A política de equidade de gênero do CNJ e o princípio da paridade de participação

Abstract

The study aims to investigate gender equity by analyzing the gender alternation policy drawn up by the National Council of Justice, comparing this policy with Axel Honneth\u27s theory of recognition and Nancy Fraser\u27s principle of parity of participation. Based on the hypothesis that changing the Internal Regulations of the aforementioned body is not capable of promoting equitable measures of participation in the Judiciary in isolation, the research will use the hypothetical-deductive method, with a qualitative analysis of bibliographic material. The result indicates that the CNJ\u27s policy of gender alternation is not capable, in isolation, of guaranteeing the equal participation of men and women in the Judiciary. It is essential that the body establishes alternative and complementary measures to combat and repress discrimination against women in the various social strata, moving away from values established by the dominant culture and approaching plural audiences.O estudo objetiva investigar a equidade de gênero a partir da análise da política de alternância de gênero elaborada pelo Conselho Nacional de Justiça, confrontando a referida política com a teoria do reconhecimento de Axel Honneth e com o princípio da paridade de participação de Nancy Fraser. Partindo da hipótese que a alteração do Regimento Interno do referido órgão não é capaz de promover isoladamente medidas equânimes de participação no Poder Judiciário, a pesquisa utilizará o método hipotético-dedutivo, com análise qualitativa de material bibliográfico. O resultado indica que a política de alternância de gênero formulada pelo CNJ, não é capaz de, isoladamente, garantir a participação equânime de homens e mulheres no âmbito do Poder Judiciário, sendo primordial que o órgão estabeleça medidas alternativas e complementares para o combate e repressão da discriminação contra as mulheres nas diversas camadas sociais, afastando-se de valores instituídos pela cultura dominante e aproximando-se de públicos plurais
