Towards ending incarceration of Indigenous peoples in Canada: A critical, narrative inquiry of hegemonic power in the Gladue report process
Abstract
This study is concerned with the possibility that Gladue perpetuates the hegemonic powers of settler colonialism, white supremacy, patriarchy, and neoliberalism. Gladue is intended to remediate systemic anti-Indigenous racism by requiring judges to consider all alternatives to incarceration when sentencing Indigenous peoples, yet Indigenous incarceration rates continue to rise precipitously. On the surface, Gladue does not appear to disrupt the hegemonic status quo. How is it that the Canadian state, even when ‘remediating,’ keeps producing the same – colonial, oppressive, and tyrannical – result?
This qualitative study used a critical, narrative methodology, interviewing Gladue report writers (n=9) and judges (n=12) about their perspectives and experiences with Gladue, particularly Gladue reports. The study purposefully emphasized settler accountability – research as reparation – in the research design, data collection, and analysis. A careful, ethical protocol for researching with Indigenous peoples (n=9) was followed, premised in Truth and Reconciliation ‘Call to Action’ number 30 to reduce Indigenous incarceration in Canada.
This study found that Gladue is falling short of achieving its systemic aim because of (a) a hyper-individualistic, dehumanizing configuration that discursively shifts judges away from dealing with the systemic issue of anti-Indigenous racism, towards judging the individual Indigenous person before the court; (b) colonial mentalities (e.g., whiteness and patriarchy) persisting in the process; (c) a lack of funding for Gladue writers, as well alternatives to incarceration, constraining judges’ capacities to divert Indigenous away from prisons. The study points towards the need for a more radical framework for Gladue that honours Indigenous self-determination and foundational treaties such as the Two Row Wampum
An exploration of the language within Ofsted reports and their influence on primary school performance in mathematics: a mixed methods critical discourse analysis
This thesis contributes to the understanding of the language of Ofsted reports, their similarity to one another and associations between different terms used within ‘areas for improvement’ sections and subsequent outcomes for pupils. The research responds to concerns from serving headteachers that Ofsted reports are overly similar, do not capture the unique story of their school, and are unhelpful for improvement. Ofsted reports’ the study uses two tools, a plagiarism detection software (Turnitin) and a discourse analysis tool (NVivo) to identify trends within and across a large corpus of reports.
The approach is based on critical discourse analysis (Van Dijk, 2009; Fairclough, 1989) but shaped in the form of practitioner enquiry seeking power in the form of impact on pupils and practitioners, rather than a more traditional, sociological application of the method.
The research found that in 2017, primary school section 5 Ofsted reports had more than half of their content exactly duplicated within other primary school inspection reports published that same year. Discourse analysis showed the quality assurance process overrode variables such as inspector designation, gender, or team size, leading to three distinct patterns of duplication: block duplication, self-referencing, and template writing. The most unique part of a report was found to be the ‘area for improvement’ section, which was tracked to externally verified outcomes for pupils using terms linked to ‘mathematics’. Those
required to improve mathematics in their areas for improvement improved progress and attainment in mathematics significantly more than national rates. These findings indicate that there was a positive correlation between the inspection reporting process and a beneficial impact on pupil outcomes in mathematics, and that the significant similarity of one report to another had no bearing on the usefulness of the report for school improvement purposes

Corporate Social Responsibility: the institutionalization of ESG
Understanding the impact of Corporate Social Responsibility (CSR) on firm performance as it relates to industries reliant on technological innovation is a complex and perpetually evolving challenge. To thoroughly investigate this topic, this dissertation will adopt an economics-based structure to address three primary hypotheses. This structure allows for each hypothesis to essentially be a standalone empirical paper, unified by an overall analysis of the nature of impact that ESG has on firm performance. The first hypothesis explores the evolution of CSR to the modern quantified iteration of ESG has led to the institutionalization and standardization of the CSR concept. The second hypothesis fills gaps in existing literature testing the relationship between firm performance and ESG by finding that the relationship is significantly positive in long-term, strategic metrics (ROA and ROIC) and that there is no correlation in short-term metrics (ROE and ROS). Finally, the third hypothesis states that if a firm has a long-term strategic ESG plan, as proxied by the publication of CSR reports, then it is more resilience to damage from controversies. This is supported by the finding that pro-ESG firms consistently fared better than their counterparts in both financial and ESG performance, even in the event of a controversy. However, firms with consistent reporting are also held to a higher standard than their nonreporting peers, suggesting a higher risk and higher reward dynamic. These findings support the theory of good management, in that long-term strategic planning is both immediately economically beneficial and serves as a means of risk management and social impact mitigation. Overall, this contributes to the literature by fillings gaps in the nature of impact that ESG has on firm performance, particularly from a management perspective

An Agile Musicology: Improvisation in Corporate Management and Lean Startups
The last decade of the twentieth century saw a proliferation of publications that use jazz as a metaphor for corporate management, arguing that in the contemporary knowledge economy, jazz is superior to the symphonic model that governed mid-century factory floors. As the literature on the jazz metaphor, and organizational improvisation more broadly, continued to develop into the twenty-first century, another managerial methodology became widely adopted by entrepreneurs: agile. While agile is yet to be fully theorized as an improvisatory practice, agile shares several core tenets with the models promoted by organizational improvisation scholars, including the use of small teams, an emphasis on feedback, and an openness to change. In this dissertation, I argue that agile methods, and the adjacent lean methodology, are inherently improvisatory and that understanding them as improvisatory offers opportunities not only for their deployment within growing businesses, but also for adoption at-scale in large corporations.
I draw on an array of disciplinary perspectives, including management science, organizational studies, musicology, and critical improvisation studies, as well as a wide range of sources, from peer-reviewed journal publications to trade manuals. Each chapter builds upon the former: a substantial and critical review of the jazz metaphor literature is followed by a dissection of its main themes under a musicological lens; after securing the foundations of organizational improvisation, the next chapter reveals the improvisatory nature of agile and lean startup practices and links them to concepts discussed within the jazz metaphor literature. Drawing on insights from large-scale improvisatory musical practices, the final chapter reveals how improvisation, as a set of practices shared between corporate management and agile methodologies, provides avenues for agile to be scaled up as startups grow or for its widespread adoption within established companies
Coloniality and the Courtroom: Understanding Pre-trial Judicial Decision Making in Brazil
This thesis focuses on judicial decision making during custody hearings in Rio de Janeiro, Brazil. The impetus for the study is that while national and international protocols mandate the use of pre-trial detention only as a last resort, judges continue to detain people pre-trial in large numbers. Custody hearings were introduced in 2015, but the initiative has not produced the reduction in pre-trial detention that was hoped. This study aims to understand what informs judicial decision making at this stage. The research is approached through a decolonial lens to foreground legacies of colonialism, overlooked in mainstream criminological scholarship. This is an interview-based study, where key court actors (judges, prosecutors, and public defenders) and subject matter specialists were asked about influences on judicial decision making. Interview data is complemented by non-participatory observation of custody hearings. The research responds directly to Aliverti et al.'s (2021) call to ‘decolonize the criminal question’ by exposing and explaining how colonialism informs criminal justice practices. Answering the call in relation to judicial decision making, findings provide evidence that colonial-era assumptions, dynamics, and hierarchies were evident in the practice of custody hearings and continue to inform judges’ decisions, thus demonstrating the coloniality of justice. This study is significant for the new empirical data presented and theoretical innovation is also offered via the introduction of the ‘anticitizen’. The concept builds on Souza’s (2007) ‘subcitizen’ to account for the active pursuit of dangerous Others by judges casting themselves as crime fighters in a modern moral crusade. The findings point to the limited utility of human rights discourse – the normative approach to influencing judicial decision making around pre-trial detention – as a plurality of conceptualisations compete for dominance. This study has important implications for all actors aiming to reduce pre-trial detention in Brazil because unless underpinning colonial logics are addressed, every innovation risks becoming the next lei para inglês ver (law [just] for the English to see)
Identity, Transition, And High-Performing Veterans
Our identity is what makes us who we are. When a person joins the military, their identity is broken down and reshaped into a Soldier, Sailor, Marine, or Airmen. When a person exits the military, veteran status is placed in front of them like a mask or shield. This study examines a veteran transitional program designed explicitly for Post 9/11 High-Performing Veterans (HIPOVeterans) conducted at the Union League of Philadelphia. The program address’s identity and brand presence along with traditional transition methods and tools. It is essential to state that this dissertation is not about veteran challenges such as suicide, homelessness, jobless claims, Military Sexual Trauma or other critical veteran issues which dominate the news.
The purpose of this paper is to explore veteran identity and how veteran transitional programs play an essential role in HIPO-Veterans successfully transitioning out of the military. This is important because there is a significant gap in veteran research on successful veterans. HIPO-Veterans are not addressed uniquely, nor are they distinguished from the whole veteran population. Instead, all veterans are lumped into one group, and typically only those with challenges and issues are singled out.
The Union League of Philadelphia generously provided access to the Veteran\u27s transition program conducted yearly every January – June until January 2020. COVID-19 provided a unique opportunity for the program to pause and evaluate the effectiveness of its curriculum. Access to the program provided an insight into the veteran transitional process and the mentors serving the veterans. Two surveys were administered, and the data collected from the survey resulted in the development of a new model for the Union League of Philadelphia to implement. This model can be replicated in other veteran transitional programs as well
GENDERED EMBODIMENT, STABILITY AND CHANGE: WOMEN’S WEIGHTLIFTING AS A TOOL FOR RECOVERY FROM EATING DISORDERS
This thesis explores the everyday embodied experiences of women who use amateur weightlifting as a vehicle for recovery from eating disorders. Within online spaces and on social media, women frequently share their experiences of using weightlifting to overcome issues relating to disordered eating, body image, and mental health. In particular, women with a history of eating disorders credit weightlifting to be integral to their recovery journey. However, there is a dearth of research on women’s experiences with exercise during eating disorder recovery and no research that identifies weightlifting as beneficial to this process. To the contrary, discursive links are drawn between the practices of self-surveillance exercised by both eating disorder sufferers and weightlifters alike. In this regard, engagement with weightlifting during eating disorder recovery may signal the transferal of pathology from one set of behaviours to another. That is, from disordered eating to rigid and self-regulatory exercise routines. This thesis examines how women subjectively navigate and make sense of this pathologisation.
The data for this research comes from longitudinal semi-structured interviews and photo elicitation with 19 women, living in the United Kingdom, who engaged in weightlifting during their eating disorder recovery. In addition, to build up a holistic picture and to explore how this phenomenon also ‘takes place’ online, I conducted a netnography of the overlapping subcultures of female weightlifting and eating disorder recovery on Instagram. Women’s standpoint theory and interpretative phenomenological analysis are combined to form the underpinning theoretical and analytical tools used to engage with these three rich data sets. Moreover, throughout I draw on an eclectic range of disciplinary perspectives, in order to bring together multiple fields of research and develop novel theoretical frameworks.
In the findings, I argue that women’s experiences using weightlifting as a tool for recovery from eating disorders manifests in an embodied sense of multiplicity. In this sense, understandings of the body that are often viewed as ontologically distinct (muscularity/thinness/fatness) hang-together at once in the lived experience of a single individual.
I argue that women, particularly those who have previously struggled with an eating disorder, are too readily positioned as vulnerable to media and representation. To theoretically combat these ideas regarding women’s assumed passivity, I develop the concept of ‘digital pruning’ to account for women’s agency in relation to new media.
I contend that weightlifting offers women in recovery from eating disorders a new framework for approaching eating and exercise. Specifically, weightlifting’s norms and values legitimate occupying a larger body, which gives women in recovery permission to eat and gain-weight in a way that is both culturally sanctioned and health-promoting.
Finally, I explore identity transformation as a specific tenet of recovery from eating disorders. I argue that, on social media, recovery identities are characterised by personal empowerment, resilience, and independence. While offline, quieter and less culturally glorified aspects of recovery (such as relationships of care) are central to women’s accounts of developing a new sense of self as they transition away from an eating disorder identity.
In summary, this thesis is an examination of the ways in which women strategically navigate pathology in relation to their bodies, social media, food/exercise practices, and identity. I argue that women develop a set of ‘DIY’ recovery practices that allow them to consciously channel and draw on their negative experiences with eating disorders, to develop new ways of living that serve their overall wellbeing. Weightlifting is integral to this process, as it provides women transitioning out of this difficult phase in their lives with new ways of relating to their bodies and of being in the world. I situate this phenomenon within a neoliberal socio-political climate in which individuals are required to take personal responsibility for their mental health and wellbeing, despite living within conditions which are not conducive to recovery
Conscience and Consciousness: British Theatre and Human Rights.
This research project investigates a paradigm of human rights theatre. Through the lens of performance and theatre-making, this thesis explores how we came to represent, speak about, discuss, and own human rights in Britain. My framework of ‘human rights theatre’ proposes three distinctive features: firstly, such works dramatise real-world issues and highlights the role of the state in endangering its citizens; secondly, ethical ruptures are encountered within and without the drama, and finally, these performances characteristically aspire to produce an activist effect on the collective behaviours of the audience.
This thesis interrogates the strategies theatre-makers use to articulate human rights concerns or to animate human rights intent. The selected case-studies for this investigation are ice&fire’s testimonial project, Actors for Human Rights; Badac Theatre; Jonathan Holmes’ work as director of Jericho House; Cardboard Citizens’ youth participation programme, ACT NOW; and Tony Cealy’s Black Men’s Consortium. Deliberately selecting companies and performance events that have received limited critical attention, my methodology constellates case-studies through original interviews, durational observation of creative working methods and proximate descriptions of practice.
The thesis is interested in the experience of coming to ‘consciousness’ through human rights theatre, an awakening to the impacts of rights infringements and rights claiming. I explore consciousness as a processual, procedural, and durational happening in these performance events. I explore the ‘æffect’ of activist art and examine the ways in which makers of human rights theatre aim to amplify both affective and effective qualities in their work. My thesis also considers the articulation of activist purpose and the campaigning intent of the selected theatre-makers and explores how their activism is animated in their productions. Through the rich seam of discussion generated by the identification and exploration of the traits of a distinctive human rights theatre, I affirm the generative value of this typological enquiry
