    Taming the Golden Goose: Private Companies, Consumer Geolocation Data, and the Need for a Class Action Regime for Privacy Protection

    With the implementation of new geolocation technologies, the boundaries between private versus commercial and secret versus easily ascertainable have vanished. Consumer information that was once very difficult and prohibitively expensive to ascertain, catalogue, and recall is available to companies at the click of a button. Not only that, but the collecting company can share consumer information with other companies even more easily than it can initially collect the information. Today, with the widespread use of smartphone and location-enabled tablet devices, it is possible for location services to determine and plot the location and travel of the device and thereby the travel and habits of the owner. Companies can use the collected customer information to sell products, and they can sell the information to third parties for a variety of both benign and malicious purposes. Meanwhile, skilled hackers can steal consumer information. After analyzing the current legal landscape of consumer privacy law as it relates to geolocation services, this Note argues that US and global consumers need the United States to act. In order to foster trust in corporations and the market, Congress should enact a framework that assures consumers of sufficient protection of those details that consumers hold intrinsically private, such as their personal locations. This Note concludes by examining the bills currently under consideration by Congress and their respective deficiencies

    'His own privacyĢ: Frederic Manning: a critical and historical analysis

    This thesis sets out to establish the fact that Frederic Manning is a writer whose work, hitherto regarded as too limited in its scope, its quantity and its quality to be exceptional, is actually diverse, productive and highly articulate, therefore justifying him a notable places in literature. The reasons given for that previous estimate are considered, and countered. The study commences with an introductory chapter briefly covering the main events in his life, particularly in relation to his literary development. Then follow three chapters which discuss his writing, genre by genre - his poetry, minor prose works, and major prose works. In particular the chapter on his minor prose works covers ground not previusly examined in such detail, being devoted to his reviews and his other critical writing, ranging through classical literature, and all eras of English literature, as well as through his critiques of noteworthy writers in French and Italian literature. In this genre Manning applies his knowledge, drawn from his outstanding breadth and depth of reading, to his theoretical appreciation of literature, while generally applying its practical value throughout his own creative writing. Previous analysts have been satisfied to deposit Manning among late Victorian adherents to Arnoldian standards, who yet somehow managed to write The Middle Parts of Fortune, seen by them as an aberration from the norm. This study makes the case for his progression from the Pre-Raphaelites and the Aesthetes/Decadents of the nineteenth century, to a Modernist trend in him, traced from the originality he perceived in William Morris, Thomas Hardy, J.M. Synge, Henri Bergsonā€™s philosophy, and in his fascination with twentieth century developments in dramatic construction. The conclusion reached is that, based on the diversity of material and consistent quality of Frederic Manningā€™s canon, his reputation as a writer will increase as further research comes to be devoted to his many-faceted life and works

    This is a descriptive study of elementary school teachers' perceptions of values transmitted in classrooms.     Suspect Until Proven Guilty, a Problematization of State Dossier Systems via Two Case Studies: The United States and China

    This dissertation problematizes the state dossier system (SDS): the production and accumulation of personal information on citizen subjects exceeding the reasonable bounds of risk management. SDS - comprising interconnecting subsystems of records and identification - damage individual autonomy and self-determination, impacting not only human rights, but also the viability of the social system. The research, a hybrid of case-study and cross-national comparison, was guided in part by a theoretical model of four primary SDS driving forces: technology, political economy, law and public sentiment. Data sources included government documents, academic texts, investigative journalism, NGO reports and industry white papers. The primary analytical instrument was the juxtaposition of two individual cases: the U.S. and China. Research found that constraints on the extent of the U.S. SDS today may not be significantly different from China\u27s, a system undergoing significant change amidst growing public interest in privacy and anonymity. Much activity within the U.S., such as the practice of suspicious activity reporting, is taking place outside the domain of federal privacy laws, while ID systems appear to advance and expand despite clear public opposition. Momentum for increasingly comprehensive SDS appears to be growing, in part because the harms may not be immediately evident to the data subjects. The future of SDS globally will depend on an informed and active public; law and policy will need to adjust to better regulate the production and storage of personal information. To that end, the dissertation offers a general model and linguistic toolkit for the further analysis of SDS

    ERP implementation methodologies and frameworks: a literature review

    Enterprise Resource Planning (ERP) implementation is a complex and vibrant process, one that involves a combination of technological and organizational interactions. Often an ERP implementation project is the single largest IT project that an organization has ever launched and requires a mutual fit of system and organization. Also the concept of an ERP implementation supporting business processes across many different departments is not a generic, rigid and uniform concept and depends on variety of factors. As a result, the issues addressing the ERP implementation process have been one of the major concerns in industry. Therefore ERP implementation receives attention from practitioners and scholars and both, business as well as academic literature is abundant and not always very conclusive or coherent. However, research on ERP systems so far has been mainly focused on diffusion, use and impact issues. Less attention has been given to the methods used during the configuration and the implementation of ERP systems, even though they are commonly used in practice, they still remain largely unexplored and undocumented in Information Systems research. So, the academic relevance of this research is the contribution to the existing body of scientific knowledge. An annotated brief literature review is done in order to evaluate the current state of the existing academic literature. The purpose is to present a systematic overview of relevant ERP implementation methodologies and frameworks as a desire for achieving a better taxonomy of ERP implementation methodologies. This paper is useful to researchers who are interested in ERP implementation methodologies and frameworks. Results will serve as an input for a classification of the existing ERP implementation methodologies and frameworks. Also, this paper aims also at the professional ERP community involved in the process of ERP implementation by promoting a better understanding of ERP implementation methodologies and frameworks, its variety and history
