    The role of traditional knowledge in the COVID-19 battle

    This article addresses the role of traditional medicine in the corona virus (COVID-19) battle. It situates traditional medicine within the traditional knowledge and Intellectual Property discussion. The paper discusses the increased gravitation towards using traditional medicine but also identifies the existence of scepticism towards its use. Indigenous communities make up a large portion of the traditional medicine community and are therefore called upon to play their role in the fight against COVID-19. The battle is real, the coronavirus ground is an intersecting one with multiple, plausible solutions. Traditional medicine has a role in this battle and this article advocates for collaboration. It is a clarion call for all stakeholders to join hands to fight the virus. It advocates inclusion rather than exclusion

    Traditional knowledge, biological resources and intellectual property rights in Asia : the example of the Philippines

    The relationship between traditional knowledge and intellectual property rights has become a topic for intensive debates at the national level, in various international settings and within and among different UN agencies, including the World Intellectual Property Organisation (WIPO), the UN Food and Agriculture Organisation (FAO), UNESCO, UNCTAD and the United Nations Environment Programme (UNEP). However, a consensus on a definition of traditional knowledge has yet to emerge due to persistent differences in perception. On the one hand, indigenous communities hold locally specific and holistic views of traditional knowledge, which are difficult to place within the framework of current intellectual property rights. Governments of developing countries, on the other hand, mostly focus on clearly defined aspects of traditional knowledge and their interpretation in the national interest and as expressions of national culture. Asian governments, in particular, have advocated the latter view. The Philippines provide an exception due to a tradition of recognising indigenous people as separate &quot;cultural communities&quot;. However, the practical implementation of so-called &quot;community intellectual rights&quot; thus far is largely confined to access and benefit sharing rules, compensation requirements for traditional farmers and defensive protection measures such as digital libraries documenting traditional knowledge.<br /

    Traditional Knowlege: Is Perpetual Protection a Good Idea?

    Most of the international dialogue about traditional knowledge has taken place within the context of an intellectual property framework with the World Intellectual Property Organization (WIPO) as the primary facilitator of the discussion. Following more than a decade of dialogue, the WIPO Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (WIPO IGC) has been given until the Fall of 2011 to come up with something concrete. Due to the intersection between traditional knowledge and intellectual property, the resulting text is likely to be a significant development for international intellectual property law. Developing countries have long advocated for international protection for traditional knowledge while developed countries have resisted movement on the issue. The duration of protection is one of the more contentious issues in the traditional knowledge debate. While developing countries and indigenous groups have expressed a preference for an indefinite term of protection, the developed countries have resisted engagement on such topics as premature. If the demands of the developing countries are met, there is a strong possibility that an international instrument to protect traditional knowledge will provide for perpetual protection

    A critical analysis of the protection of traditional knowledge within the Namibian legal system

    Includes bibliographical references.Namibia is well known for its unique climate and ecological profile hence its biodiversity, which comprises wild and cultivated species and varieties. The country’s relative isolation has contributed to the maintenance of a unique genetic resource base. There are many naturally occurring plants and animals that have been used since time immemorial by local people as a source of food security, primary health and for their general livelihood, which could be exploited for commercial purposes. There is a growing international interest in bio trade with, and bio prospecting in, Namibia. This paper examines Traditional Knowledge (TK) and Intellectual Property Rights (IPR’s)6within the Namibian context. It further examines whether the protection under the current Namibian intellectual property (IP) framework sufficiently protects all types of indigenous TK against exploitation. The rationale for the examination stems from a draft policy on ‘Access to Genetic Resources and the Protection of Associated Traditional Knowledge’. There is little knowledge about the genetic resources that have left Namibia, those that are still here, and their biological and conservation status. The associated problems, concerns and threats underscore the need for policies and legislation to regulate access to genetic resources, to protect TK and practices, and to facilitate the equitable sharing of benefits from the use of genetic resources

    Pada tahun 2020 lalu, Rumah Mode Christian Dior Couture, S.A. yang berkedudukan di Paris, Perancis, mengajukan permohonan kepada Kementerian Luar Negeri Republik Indonesia untuk menggunakan kain tenun Endek Bali dalam acara Paris Fashion Week untuk koleksi musim semi/panas (spring/summer) pada tahun 2021. Artikel ini bertujuan untuk memahami dan menganalisis konsep dan penerapan pelindungan dan pemajuan pengetahuan tradisional dan ekspresi budaya tradisional Indonesia dalam studi kasus penggunaan tenun Endek Bali oleh Christian Dior serta menganalisis pelajaran, baik kelebihan maupun kekurangan, yang dapat dipetik dari studi kasus tersebut. Artikel ini menunjukkan bahwa konsep pelindungan dan pemajuan pengetahuan tradisional dan ekspresi budaya tradisional Indonesia dalam studi kasus tenun Endek Bali oleh Christian Dior menggunakan konsep pelindungan hak kekayaan intelektual komunal dalam Undang-Undang Hak Cipta dan konsep pemajuan kebudayaan dalam Undang-Undang Pemajuan Kebudayaan. Adapun penerapan pelindungan tenun Endek Bali tersebut dilaksanakan dengan melakukan pendaftaran kekayaan intelektual komunal tenun Endek Bali sebagai ekspresi budaya tradisional dan pemajuan kebudayaan berdasarkan prinsip-prinsip dalam Undang-Undang Pemajuan Kebudayaan. Beberapa pelajaran dapat dipetik, yaitu kelebihan, bahwa adanya dukungan dari semua pihak, dan koordinasi serta sinergi yang relatif baik antara Pemerintah Pusat dan Pemerintah Daerah dalam setiap kronologis dan proses penggunaan tenun Endek Bali oleh Christian Dior serta penggunaan tenun Endek Bali yang dituangkan di dalam Memorandum Saling Pengertian antara Pemerintah Daerah Provinsi Bali dengan Christian Dior telah memberikan dampak secara positif terhadap perekonomian pada perajinny

    Traditional knowledge, including genetic resources of living organisms, especially plants, plays an extremely important role also in the development of modern science and present-day industry. This prompts us to consider the need, scope, and model of legal protection for such knowledge, both for the needs of the communities that create and cultivate it and for the wider public good. The present article includes an analysis of international legal regulations concerning the protection of traditional knowledge, with particular emphasis on the knowledge related to genetic resources, as well as legal works in this field. The considerations cover issues related to the development of the conceptual framework of such legal norms and the foundations of the legal protection of traditional knowledge, in particular the arguments concerning the need for such protection. The article also presents the basic types of intellectual property rights that can be the basis for legal protection of traditional knowledge.Tradycyjna wiedza, w tym dotycząca zasobów genetycznych żywych organizmów, w szczególności roślin, odgrywa niezwykle istotną rolę także w rozwoju współczesnej nauki i współczesnego przemysłu. Skłania to do podjęcia rozważań dotyczących potrzeby, zakresu oraz modelu ochrony prawnej takiej wiedzy, zarówno dla potrzeb społeczności, które wiedzę taką tworzą i kultywują, jak i dla szeroko pojmowanego dobra ogółu. Artykuł obejmuje analizę międzynarodowych regulacji prawnych poświęconych problematyce ochrony tradycyjnej wiedzy, ze szczególnym uwzględnieniem wiedzy związanej z zasobami genetycznymi, a także prac prawotwórczych w tej dziedzinie. Rozważania dotyczą kwestii kształtowania się siatki pojęciowej takich norm prawa oraz fundamentów ochrony prawnej tradycyjnej wiedzy, zwłaszcza argumentacji dotyczącej potrzeby takiej ochrony. Przedstawiono też podstawowe rodzaje praw własności intelektualnej, które mogą stanowić podstawę ochrony prawnej tradycyjnej wiedzy
