    Legal Rules, Legal Reasoning, and Nonmonotonic Logic

    This dissertation develops, justifies, and examines the jurisprudential implications of a non-monotonic theory of common law legal reasoning. Legal rules seem to have exceptions but identifying all of them is difficult. This hinders attempts to formalize legal rules using classical logics. Non-monotonic logics allow defeasible inference, permitting rules that hold generally but can be defeated in the presence of exceptions. This ameliorates the problem of characterizing all exceptions to a rule, because exceptions can be added piecemeal while the rule remains. The first portion of the dissertation rebuts a prominent criticism leveled at a large class of theories of legal reasoning that includes my theory. The charge is that no coherent theory can recognize both (i) the difference between distinguishing and overruling, and (ii) the constraint of precedent. The critics argue that (ii) is more important than (i) and that (ii) can only be explained by monotonic legal rules. Drawing on cognitive psychology as well as legal theory, I show that coherent theories, such as my own, can accommodate both (i) and (ii). The second chapter provides motivation for understanding precedential constraint in terms of non-monotonic default rules and introduces my positive theory, which elaborates on John Horty's work in treating legal rules as prioritized defaults involving reasons. I motivate and implement a relaxation of Horty's restrictions on the form of rules to allow a more fine-grained characterization of precedent. Finally, I explore the relationship between these relaxations and the concept of precedent. The final section explains how my theory fits into the traditional jurisprudential ecosystem. I demonstrate that, contrary to assertions in the legal theory literature, this non-monotonic approach is entirely compatible with positivism's commitment to extracting rules from authoritative legal sources, namely court opinions.     Jurisprudence and Structural Realism

    Some Anglophone legal theorists look to analytic philosophy for core presuppositions. For example, the epistemological theories of Ludwig Wittgenstein and Willard Quine shape the theories of Dennis Patterson and Brian Leiter, respectively. These epistemologies are anti-foundational since they reject the kind of certain grounding that is exemplified in Cartesian philosophy. And, they are coherentist in that they seek to legitimate truth-claims by reference to entire linguistic systems. While these theories are insightful, the current context of information and communication technologies (ICT) has created new informational concepts and issues. As a result, the analytic epistemologies are increasingly challenged by alternative perspectives. One such alternative is Structural Realism (SR), which is influential among the natural sciences, and especially physics. Informational Structural Realism, (ISR) is a variant of SR that was introduced by Luciano Floridi. Unlike the coherentist theories, ISR promotes examination of the connections among types of information and informational structures. It is an important shift for legal theory today, since the challenges that the ICT presents have to do with pattern recognition across vast domains of diverse data. An informational jurisprudence is now required to understand the issues emerging from the ICT

    What Makes a Belief Warranted? A Pragmatist’s Answer

    Philosophical theories of warrant and justification are thought to answer the question of what makes some beliefs better to belief than others. Traditionally, philosophers have tried to find general qualities that beliefs share to get at the nature of warrant. Some of the most prominent theories based on these attempts are criticized. It is then suggested that what all of these theories miss is the fact that whenever the warrant of a belief is being evaluated, characteristics of the evaluator – not just the belief or the believer – affect the epistemic status of that belief. A pragmatist account of warrant is offered that takes into account the evaluator’s role in determining the epistemic status of a belief

    Won\u27t Get Fooled Again: The Dogma of Quine\u27s “Two Dogmas”

    [From the Introduction] In the 1950’s, W.V.O. Quine published what he thought was a crippling blow to the analytic/synthetic distinction. Hailed as one of the most important philosophical articles in the 20th century, the “Two Dogmas of Empiricism” sought to demonstrate how the concept of analyticity is circular in nature. The conclusions that Quine drew from this argument envisioned the collapse of reductionism and, subsequently, the verification theory. Both were theories central to the logical positivists whose hard-nosed doctrine dominated Anglo-American philosophy for much of early 20th Century. Although it has attracted criticism and praise, the article has held a profound influence in Western philosophy. Unfortunately, the article is flawed in the same manner the author critiques analyticity and the two doctrines following in its wake: the “Two Dogmas” is dogmatic itself. Quine’s essay strictly holds to ideas and claims that are clearly not true, highly contested, or preposterous. This article’s first critique exposes two major dogmatisms cleverly embedded under the superficial and swift analysis. Readers are required to agree with Quine on the assertion that all definitions are synonyms. This ignores axiological components of the relationship between them as well as demand agreement with the Cluster theory of naming. The second dogmatism is the blatant ignorance of two extremely conflicting theories of meaning (logical positivist and ordinary language philosophy) that is embodied in his dual categories of analyticity. For Quine to bridge the gap between the theories and ground analyticity, what he really did was set up an impossible task of needing to conform one theory of meaning to another. The third dogmatism that Quine, his followers and his critics are guilty of is the avoidance of syntheticity, thereby leaving the other half of the analytic/synthetic dichotomy untouched

    Homeostatic epistemology : reliability, coherence and coordination in a Bayesian virtue epistemology

    How do agents with limited cognitive capacities flourish in informationally impoverished or unexpected circumstances? Aristotle argued that human flourishing emerged from knowing about the world and our place within it. If he is right, then the virtuous processes that produce knowledge, best explain flourishing. Influenced by Aristotle, virtue epistemology defends an analysis of knowledge where beliefs are evaluated for their truth and the intellectual virtue or competences relied on in their creation. However, human flourishing may emerge from how degrees of ignorance are managed in an uncertain world. Perhaps decision-making in the shadow of knowledge best explains human wellbeing—a Bayesian approach? In this dissertation I argue that a hybrid of virtue and Bayesian epistemologies explains human flourishing—what I term homeostatic epistemology. \ud \ud Homeostatic epistemology supposes that an agent has a rational credence p when p is the product of reliable processes aligned with the norms of probability theory; whereas an agent knows that p when a rational credence p is the product of reliable processes such that: 1) p meets some relevant threshold for belief (such that the agent acts as though p were true and indeed p is true), 2) p coheres with a satisficing set of relevant beliefs and, 3) the relevant set of beliefs is coordinated appropriately to meet the integrated aims of the agent. \ud \ud Homeostatic epistemology recognizes that justificatory relationships between beliefs are constantly changing to combat uncertainties and to take advantage of predictable circumstances. Contrary to holism, justification is built up and broken down across limited sets like the anabolic and catabolic processes that maintain homeostasis in the cells, organs and systems of the body. It is the coordination of choristic sets of reliably produced beliefs that create the greatest flourishing given the limitations inherent in the situated agent. \u

    Building on Nietzsche's Prelude: Reforming Epistemology for the Philosophy of the Future

    Drawing from the "anti-philosophies" of Nietzsche and Wittgenstein, and deploying a methodology which synthesizes critical theory with evolutionary psychology and contemporary cognitive science, our analysis demonstrates: 1. Justifications, in any context, are oriented towards social manipulation and bear no relation to any "cognitive processes." 2. The role of logic is overstated, both with regards to our justifications, and also our cognition. 3. Truth and falsity are socio-linguistic functions which have no bearing on any "objective reality." Insofar as these claims are correct, the methods and aims (both normative and descriptive) of "classical epistemology" are invalidated. We offer up a proposal as to what a more useful/meaningful epistemology might look like, exploring how such a reformulation might affect conceptions of "knowledge" and "rationality.

    In this article, I will provide a critical overview of the form of non-deductive reasoning commonly known as “Inference to the Best Explanation” (IBE). Roughly speaking, according to IBE, we ought to infer the hypothesis that provides the best explanation of our evidence. In section 2, I survey some contemporary formulations of IBE and highlight some of its putative applications. In section 3, I distinguish IBE from C.S. Peirce’s notion of abduction. After underlining some of the essential elements of IBE, the rest of the entry is organized around an examination of various problems that IBE confronts, along with some extant attempts to address these problems. In section 4, I consider the question of when a fact requires an explanation, since presumably IBE applies only in cases where some explanation is called for. In section 5, I consider the difficult question of how we ought to understand IBE in light of the fact that among philosophers, there is significant disagreement about what constitutes an explanation. In section 6, I consider different strategies for justifying the truth-conduciveness of the explanatory virtues, e.g., simplicity, unification, scope, etc., criteria which play an indispensable role in any given application of IBE. In section 7, I survey some of the most recent literature on IBE, much of which consists of investigations of the status of IBE from the standpoint of the Bayesian philosophy of science

    Putnam's Internal Realism

    This work is intended to ascertain whether Putnam’s internal realism is actually a realist doctrine. Putnam has opposed internal realism, which maintains that truth is an epistemic notion (specifically, idealised rational acceptability), to metaphysical realism, which holds that truth is a non-epistemic notion (in particular, a correspondence relationship between sentences and extra-linguistic facts). Putnam has argued that, even if metaphysical realism is untenable, realism is still defensible, for internal realism is a form of realism. In my work, I leave aside the question of the correctness of Putnam’s arguments against metaphysical realism and I directly focus upon internal realism. I first present this position and I set out its realist characteristics: Putnam’s position can be characterised as one that originated in an attempt to develop Dummett’s anti-realist notion of truth in a realist direction. I show that this effort is in part successful. Next, I raise objections against internal realism and I show that, despite its merits, Putnam’s position is not a form of realism. This is so mainly because internal realism may collapse into relativism, which – I argue – is not realism, and because the internal realist cannot explain how the world, which is causally independent of our minds, makes statements true or false. Since Putnam’s probably constitutes the best possible attempt to produce an epistemic view of truth compatible with realism, I conclude that truth conceived as an epistemic notion is incompatible with realism. I finally suggest that realism can be restored if Putnam’s arguments against metaphysical realism can be shown to be incorrect, so that a non-epistemic notion of truth can be rehabilitated.Epistemology & Methodolog
