    Online searches for jury selection

    abstract: The Sixth Amendment guarantees defendants the right to trial by an impartial jury. Attorneys are expected to obtain information about potential juror biases and then deselect biased jurors. Social networking sites may offer useful information about potential jurors. Although some attorneys and trial consultants have begun searching online sources for information about jurors, the privacy rights of potential jurors’ online content has yet to be defined by case law. Two studies explored the issue of possible intrusion into juror privacy. First, an active jury venire was searched for online content. Information was found for 36% of the jurors; however, 94% of the information was found through simple Google searches. Only 6% of the information we found was unique to other sites. We concluded that searching for potential jurors online is feasible, but that systematically searching sites other than Google is generally not an effective search strategy. In our second study we surveyed attorneys, trial consultants, law students, and undergraduate students about ethical and privacy issues in the use of public domain information for jury selection. Participants evidenced concern about the rights of jurors, the rights of the defendant and accuser, and the role of tradition in court processes

    The advent and popularity of online social networking has changed the way Americans socialize. Employers have begun to tap into these online communities as a simple and inexpensive way to perform background checks on candidates. However, a number of problems arise and may arise when employers base adverse employment decisions on the results of these online searches. Three basic problems or issues accompany searches of online profiles for employment decisions: inaccurate, irrelevant, or false information leads to unfair employment decisions; lack of accountability and disclosure tempts employers to make illegal employment decisions; and employer searches of an employee’s online social life violate an employee’s privacy when his off-duty conduct does not negatively impact her employer. Because searches of online social networking services such as MySpace and The Facebook only stand to become more prevalent and popular among employers, the law must expand to ensure users of these websites adequate protection from unfair, illegal or arbitrary employment decisions. Employers also stand to gain from such an expansion of legal protections because they will be accountable to make good employment decisions. The original purposes of the FCRA allow for and demand its expansion to cover the potential problems caused when employers go searching for a candidate or employee’s online social networking profiles. This solution effectively strikes an agreeable balance between an employer’s right to know its candidates and employees and an employee’s right to privacy and fair employment decision making

    Major Security Issue That Facing Social Networks with Its Main Defense Strategies

    The Social Network Service "SNS" has enabled significant advancements in a wide variety of scientific fields, and as a result, it has become an extremely popular subject in both academia and business. SNSs can be extremely beneficial to users because they eliminate economic and geographical barriers and can be used for job searching, entertainment and education. Regardless of the economic and social benefits, protecting businesses and users\u27 security and privacy remains a critical issue that must be addressed. It is critical to address and evaluate social network service challenges, as they vary according to the variety of SNS sites. Thus, by discussing SNS challenges alongside available and potential solutions, users, developers, and businesses can identify relevant and timely responses to specific threats, resulting in the best SNS-based services possible. The objective of this article is to discuss the inherent challenges of social networking sites and some critical solutions for resolving them. We extracted and analyzed seminal papers to add to the corpus of literature by focusing on several critical challenges in the social network service domain and shedding light on how these challenges affect a variety of domains, including users, sites, and business. The most frequently mentioned difficulties concerned privacy risks, anonymity risks, malware, spam, identity theft, phishing, business data, social content, technical issues, and psychological difficulties. By incorporating previously discovered solutions, this paper addressed these issues. The implications for both researchers and practitioners have been discussed

    An empirical analysis of SNS users and their privacy and security awareness of risks associated with sharing SNS profiles (online identities)

    Social networking sites (SNS) like MySpace, Facebook and LinkedIn now have hundreds of millions of users. In this paper a quantitative approach was used to analyse primary data collected about SNS users. Our findings show that SNS users are dominated by younger adults, higher education levels and higher income levels. SNSs are more likely to be used for maintaining existing friendships as opposed to establishing new friendships and for building business networks. SNS users either have poor levels of privacy and security awareness or high levels of complacency in relation to SNS profile sharing and sharing their identity online

    Profiles of social networking sites users in the Netherlands

    Online social networking has become a reality and integral part of the daily personal, social and business life. The extraordinary increase of the user numbers of Social Networking Sites (SNS) and the rampant creation of online communities presents businesses with many challenges and opportunities. From the commercial perspective, the SNS are an interesting and promising field: online social networks are important sources of market intelligence and also offer interesting options for co-operation, networking and marketing. For SMEs especially the Social Networking Sites represent a simple and low cost solution for listening the customer’s voice, reaching potential customers and creating extensive business networks. This paper presents the results of a national survey mapping the demographic, social and behavioral characteristics of the Dutch users of SNS. The study identifies four different user profiles and proposes a segmentation framework as basis for better understanding the nature and behavior of the participants in online communities. The findings present new insights to marketing strategists eager to use the communication potential of such communities; the findings are also interesting for businesses willing to explore the potential of online networking as a low cost yet very efficient alternative to physical, traditional networking

    In recent years, Online Social Networks (OSNs) have become an important\ud part of daily life for many. Users build explicit networks to represent their\ud social relationships, either existing or new. Users also often upload and share a plethora of information related to their personal lives. The potential privacy risks of such behavior are often underestimated or ignored. For example, users often disclose personal information to a larger audience than intended. Users may even post information about others without their consent. A lack of experience and awareness in users, as well as proper tools and design of the OSNs, perpetuate the situation. This paper aims to provide insight into such privacy issues and looks at OSNs, their associated privacy risks, and existing research into solutions. The final goal is to help identify the research directions for the Kindred Spirits project

    Attack vectors against social networking systems : the Facebook example

    Social networking systems (SNS&rsquo;s) such as Facebook are an ever evolving and developing means of social interaction, which is not only being used to disseminate information to family, friends and colleagues but as a way of meeting and interacting with &quot;strangers&quot; through the advent of a large number of social applications. The attractiveness of such software has meant a dramatic increase in the number of frequent users of SNS&rsquo;s and the threats which were once common to the Internet have now been magnified, intensified and altered as the potential for criminal behaviour on SNS&rsquo;s increases. Social networking sites including Facebook contain a vast amount of personal information, that if obtained could be used for other purposes or to carry out other crimes such as identity theft. This paper will focus on the security threats posed to social networking sites and gain an understanding of these risks by using a security approach known as &ldquo;attack trees&rdquo;. This will allow for a greater understanding of the complexity associated with protecting Social Networking systems with a particular focus on Facebook.<br /

    Ethics and social networking sites: A disclosive analysis of Facebook

    Paper has been accepted for publication in Information, Technology and People.Purpose: This paper provides insights into the moral values embodied by a popular social networking site (SNS), Facebook. We adopt the position that technology as well as humans has a moral character in order to disclose ethical concerns that are not transparent to users of the site. Design/methodology/approach: This study is based upon qualitative field work, involving participant observation, conducted over a two year period. Findings: Much research on the ethics of information systems has focused on the way that people deploy particular technologies, and the consequences arising, with a view to making policy recommendations and ethical interventions. By focusing on technology as a moral actor with reach across and beyond the Internet, we reveal the complex and diffuse nature of ethical responsibility in our case and the consequent implications for governance of SNS. Research limitations/implications: We situate our research in a body of work known as disclosive ethics and argue for an ongoing process of evaluating SNS to reveal their moral importance. Along with other authors in the genre, our work is largely descriptive, but we engage with prior research by Brey and Introna to highlight the scope for theory development. Practical implications: Governance measures that require the developers of social networking sites to revise their designs fail to address the diffuse nature of ethical responsibility in this case. Such technologies need to be opened up to scrutiny on a regular basis to increase public awareness of the issues and thereby disclose concerns to a wider audience. We suggest that there is value in studying the development and use of these technologies in their infancy, or if established, in the experiences of novice users. Furthermore, flash points in technological trajectories can prove useful sites of investigation. Originality/value: Existing research on social networking sites either fails to address ethical concerns head on or adopts a tool view of the technologies so that the focus is on the ethical behaviour of users. We focus upon the agency, and hence the moral character, of technology to show both the possibilities for, and limitations of, ethical interventions in such cases
