    The Arbitration in Urgent Matters In Light of the Comparative and the UAE Laws

    The interim protection for legal rights is one of the methods of judicial protection that avoids the risk of delay in the implementation of the law and in providing objective protection for these rights and centers, as well as to preserve them from this risk by taking urgent, temporary or conservative measures by issuing judgments or orders. Therefore, the aim of this research is to answer the following questions: does the arbitrator have the right to consider interim requests to achieve this protection, and if yes what is the legal base of this authority? What are the authorities of the arbitrator in terms of comparative law and the UAE law No. 6 for 2018? These questions are investigated in this study in details which starts with the definition of interim relief and methods of their protection (first part). The second part examines the authorities of the arbitrator to issue interim decisions, while the last part focuses the scope of the authority of the arbitrator to ensure interim protection and the extent to which litigants may agree to exclude the jurisdiction of the interim relief of formal courts

    The Novelty in Terms of Jurisdiction and Procedural System for the Enforcement of Foreign Arbitration Awards In the United Arab Emirates

    The voluntary and forced execution embodies the purpose of the request for arbitration for anyone who obtains an award that achieves the purpose of the arbitration proceeding. In the context of foreign arbitration awards, permitting without national conditions or restrictions for the enforcement of foreign arbitration awards prejudices the sovereignty of the State over its territory, so the order of enforcement has become the judicial regulatory instrument imposed by the national legislator on the will of the parties, which is subsequent control over the issuance of the arbitration judgement - national, international or foreign - when it is to be enforced. In view of the different international and national legislation in the terms and conditions of the enforcement of foreign arbitration judgments, the problem of the study is to know which provisions are applicable to assess the availability of jurisdiction and procedures for obtaining order to enforce such awards. All this by pursuing an analytical approach and a plan based on two topics: the jurisdiction to request an enforcement order (first), and its procedural system (second)

    يجسد التنفيذ الاختياري والجبري غاية طلب التحكيم لكل من يحصل على حكم يحقق المراد من الدعوى التحكيمية. وفي نطاق أحكام التحكيم الأجنبية، فإن الترخيص بدون شروط أو قيود وطنية لتنفيذ أحكام التحكيم الأجنبية يؤدي إلى المساس بسيادة الدولة على إقليمها، لذا أصبح الأمر بالتنفيذ هو الأداة الرقابية القضائية التي يفرضها المشرع الوطني على إرادة الأطراف، فهي رقابة لاحقة على صدور حكم التحكيم – الوطني أو الدولي أو الأجنبي -حين يراد تنفيذه. ونظراً لتباين التشريعات الدولية والوطنية في شروط وإجراءات تنفيذ الاحكام التحكيمية الأجنبية فإن مشكلة الدراسة تكمن في معرفة أي النصوص الواجبة التطبيق لتقدير مدى توافر اختصاص وإجراءات استصدار الأمر بتنفيذ هذه الأحكام من ناحية، وشروط استصدارها من ناحية أخرى. وذلك كله باتباع منهج تحليلي وخطة تستند إلى مبحثين، هما: جهة الاختصاص بطلب الأمر بالتنفيذ (مبحث أول)، ونظامه الإجرائي (مبحث ثان)

    Comparison of Operative vs Non-operative Management of Ankle Fractures in Diabetic Patients: Prospective Randomized Trial

    This study investigates the outcomes and complications associated with the management of ankle fractures in diabetic patients. A total of 44 diabetic patients with ankle fractures were enrolled, and they were randomly assigned to either conservative or operative treatment groups. The study evaluated demographic characteristics, diagnosis, complications, functional outcomes, and correlation with HbA1c and ankle brachial index. The results revealed a 29.5% complication rate among the patients, including superficial infections, Charcot neuroarthropathy, arthritic changes, loss of reduction leading to ankle fusion, and stiffness. Functional outcome scores (AOFAS and SF36) did not significantly differ between the conservative and operative groups. Correlation analysis showed a significant negative relationship between HbA1c levels and functional scores in the conservative group. Ankle brachial index demonstrated a negative correlation with the SF36 score in the conservative treatment group. The study emphasizes the importance of diabetic control and vascular assessment in guiding treatment decisions for diabetic ankle fractures
