La tradicional marginación del trabajador autónomo por parte del Derecho del Trabajo

Si bien es incuestionable la relevancia histórica del trabajo autónomo, igualmente es irrefutable el desinterés mostrado por parte del Derecho del Trabajo, desde sus albores, hacia el mismo. Esta disciplina, nacida como respuesta social a la Revolución Industrial, vino centrando su atención en la figura del trabajador subordinado. Dicho de otro modo, para tal rama del ordenamiento jurídico el objetivo fue, desde el principio, la protección y tutela del trabajador asalariado, manifestando mínimo interés hacia el trabajador por cuenta propia, cuya regulación quedaba encomendada a los órdenes jurídicos civil o mercantil. Muestra de ello es el contenido de los diversos textos normativos dictados a lo largo del siglo XX, los cuales, a pesar de ampliar progresivamente el ámbito aplicativo de la rama tuitiva por excelencia, no dieron cabida al trabajo autónomo en su esfera protectora.While there is no doubt about the historical relevance of self-employed work, the lack of interest displayed by Employment Law is equally irrefutable, from its outset to now. This discipline, created as a social response to the Industrial Revolution, focused its attention on the figure of subordinated workers. In other words, from the start, the objective for every branch of the legal code was the protection and guidance of salaries workers, with minimal interest being shown to those who work for themselves, whose regulation is entrusted to the civil or commercial legal codes. One example of this is the content of the diverse regulatory texts issued during the course of the XX century which —in spite of progressively expanding the applicatory scope of the protective branch par excellence— gave no room for self-employed work in its protective sphere.Obwohl die historische Bedeutung der beruflichen Selbständigkeit unbestreitbar ist, kann gleichzeitig unwiderlegbar konstatiert werden, dass das Arbeitsrecht von allem Anfang an Desinteresse an demselben gezeigt hat. Dieses Rechtsgebiet entstand als soziale Antwort auf die Industrielle Revolution und legte sein Hauptaugenmerk auf die Figur des abhängig Beschäftigten. Anders formuliert: für diese juristische Fachrichtung war das vorherrschende Ziel, von ihren Anfängen an, der Schutz und die Fürsorge des abhängig Beschäftigten. Das Arbeitsrecht zeigte wenig Interesse am Freiberufler, der rechtlich durch das Spanische Zivilgesetzbuch oder das Handelsrecht erfasst wurde. Beweis hierfür sind die Inhalte der verschiedenen juristischen Dokumente, die im 20. Jahrhundert verfasst wurden, und die, obwohl sich das Anwendungsfeld des Arbeitsrechts kontinuierlich um Schutzrechte erweitert hat, den Freiberufler nicht mit ihren Schutzgesetzen abdecken

CIL II2/5, 1113 and the location of a christian worship building in the surroundings of late antique Osuna

En este trabajo se examinan las evidencias procedentes de un paraje ubicado a escasa distancia de Osuna (Sevilla). Partiendo de la información historiográfi referente a los hallazgos realiza- dos a inicios del siglo XIX en el lugar denominado “Piedra del Cristiano”, se estudia de forma específica uno de ellos, el pedestal CIL II2/5, 1113, una dedicación de colonia Genetiua Iulia a su patrono, el senador Lucio Sergio Plauto, uno de los testimonios más relevantes y conocidos de la antigüedad altoimperial de Osuna. A partir del análisis de los aspectos formales de la inscripción, se considera que en su estado actual ésta es resultado de su reutilización como ara de altar cristiano, mediante la elaboración de un loculus para la deposición de reliquias, con- formando así, junto con un tablero no conservado, una mesa de altar de notables dimensiones que se ubicaría en un conjunto edilicio con funcionalidad religiosa asociado a una necrópolis de datación tardoantigua.This work studies the remains from a site located near Osuna (Seville). More specifically, we study one of the best known and most outstanding testimonies of the altoimperial antiquity in Osuna, the pedestal CIL II2/5, 1113, dedicated by colonia Genetiua Iulia to its patronus, Sen- ator Lucius Sergius Plautus. In order to do our research we have relied on the historiographical information concerning some findings at a place called “Piedra del Cristiano” in the early nineteenth century. From the analysis of the formal aspects of the inscription, we can consider that the current state of the piece is the result of its reuse as an ara of a Christian altar through the development of a loculus for the deposition of relics, thus forming, together with a board not preserved, an altar table of considerable size which would probably have been located in a religious building complex associated with a necropolis dating back to late antiquity

Se presentan en este trabajo seis nuevos ejemplares de placas decoradas que portan la inscripción CIL II2/7, 87a. Las nuevas piezas, todas ellas con el texto completo, permiten resolver la lectura del epígrafe, que hace referencia al taller (officina) en el que opera el figulus Restitutus.Six new testimonies of decorated ceramic plaques with the inscription CIL II2/7, 87a are presented in this paper.
