuriais susiduria
besivystančios šalys bandydamos didinti mokestines pajamas
Country-by-Country Reporting jako inicjatywa w kierunku poprawy przejrzystości finansowej w Unii Europejskiej
The aim of the paper is to bring closer Country-by-Country Reporting and outline possible future amendments of the introduced anti-tax avoidance measures. The article presents the motives of implementing the international CbC initiative, aimed at increasing transparency of the biggest multinational enterprises, with particular emphasis on the specificity of the European Union. Part 2 of the paper analyses the European legal bases for companies’ financial reporting. It also gives an overview of the main findings of Directive 2016/881, which implements Country-by-Country Reporting and allows for the exchange of information between tax authorities. Part 3 deals with the national perspective, presenting the CbC solutions implemented to the Polish legal system; the paper also attempts to assess the potential impact of tax information disclosures, both from the perspective of taxpayers and the tax administration. The final part presents conclusions and tries to draft future developments of the Country-by-Country Reporting system. In the paper, the following research methods have been used: critical analysis and deduction, with particular reference to the source materials and legal acts, as well as the reports of the European Commission, consulting companies, and NGOs. Although the article deals with tax matters, CbC Reporting is an important and relevant issue from the point of view of researchers and accounting specialists. Reporting this phenomenon is part of the accounting science as a universal tool for recording economic phenomena. The author examined all relevant sources and took into account all important factors in order to obtain a comprehensive picture of CbC Reporting and to prepare a paper that may serve as a reference for future research.Celem artykułu jest przybliżenie inicjatywy Country-by-Country Reporting, wypracowanej w ramach międzynarodowych inicjatyw nakierowanych na walkę z unikaniem i uchylaniem się od opodatkowania, a także nakreślenie perspektyw ewolucji systemu raportowania według jurysdykcji podatkowych. W artykule zaprezentowano przesłanki leżące u podstaw wprowadzanych zmian, ze szczególnym uwzględnieniem specyfiki unijnej, wynikającej z potrzeby harmonizacji przepisów krajowych członków Wspólnoty. W części 2 przybliżono podstawy prawne dotyczące sprawozdawczości firm europejskich, obowiązujące przed wprowadzeniem przepisów raportowania według krajów, a następnie zaprezentowano główne założenia dyrektywy dotyczącej automatycznej wymiany informacji. W części 3 zaprezentowano rozwiązania CbC wdrożone do polskiego porządku prawnego ustawą o wymianie informacji podatkowych z innymi państwami; podjęto również próbę oceny potencjalnych skutków ujawniania danych o największych podatnikach PIT, zarówno z perspektywy podatników, jak i administracji skarbowych. W podsumowaniu zawarto wnioski końcowe i zaprezentowano najnowszą inicjatywę unijną, zmierzającą do zobowiązania międzynarodowych przedsiębiorstw do upubliczniania informacji zawartych w raportach Country-by-Country. W artykule zastosowano metodę krytycznej analizy i dedukcji, ze szczególnym uwzględnieniem materiałów źródłowych i aktów prawnych, a także raportów Komisji Europejskiej, firm doradczych oraz organizacji NGOs. Chociaż artykuł dotyczy kwestii podatkowych, sprawozdawczość CbC stanowi ważne zagadnienie z punktu widzenia zarówno naukowców, jak i specjalistów ds. księgowości; fakt raportowania tego zjawiska wpisuje się w naukę rachunkowości jako uniwersalnego narzędzia ewidencji zjawisk gospodarczych. W artykule zbadano wszystkie istotne źródła, a także wzięto pod uwagę ważne czynniki, tak, by uzyskać kompleksowy obraz Country-by-Country Reporting, mogący służyć jako punkt odniesienia do przyszłych badań
The deadweight cost of implementation of the Foreign Account Tax Compliance Act (FATCA)
From 1 June 2013 FATCA – the new American law on the disclosure of financial information about foreign accounts for tax purposes – came into force. The aim of the Foreign Account Tax Compliance Act is to prevent the tax evasion of US citizens with offshore accounts. The Act requires all foreign financial institutions to identify American people in possession of the financial accounts (banking, brokerage, etc.), and then transmit that information to the tax authorities of the United States. The penalty for failure to comply with this requirement will be a 30% withholding tax on capital flows from the United States. The article presents the main issues connected with FATCA and brings closer the arguments pro and contra. As the Act results in new requirements which non-US financial institutions have to fulfil, the paper looks both at the legislative and cost-related problems. It also analyses how the new provisions will influence Polish financial institutions and their customers
International initiatives towards transparency and security of international financial flows
The purpose of this article is the presentation of the main issues related to the optimal level of legislation governing the international financial flows. Well-designed regulations enhance the creation of stable and secure investment climate. On the one hand the rules support the freedom of investment and strengthen the competitive position of the territory. On the other they allow the effective fight against financial frauds, tax evasion and the erosion of the tax base. The paper analyses the risks associated with the lack of regulation of capital flows, as well as the consequences of too strict controls and excessive tax rules. It also presents international initiatives of developed countries, aimed both at securing the national tax systems against the loss of tax revenue due to harmful tax practices, and at improving financial market transparency and the security of international markets
European blacklist as an element of common EU policy towards tax havens
Celem artykułu jest analiza działań krajów członkowskich i Unii Europejskiej,
skierowanych na neutralizację rajów podatkowych, a także przedstawienie perspektyw
skuteczności nowego instrumentu, jakim jest utworzona w 2015 r. europejska
lista rajów podatkowych. W pracy zostały zaprezentowane inicjatywy wspólnotowe
podejmowane w celu zmniejszenia negatywnego wpływu terytoriów stosujących szkodliwą
konkurencję podatkową. Przeanalizowano zestawy kryteriów, wykorzystywane
przez państwa członkowskie przy sporządzaniu krajowych czarnych list, a następnie
przybliżono mechanizm tworzenia paneuropejskiej listy rajów podatkowych i konsekwencje
publikacji wspólnego, ponadkrajowego wykazu. Zbadano również możliwości
zastosowania spójnych procedur oraz wspólnych środków ochronnych, a także dokonano
oceny perspektyw wdrożenia jednolitych działań europejskich w walce z unikaniem
i uchylaniem się od opodatkowania.The aim of the article is analysing the perspectives of pan-European blacklist –
the 2015 initiative, taken at the EU level in order to neutralise the tax havens’ role in
international financial flows. The article studies both: sets of criteria, used by different
Member States in the process of establishing national lists of non-cooperating countries;
and the mechanism to create a pan-European list of tax havens. Next, the paper moves
towards the consequences of the publication of the common, over-the national blacklist.
It also explores the future possibilities of implementing the European procedures and
collective protection measures. In the final part the article assesses the perspectives for
the implementation of unified and consistent EU actions, taken in order to combat tax
avoidance and evasion
THE FUTURE OF COMMON EU TAX POLICY
Improving the competitiveness of the European Union requires removing barriers from the single market. Among many challenges facing the EU Member States there is also a need for stronger coordination within the national fiscal policies. EU tax management is based on the principles of transparency, information exchange and fair tax competition. The article presents the measures taken by EU Member States in order to eliminate tax barriers within the single European market. The author, in addition to the review of EU legislation regulating the cross-border activities in the common market, brings closer the subject of promoting good governance in tax matters.</p
