    Arguing Machines: Human Supervision of Black Box AI Systems That Make Life-Critical Decisions

    We consider the paradigm of a black box AI system that makes life-critical decisions. We propose an "arguing machines" framework that pairs the primary AI system with a secondary one that is independently trained to perform the same task. We show that disagreement between the two systems, without any knowledge of underlying system design or operation, is sufficient to arbitrarily improve the accuracy of the overall decision pipeline given human supervision over disagreements. We demonstrate this system in two applications: (1) an illustrative example of image classification and (2) on large-scale real-world semi-autonomous driving data. For the first application, we apply this framework to image classification achieving a reduction from 8.0% to 2.8% top-5 error on ImageNet. For the second application, we apply this framework to Tesla Autopilot and demonstrate the ability to predict 90.4% of system disengagements that were labeled by human annotators as challenging and needing human supervision

    Artificial intelligence (AI) systems are creative, unpredictable, independent, autonomous, rational, evolving, capable of data collection, communicative, efficient, accurate, and have free choice among alternatives. Similar to humans, AI systems can autonomously create and generate creative works. The use of AI systems in the production of works, either for personal or manufacturing purposes, has become common in the 3A era of automated, autonomous, and advanced technology. Despite this progress, there is a deep and common concern in modern society that AI technology will become uncontrollable. There is therefore a call for social and legal tools for controlling AI systems’ functions and outcomes. This Article addresses the questions of the copyrightability of artworks generated by AI systems: ownership and accountability. The Article debates who should enjoy the benefits of copyright protection and who should be responsible for the infringement of rights and damages caused by AI systems that independently produce creative works. Subsequently, this Article presents the AI Multi- Player paradigm, arguing against the imposition of these rights and responsibilities on the AI systems themselves or on the different stakeholders, mainly the programmers who develop such systems. Most importantly, this Article proposes the adoption of a new model of accountability for works generated by AI systems: the AI Work Made for Hire (WMFH) model, which views the AI system as a creative employee or independent contractor of the user. Under this proposed model, ownership, control, and responsibility would be imposed on the humans or legal entities that use AI systems and enjoy its benefits. This model accurately reflects the human-like features of AI systems; it is justified by the theories behind copyright protection; and it serves as a practical solution to assuage the fears behind AI systems. In addition, this model unveils the powers behind the operation of AI systems; hence, it efficiently imposes accountability on clearly identifiable persons or legal entities. Since AI systems are copyrightable algorithms, this Article reflects on the accountability for AI systems in other legal regimes, such as tort or criminal law and in various industries using these systems

    Rationale in Development Chat Messages: An Exploratory Study

    Chat messages of development teams play an increasingly significant role in software development, having replaced emails in some cases. Chat messages contain information about discussed issues, considered alternatives and argumentation leading to the decisions made during software development. These elements, defined as rationale, are invaluable during software evolution for documenting and reusing development knowledge. Rationale is also essential for coping with changes and for effective maintenance of the software system. However, exploiting the rationale hidden in the chat messages is challenging due to the high volume of unstructured messages covering a wide range of topics. This work presents the results of an exploratory study examining the frequency of rationale in chat messages, the completeness of the available rationale and the potential of automatic techniques for rationale extraction. For this purpose, we apply content analysis and machine learning techniques on more than 8,700 chat messages from three software development projects. Our results show that chat messages are a rich source of rationale and that machine learning is a promising technique for detecting rationale and identifying different rationale elements.Comment: 11 pages, 6 figures.     Hazard Contribution Modes of Machine Learning Components

    Amongst the essential steps to be taken towards developing and deploying safe systems with embedded learning-enabled components (LECs) i.e., software components that use ma- chine learning (ML)are to analyze and understand the con- tribution of the constituent LECs to safety, and to assure that those contributions have been appropriately managed. This paper addresses both steps by, first, introducing the notion of hazard contribution modes (HCMs) a categorization of the ways in which the ML elements of LECs can contribute to hazardous system states; and, second, describing how argumentation patterns can capture the reasoning that can be used to assure HCM mitigation. Our framework is generic in the sense that the categories of HCMs developed i) can admit different learning schemes, i.e., supervised, unsupervised, and reinforcement learning, and ii) are not dependent on the type of system in which the LECs are embedded, i.e., both cyber and cyber-physical systems.     Argumentation Mining in User-Generated Web Discourse

    The goal of argumentation mining, an evolving research field in computational linguistics, is to design methods capable of analyzing people's argumentation. In this article, we go beyond the state of the art in several ways. (i) We deal with actual Web data and take up the challenges given by the variety of registers, multiple domains, and unrestricted noisy user-generated Web discourse. (ii) We bridge the gap between normative argumentation theories and argumentation phenomena encountered in actual data by adapting an argumentation model tested in an extensive annotation study. (iii) We create a new gold standard corpus (90k tokens in 340 documents) and experiment with several machine learning methods to identify argument components. We offer the data, source codes, and annotation guidelines to the community under free licenses.     Punishing Artificial Intelligence: Legal Fiction or Science Fiction

    Whether causing flash crashes in financial markets, purchasing illegal drugs, or running over pedestrians, AI is increasingly engaging in activity that would be criminal for a natural person, or even an artificial person like a corporation. We argue that criminal law falls short in cases where an AI causes certain types of harm and there are no practically or legally identifiable upstream criminal actors. This Article explores potential solutions to this problem, focusing on holding AI directly criminally liable where it is acting autonomously and irreducibly. Conventional wisdom holds that punishing AI is incongruous with basic criminal law principles such as the capacity for culpability and the requirement of a guilty mind. Drawing on analogies to corporate and strict criminal liability, as well as familiar imputation principles, we show how a coherent theoretical case can be constructed for AI punishment. AI punishment could result in general deterrence and expressive benefits, and it need not run afoul of negative limitations such as punishing in excess of culpability. Ultimately, however, punishing AI is not justified, because it might entail significant costs and it would certainly require radical legal changes. Modest changes to existing criminal laws that target persons, together with potentially expanded civil liability, are a better solution to AI crime
