PROBLEMS OF THE SUCCESSOR TRUSTEE AS TO CLAIMS ARISING OUT OF SELF DEALING PURCHASES

    Get PDF
Although, under certain circumstances, the beneficiaries also may be able to enforce them, it is well settled that a successor trustee has the power to assert and enforce claims against his predecessor trustee for breaches of trust by the predecessor. Generally, wherever the circumstances are such that certain action or inaction by beneficiaries would bar them from taking advantage of a particular remedy if they were not under any incapacity, such action or inaction by the successor trustee will likewise be a bar. Therefore, in considering what remedies are available to the successor trustee and what activity or inactivity of that trustee may bar those remedies, reference will be made not only to those authorities dealing with claims by a successor trustee against his predecessor but also those authorities dealing with claims asserted directly by a beneficiary against his trustee

Academic libraries are faced with the challenge of meeting the varied demands of users stemming from the ever-increasing different formats of information resources. These libraries around the world have thus adopted the use of social media -to render the required services to library users. FUTO library is experiencing serious challenges in the effort to accommodate the needs of its users - including the increasing number of users small reading spaces compared to the rising student population and the fact that many students live off-campus. This study investigates the possibility of adopting social media-based library services at the Federal University of Technology, Owerri (FUTO), to overcome the library’s challenges

Design and implementation of a low-cost home automation and monitoring IoT system using message que telemetry transport protocol : South Africa context

Abstract: Home automation is a fast and growing industry in South Africa, because in recent years almost everything home and office electrical and electronics appliances are been connected to the internet and human mobile devices. There is an increase in demand of time from the working class and hence the busy time schedule. This necessitate the home automation and monitoring systems which enable homeowners to remotely monitor and control appliances in their houses and offices without being present in the device physical location. The designed system host the integrated intelligent unit functionalities that enable communication between the controller and remote end-user units of the system. It is important to ensure that home automation systems have a low cost to enable user adoption. Home automation systems should also incorporate latest technology, portability and also have internet connectivity capabilities. This paper proposes a design of low-cost home automation system that incorporates internet access and delivers internet of things (IoT) connectivity services in a smart home application. The designed system provides access to an internet connected home automation systems. The system is accessible via mobile devices and provides remote access to home appliances. In conclusion, during measurement and testing of the designed system, device full duplex connection for one round trip was less that 5seconds to relay a message packet between the transmitter subscriber device and the publisher receiver device. The performance of the designed device is satisfactory at first iteration prototype designed

Spatial and temporal variation in otolith chemistry for tautog (Tautoga onitis) in Narragansett Bay and Rhode Island coastal ponds

The elemental composition of otoliths may provide valuable information for establishing connectivity between fish nursery grounds and adult fish populations. Concentrations of Rb, Mg, Ca, Mn, Sr, Na, K, Sr, Pb, and Ba were determined by using solution-based inductively coupled plasma mass spectrometry in otoliths of young-of-the year tautog (Tautoga onitis) captured in nursery areas along the Rhode Island coast during two consecutive years. Stable oxygen (δ18O) and carbon (δ13C) isotopic ratios in young-of-the year otoliths were also analyzed with isotope ratio mass spectrometry. Chemical signatures differed significantly among the distinct nurseries within Narragansett Bay and the coastal ponds across years. Significant differences were also observed within nurseries from year to year. Classification accuracy to each of the five tautog nursery areas ranged from 85% to 92% across years. Because accurate classification of juvenile tautog nursery sites was achieved, otolith chemistry can potentially be used as a natural habitat tag
