    Dropping the Ax: Illegal Firings During Union Election Campaigns

    This report finds a steep rise in illegal firings of pro-union workers in the 2000s relative to the last half of the 1990s. It uses published data from the National Labor Relations Board (NLRB) to update an index of the probability that a pro-union worker will be fired in the course of a union election campaign. By 2005, pro-union workers involved in union election campaigns faced about a 1.8 percent chance of being illegally fired during the course of the campaign. If we assume that employers target union organizers and activists, and that union organizers and activists make up about 10 percent of pro-union workers, our estimates suggest that almost one-in-five union organizers or activists can expect to be fired as a result of their activities in a union election campaign

    The 750 GeV Diphoton Excess May Not Imply a 750 GeV Resonance

    We discuss non-standard interpretations of the 750 GeV diphoton excess recently reported by the ATLAS and CMS Collaborations which do not involve a new, relatively broad, resonance with a mass near 750 GeV. Instead, we consider the sequential cascade decay of a much heavier, possibly quite narrow, resonance into two photons along with one or more invisible particles. The resulting diphoton invariant mass signal is generically rather broad, as suggested by the data. We examine three specific event topologies - the antler, the sandwich, and the 2-step cascade decay, and show that they all can provide a good fit to the observed published data. In each case, we delineate the preferred mass parameter space selected by the best fit. In spite of the presence of invisible particles in the final state, the measured missing transverse energy is moderate, due to its anti- correlation with the diphoton invariant mass. We comment on the future prospects of discriminating with higher statistics between our scenarios, as well as from more conventional interpretations.Comment: Discussion about the ATLAS Moriond EW2016 added.     This research aimed to know the effect of mastery productive programs and industrial teacher’s guidance toward the achievement obtained in industrial working practice achievement on the drawing of building engineering program at SMK N 2 Yogyakarta in second grade of SMK N 2 Yogyakarta in academic year of 2010/2011. This research is an Ex-Post Facto research. The sample of this research was 31 second grade students of engineering drawings of SMK N 2 Yogyakarta in academic year of 2010/2011 who had done the first periode of industrial working practice. The data collecting of the population for the work of the industrial teacher’s guidance was using questioner of Likert scale with margin score of 1 to 4. Meanwhile to the variable of productive program achievement was using the document of report school grade from grade 1 to 2. 0 The variable achievement of industrial working practice also applied the documentation of industrial working practice grade which was written in the certificate of industrial working practice. The instruments validation questioner implemented items analysis using correlation formula “Product Moment” and the check reliability was using Alpha Cronbach Formula. Testing hypothesis was using correlation analysis product moment and multiple regression analysis which were done before test requirements analysis. It consisted of normalization, linearization, and multikolinierization. The result stows that : (1). There was an significant influence to the achievement of productive program to the student’s the achievement obtained in industrial working practice proved by correlation coefficient 0,8,8 > 0,355, P = 0,05 with the effective contribution 24,9% and X1 = 2,932. (2). There was significant influence between the work of industrial guidance teacher and the students’ achievement obtained in industrial working practice, proved by correlation coefficient 0,5932 > 0,355, P= 0,05 with the effective contribution of 0,2% and X2 = 0,030. (3). There is influence significant between the productive program achievement and the work of industrial guidance teacher with the students’ achievement obtained in industrial working practice with effective contribution of 25,1% and Y = -12,819 + 2,923X1 + 0,030 X2.     The Law\u27s Mystery

    What is the continuing significance of Cohen v. California, the 1971 U.S. Supreme Court decision holding that “Fuck the Draft” is a message protected by the First Amendment? Using Cohen as an exemplar, this article offers a new theory about how to understand the law and judicial opinions. The theory begins in a recognition of the “law” as resting upon mystery and uncertainty, a mystery that is also the source of the law’s enchantment. It is this enchantment that we depend upon for the law to be authoritative rather than authoritarian and reducible to the political and thus to power. In simple terms, the mystery of the law—its being beyond us in this way—constitutes its legitimate authority over us. The law that discloses itself to us does so through the openings that language provides. For our culture, judicial opinions are its primary way of doing this. Having introduced the theory, the article applies it, exploring whether it is possible to bring to the surface the tracings of a “great” judicial performance, using “great” in the sense of revealing an opening through which the law discloses itself. This section describes a reading of Cohen that aims to discover whether through the performance of the opinion, its author has uncovered something that is “of the essence” of our community. The article finally raises questions about what it would mean to legal education and law practice if judicial opinions were evaluated without destroying the law’s mystery. What would it mean if we thought of judges as preservers of this mystery? What would it mean if readers of opinions started thinking in terms of their own experience of the opinion rather than as critics of it? And what would it mean if lawyers saw their task as related to “truth”

    Germany overtook Britain in comparative productivity levels for the whole economy primarily as a result of trends in services rather than trends in industry. Britain's productivity lead in services before World War II reflected external economies of scale in a highly urbanised economy with an international orientation. Low productivity in Germany reflected the underdevelopment of services in an economy that was slow to move out of agriculture. As German agricultural employment contracted sharply from the 1950s, catching-up occurred in services. This was aided by a sharp increase in human and physical capital accumulation, underpinned by the institutional framework of the postwar settlement
