    English language and Literature Department, University of Brawijaya.Public information notice is one application of delivering messages using written language. In Malang there are a lot of public information notices found in public places especially in crowded area such as Pasar Besar area and campus area. In the application, some public information notices use figurative language to gain certain effect for the readers. Figurative language is the utterance or expression used to express things in unusual way. Using Reaske (1966) definition of figurative language and Yule (1996) theory of context, this study is aimed to identify (1) the types of figurative language found in public infomation notice in Malang (2) the meaning of figrative language used in public information notice.This study uses qualitative approach in relation of the document analysis. The document analysis is intended to provide clear description about the text in the public information notice.This study finds that (1) figurative languages used in the public information notices in Pasar Besar area and campus area in Malang are sarcasm, metaphor, irony, synecdoche, hyperbole, and personification. Satire is mostly used in Pasar Besar area while personification is dominant in the campus area, (2) The meaning of the utterance in public information notices depends on the situational context and background knowledge of the readers.The writer suggests the next researchers conduct similar research about figurative language by using different point of view or objects. Many phenomena are found in the application of language in daily life. Moreover, the next researhers are able to find other theories concerning the idea of figurative language

    Longmeyer Exposes or Creates Uncertainty about the Duty to Inform Remainder Beneficiaries of a Revocable Trust

    This article discusses the surprising Longmeyer decision, handed down by the Supreme Court of Kentucky earlier this year in which a predecessor trustee was held to have a duty to give certain notifications to former remainder beneficiaries of a revocable trust. The authors then examine how Longmeyer might have been decided in other states and under other statutory schemes. The article concludes with observations concerning when certain notices to trust beneficiaries may be conducive to effective trust administration and suggestions to those who administer trusts on how best to comply with beneficiary notice requirements

    Plaintiffs-appellants appeal from a summary judgment entered in the United States District Court for the Southern District of New York (Casey, J.), dismissing their declaratory judgment action against defendant-appellee TIG Insurance Company ( TIG ) to establish excess insurance coverage, the District Court having found as a matter of law that the notice of claim provided to TIG was not timely. According to the undisputed facts presented to the District Court: (1) Plaintiffs provided TIG with notice of the claim giving rise to excess coverage approximately one month after the underlying tort action was filed but approximately three years after the arson giving rise to that tort action occurred; 284*284 and (2) Plaintiffs provided a claim notice to the producer of the TIG policy three days after the fire was set. Because we conclude that there are material issues of fact concerning whether the producer of the TIG policy was TIG\u27s agent for the purpose of accepting notices of claims from TIG\u27s insureds, we vacate the summary judgment and remand the case to the District Court for proceedings consistent with this opinion

    Follower notices, introduced in Finance Act 2014, can in certain avoidance situations be served on a taxpayer by HMRC (the UK revenue authority) where HMRC is of the opinion that the principles or reasoning of a decided case would deny the tax advantage in dispute. Such a taxpayer, who persists with the dispute, is then exposed to a tax-geared penalty of up to 50 percent and can be required to pay the tax in dispute before the litigation is determined. The follower notice regime was considered by the UK Supreme Court in R (on the application of Haworth) v HMRC. The Supreme Court judgment addresses fundamental issues concerning access to the courts, the doctrine of precedent and balancing taxpayer rights against the public interest in the collection of taxes
