    Noriega v. Activision/Blizzard: The First Amendment Right to Use a Historical Figure\u27s Likeness in Video Games

    Panama’s former dictator, Manuel Noriega, recently sued Activision Blizzard in the California Superior Court for using his likeness and image in the popular video game “Call of Duty: Black Ops II.” In his complaint, Noriega alleged that the use of his likeness violated his right of publicity. Former New York Mayor, Rudy Giuliani, came to Activision’s defense, and filed a motion to dismiss, which was granted. In granting Activision’s motion, the court held that Activision’s use of Noriega’s likeness was transformative and did not violate his right of publicity. This Issue Brief argues that the California Superior Court should not have applied the transformative use test but should have held that Manuel Noriega did not have a right of publicity for his place in Panama’s history

    Refugee students, language learners, and students in poverty are often viewed through a deficit model of everything they do not have in the way of school preparedness. However, many of them are survivors who possess courage and resilience. They also possess exceptional visual literacy developed through experiences with video and other images. Leveraging their visual literacy builds a bridge to help them understand text, which in turn helps them understand how literature reflects all of our experiences. Increased textual literacy helps students engage with vexing human questions. These questions form an inquiry base from which students can approach writing as an authentic task for self-expression. Student voice and culturally responsive teaching is valued in this model, which counters the experiences with failure that so many immigrant and low-income students learn when standardized testing is the focus of school. Inviting students to co-create literate spaces honors them, their families, and their cultures

    Indexing of fictional video content for event detection and summarisation

    This paper presents an approach to movie video indexing that utilises audiovisual analysis to detect important and meaningful temporal video segments, that we term events. We consider three event classes, corresponding to dialogues, action sequences, and montages, where the latter also includes musical sequences. These three event classes are intuitive for a viewer to understand and recognise whilst accounting for over 90% of the content of most movies. To detect events we leverage traditional filmmaking principles and map these to a set of computable low-level audiovisual features. Finite state machines (FSMs) are used to detect when temporal sequences of specific features occur. A set of heuristics, again inspired by filmmaking conventions, are then applied to the output of multiple FSMs to detect the required events. A movie search system, named MovieBrowser, built upon this approach is also described. The overall approach is evaluated against a ground truth of over twenty-three hours of movie content drawn from various genres and consistently obtains high precision and recall for all event classes. A user experiment designed to evaluate the usefulness of an event-based structure for both searching and browsing movie archives is also described and the results indicate the usefulness of the proposed approach

    Studies into dynamic facial expressions tend to make use of experimental methods based on objectively manipulated stimuli. New techniques for displaying increasingly realistic facial movement and methods of measuring observer responses are typical of computer animation and psychology facial expression research. However, few projects focus on the artistic nature of performance production. Instead, most concentrate on the naturalistic appearance of posed or acted expressions. In this paper, the authors discuss a method for exploring the creative process of emotional facial expression animation, and ask whether anything can be learned about authentic dynamic expressions through artistic inquiry
