The reliance on engineers with these dual skill sets does not guarantee success and often results in failure due to restrictively systematic methodologies that stifle creativity, engineering monoculture, and the assumption that technology is a specialists field. Design driven companies, on the other hand, often lack a concrete methodology that can be applied to other companies due to a lack of knowledge of the definition of what design is and the ineffective conversion of employees into creative design forces. Therefore, this paper suggests to introduce a solution that can increase creativity within the technology centers of the world by analyzing both technology and design driven methodologies. North Korea โ€“ The United States Park ChunWoo Political Science Major Dept. of Science & Int'l Relations The Graduate School Seoul National University The purpose of this study was to draw some implications for foreign policy that Korean government should maintain in those radical triangle relationship among South Korea โ€“ North Korea โ€“ The United States (S-N-U) by (1) providing an analysis framework for strategic triangle relationship combining Dittmers strategic triangle analysis framework and Heiders cognitive consistency theory and (2) analyzing strategic triangle relationship among S-N-U for 15 years covering Kim Dae-jung Government(The Peoples government), Roh Moo-hyun Government(The Participation government) and Lee Myung-bak Government. The triangle relationship, as used in this study, is as follows: if there are three actors behaving reasonably, if an actor can affects relationship between other two ones, and inversely, the relationship can affects a remaining actor and if this association is true in all combinations among three actors, it is said that there is a triangle relationship. The term strategic means that if a triangle relationship is formed surrounding an issue that affects survivals and interests of three actors, the actors try to act reasonably according to power relationship among them. The triangle relationship formed by three nations is analyzed in this study. The advantage of analyzing triangle relationship is to allow deeper analysis compared to analyzing bilateral relationship. In addition, strategic triangle relationship among S-N-U is investigated in the first place because it is appropriate to analyze it among many triangle relationships for drawing implication for Korean foreign policy. The analysis period in this study was 15 years from 1998 to 2012 corresponding to The Peoples government, The Participation government and Lee myung bak Government because it is appropriate to analyze triangle relationship until today focusing on the changes in Korean administration if the purpose of analysis in this study is to draw implication for Korean foreign policy. This study divided 15 years from 1998 to 2012 into six phases in analyzing strategic triangle relationship among S-N-U. The first criteria in dividing phases was change of Korean administration and second one was a time when the nature of triangle relationship among S-N-U changed critically. The most representative example is the start of Bushs administration when the N-U relationship as well as triangle relationship among S-N-U has significantly changed. The agreements on Feb. 13th, 2007 or the announcement of measure on May 24th, 2010 were also used as a criteria because there was dramatical change in triangle relationship among S-N-U. This study propose a enhanced Dittmers strategic triangle analysis framework by complementing with Heiders cognitive consistency theory and other theories. Especially, there were attempts to complement or overcome the limitation or lacking in Dittmers framework. For the purpose, a notation was devised to mark the levels of amity and hostility in detail and it was investigated whether the Dittmers strategic triangle analysis framework is applicable to the triangle relationship among S-N-U which did not reach balance of power among nations. The three pairs of bilateral relationship was determined in terms of amity or hostility, and the level was marked by using + or โ€“ signs. The natures of triangle relationships formed by three paris of bilateral relationship were prescribed and classified into one of 1) the menage a trios, 2) romantic triangle and 3) stable marriage. Finally, the triangle relationships at six phases were analyzed in terms of the mechanism and process through which the change occurred. The result of analysis showed that the first and fourth phases were in the menage a trois, the second and third phases were in romantic triangle and fifth and sixth phases were in stable marriage. In addition, The periods of perceived stable triangle relationship were to be found in first, fourth, fifth and sixth phases while periods of perceived unstable triangle relationship were to be found in second and third phases. The results of analyzing six phases are as follows: First, the most strong determining power in triangle relationship among S-N-U was still bilateral relationship between North Korea and United States. The triangle relationship among S-N-U, however was not subordinated to this bilateral relationship, there are sufficient room to occur change by other bilateral relationships. Second, though the bilateral relationship between South Korea and United States has smallest width of change, it is not a constant but still a variable, meaning that the triangle relationship among S-N-U is strategic triangle relationship evidently. Third, assuming the balance among three nations in terms of interests, the most ideal triangle relationship among S-N-U is the state of the menage a trois. Fourth, given that the position of South Korea does not allow this nation to bias to North Korea or United States, the most strategic action is to maintain the amicable relationship between South and North Korea in which South Korea has some determining power, to induce the relationship between North Korea and United States to be amity, resulting in the triangle relationship among S-N-U to be the menage a trois. This can be found in the transit period from third to fourth phase, while the transit period from fourth to fifth phase is a counter-example. Fifth, the effect of South Korea on bilateral relationships between South Korea and North Korea or United States is not so strong. It is practical, therefore, to keep evident initiative in relationship with North Korea, and this decision is a strategic one rather than should-be one. In order to overcome this crisis, companies are striving to secure a competitive advantage through technological innovation, and are putting much effort into the creation of intellectual property rights to effectively protect the results of innovation. In addition, since intellectual property rights can be a means of generating profits by themselves, companies are paying attention not only to create intellectual property rights but also to use them. According to the 2020 intellectual property white paper published by the Korean Intellectual Property Office in 2021, the number of domestic patent applications in the name of corporations as of 2020 was 181,873, accounting for 80.2% of the total number of applications. According to these survey results, most of today's intellectual property rights are based on employee inventions. Therefore, in order to create qualitatively superior intellectual property and accelerate the innovative growth of a company, it is necessary to closely support the employee invention compensation-related laws so that fair compensation can be provided to the employees who are the main agent of technological innovation. Meanwhile, Articles 15 and 16 of the Invention Promotion Act stipulate compensation for employee inventions. According to these Articles, compensation rules for employee inventions should be prepared by agreement between employer and employee. However, the current Invention Promotion Act Article 15 provides only abstractive standards such as fair compensation, employerโ€™s profits, and the extent to which the employer or employee has contributed to the completion of the invention as compensation standards for employee inventions. Currently, there is no practically acceptable legal guideline when a private company draws up compensation standards. Therefore, if a dispute over compensation arises due to the absence or inadequacy of compensation provisions, there is a problem that the dispute must be resolved through litigation or the mediation procedure of the Industrial Property Rights Dispute Mediation Committee. In this situation, the Korean Intellectual Property Office and the Invention Promotion Association have prepared and distributed the โ€˜Standard Model of compensation Regulations for Employee Inventionsโ€™, which suggests specific types of compensation and standards for calculating the amount of compensation as a government support policy pursuant to Article 11 of the Invention Promotion Act. Although this is a non-legally binding guideline but provides a standard point of reasonable compensation. In a situation where the current law does not provide specific standards for compensation for employee inventions and the judgment of the types of compensation and the standards for calculating the amount of compensation depends on the court, the standard model can be a useful reference for private companies when creating and enforcing employee invention compensation provisions. Also the standard model can be useful in practice because it increases the predictability of compensation and prevents the occurrence of legal disputes in advance. However, although today's patents are used in a variety of ways beyond implementation and disposition, the current standard model does not appear to adequately reflect this situation. For example, there are problems that compensation is delayed for a long period of time and predictability is reduced if the standard model is followed for employee inventions in the pharmaceutical/bio field, where implementation or disposition is withheld for a considerable period of time due to the testing/licensing procedure. Furthermore, when employerโ€™s profits are generated from defensive patent or infringement lawsuits that do not involve implement or disposition, it is also difficult to obtain fair compensation according to the standard model. Therefore, when companies refer to the standard model to formulate and implement compensation rules, it is hard to obtain fair compensation for the above cases, which lowers employees' motivation for research and slows down the innovation speed of the company. Therefore, this study examines current regulations for compensation for employee inventions, Supreme Court precedents, legal systems and operational status of major countries. Also this study insists that compensation standards should be presented in the standard model for fair compensation to employees for a employee invention in the pharmaceutical/bio field, where implementation or disposition is withheld, and for defensive patents or infringement lawsuits without direct implementation or disposition. Furthermore, by reviewing the guidelines on compensation for employee inventions in Germany's private employment relationship, this study suggests the standard model improvement (draft) that presents compensation types such as โ‘  performance compensation, โ‘ก compensation for withholding implementation or disposition, and โ‘ข infringement compensation, and the calculation criteria for each type
