When Congress passed the Occupational Safety and Health Act (OSHA) in 1970, it commanded industry to provide its employees with workplaces free from recognized dangers. The legislation declared that the safety of workers is a public concern, a concern vital to the community at large. Spokesmen for the then-presiding Nixon Administration praised the Act heartily and vowed to implement it energetically. This bill opens up a whole new vista for the Labor Department, said the Secretary of Labor. We plan to launch the administration of the Act with all the vigor and momentum we can generate. Four years later, the vigor is exhausted, the momentum has fizzled, and the vista ahead is the same bloody stream of injuries and fatalities that has marred the past

OSHA at the Threshold: Setting Permissible Exposure Levels For Known Carcinogens After American Petroleum Institute

    Get PDF
This Comment examines the nature of scientific uncertainty that complicates precision in setting permissible exposure levels for carcinogens under the Occupational Safety and Health Act (OSHA). The author compares OSHA\u27s policy for dealing with these uncertainties with the legal and factual findings required by the Supreme Court in Industrial Union Department, AFL-CIO v. American Petroleum Institute as a prerequisite to the promulgation of standards. The author argues that the future of OSHA\u27s attempts to set exposure levels depends on a partnership between courts and the agency to confront these scientific issues. The author argues that reviewing courts should yield to OSHA\u27s expertise in analyzing, interpreting, and applying complex scientific data in an effort to enhance the efficiency of OSHA

[Excerpt] The nation’s job safety laws were enacted 40 years ago. The Occupational Safety and Health Act (OSHA) has never been updated. Penalties are weak even in cases where workers are killed, the government’s enforcement tools are limited and protections for workers who raise job safety concerns are woefully inadequate. Legislation has been introduced in the Congress to prevent future disasters and protect the safety and health of miners and other workers. H.R. 5663 strengthens the Mine Safety and Health Act and Occupational Safety and Health Act, the nation’s primary job safety laws. The bill – the “Miner Safety and Health Act of 2010” - provides for stepped up enforcement and tougher penalties for employers who flagrantly violate the law and enhances the protection of miners and workers who speak out about job hazards, report injuries and exercise their rights. The mine safety provisions address problems identified after the Upper Big Branch disaster, including increased oversight, enforcement and penalties for mines with a pattern of violations. The provisions to strengthen the OSH Act come from H.R. 2067 – the Protecting America’s Workers Act – legislation introduced last year and the subject of numerous Congressional hearings

This study also providing the suitable solution and precaution step towards the zero hazard for the factory for reducing the possible accidents or injuries. Some of the suggestion that has collected through data collected was carried out through site visit using Preliminary Hazard Analysis (PHA) and HIRARC form by interviewing several workers. As a result, this study gave recommendations to the company in order to practice the safe and no harm work practice and gives priority to the safety first
