DIREITO, CIDADANIA E REGULAMENTAÇÃO DA MÍDIA NO BRASIL: DEBATES E DESAFIOS

Abstract

This article seeks to propose a discussion about Law and Citizenship, considering access to information, the right to communication and media regulation. Brazil is chosen as the locus, due to its peculiarities and the social demands in relation to the theme – in addition to being the field of action of the authors of this research. As a method of investigation, we opted for a literature review with conceptual operationalization, also making use of the word cloud and the timeline to reinforce the arguments. As conclusions, it is identified that Law and Citizenship are conceptual categories that need to go together, in addition to considering that the reform in the regulation of the media, in Brazil, as a legal apparatus, is an essential condition for the exercise of the right to information and for a better observation of the Constitution of the Federative Republic of Brazil.O presente artigo busca propor uma discussão a respeito do Direito e da Cidadania considerando-se o acesso à informação, o direito à comunicação e a regulamentação da mídia. Escolhe-se o Brasil como locus, pelas suas peculiaridades e pelas demandas sociais em relação ao tema – além de ser o campo de atuação dos autores dessa pesquisa. Como método de investigação, opta-se pela revisão de literatura com a operacionalização conceitual, fazendo uso também da nuvem de palavras e da linha do tempo para reforçar os argumentos. Como conclusões, identifica-se que Direito e Cidadania são categorias conceituais que precisam seguir juntas, além de considerar que a reforma na regulamentação da mídia, no Brasil, como aparato jurídico, é uma condição essencial para o exercício do direito à informação e para uma melhor observação da Constituição da República Federativa do Brasil
