    A Tale of Two Amendments: The Reasons Congress Added Sex to Title VII and Their Implication for the Issue of Comparable Worth

    The author of this article examines and dispels the frequently cited account that the provisions against sex discrimination in Title VII of the Civil Rights Act of 1964 were created as a Congressman\u27s joke or as an attempt to defeat the bill. He analyzes the background of the Smith and Bennett amendments, focusing on the congressional debates as they appear in the Congressional Record. He concludes that the Members of Congress were serious about sex discrimination, and that this seriousness has important implications for the interpretation of Title VII

    Distinct Mechanisms for Induction and Tolerance Regulate the Immediate Early Genes Encoding Interleukin 1β and Tumor Necrosis Factor α

    Interleukin-1β and Tumor Necrosis Factor α play related, but distinct, roles in immunity and disease. Our study revealed major mechanistic distinctions in the Toll-like receptor (TLR) signaling-dependent induction for the rapidly expressed genes (IL1B and TNF) coding for these two cytokines. Prior to induction, TNF exhibited pre-bound TATA Binding Protein (TBP) and paused RNA Polymerase II (Pol II), hallmarks of poised immediate-early (IE) genes. In contrast, unstimulated IL1B displayed very low levels of both TBP and paused Pol II, requiring the lineage-specific Spi-1/PU.1 (Spi1) transcription factor as an anchor for induction-dependent interaction with two TLR-activated transcription factors, C/EBPβ and NF-κB. Activation and DNA binding of these two pre-expressed factors resulted in de novo recruitment of TBP and Pol II to IL1B in concert with a permissive state for elongation mediated by the recruitment of elongation factor P-TEFb. This Spi1-dependent mechanism for IL1B transcription, which is unique for a rapidly-induced/poised IE gene, was more dependent upon P-TEFb than was the case for the TNF gene. Furthermore, the dependence on phosphoinositide 3-kinase for P-TEFb recruitment to IL1B paralleled a greater sensitivity to the metabolic state of the cell and a lower sensitivity to the phenomenon of endotoxin tolerance than was evident for TNF. Such differences in induction mechanisms argue against the prevailing paradigm that all IE genes possess paused Pol II and may further delineate the specific roles played by each of these rapidly expressed immune modulators. © 2013 Adamik et al

    Localization of adaptive variants in human genomes using averaged one-dependence estimation.

    Statistical methods for identifying adaptive mutations from population genetic data face several obstacles: assessing the significance of genomic outliers, integrating correlated measures of selection into one analytic framework, and distinguishing adaptive variants from hitchhiking neutral variants. Here, we introduce SWIF(r), a probabilistic method that detects selective sweeps by learning the distributions of multiple selection statistics under different evolutionary scenarios and calculating the posterior probability of a sweep at each genomic site. SWIF(r) is trained using simulations from a user-specified demographic model and explicitly models the joint distributions of selection statistics, thereby increasing its power to both identify regions undergoing sweeps and localize adaptive mutations. Using array and exome data from 45 ‡Khomani San hunter-gatherers of southern Africa, we identify an enrichment of adaptive signals in genes associated with metabolism and obesity. SWIF(r) provides a transparent probabilistic framework for localizing beneficial mutations that is extensible to a variety of evolutionary scenarios

    Instantaneous Dynamics of QCD

    We start from the observation that, in the confining phase of QCD, the instantaneous color-Coulomb potential in Coulomb gauge is confining. This suggests that, in the confining phase, the dynamics, as expressed in the set of Schwinger-Dyson equations, may be dominated by the purely instantaneous terms.     A high-finesse Fabry-Perot cavity with a frequency-doubled green laser for precision Compton polarimetry at Jefferson Lab

    A high-finesse Fabry-Perot cavity with a frequency-doubled continuous wave green laser (532~nm) has been built and installed in Hall A of Jefferson Lab for high precision Compton polarimetry. The infrared (1064~nm) beam from a ytterbium-doped fiber amplifier seeded by a Nd:YAG nonplanar ring oscillator laser is frequency doubled in a single-pass periodically poled MgO:LiNbO3_{3} crystal. The maximum achieved green power at 5 W IR pump power is 1.74 W with a total conversion efficiency of 34.8\%. The green beam is injected into the optical resonant cavity and enhanced up to 3.7~kW with a corresponding enhancement of 3800. The polarization transfer function has been measured in order to determine the intra-cavity circular laser polarization within a measurement uncertainty of 0.7\%. The PREx experiment at Jefferson Lab used this system for the first time and achieved 1.0\% precision in polarization measurements of an electron beam with energy and current of 1.0~GeV and 50~μ\muA.Comment: 20 pages, 22 figures, revised version of arXiv:1601.00251v1, submitted to NIM

    Application of the Gillespie algorithm to a granular intruder particle

    We show how the Gillespie algorithm, originally developed to describe coupled chemical reactions, can be used to perform numerical simulations of a granular intruder particle colliding with thermalized bath particles. The algorithm generates a sequence of collision ``events'' separated by variable time intervals. As input, it requires the position-dependent flux of bath particles at each point on the surface of the intruder particle. We validate the method by applying it to a one-dimensional system for which the exact solution of the homogeneous Boltzmann equation is known and investigate the case where the bath particle velocity distribution has algebraic tails. We also present an application to a granular needle in bath of point particles where we demonstrate the presence of correlations between the translational and rotational degrees of freedom of the intruder particle. The relationship between the Gillespie algorithm and the commonly used Direct Simulation Monte Carlo (DSMC) method is also discussed.Comment: 13 pages, 8 figures, to be published in J. Phys. A Math.     Optimum Monte Carlo Simulations: Some Exact Results

    We obtain exact results for the acceptance ratio and mean squared displacement in Monte Carlo simulations of the simple harmonic oscillator in DD dimensions. When the trial displacement is made uniformly in the radius, we demonstrate that the results are independent of the dimensionality of the space.     EquiFACS: the Equine Facial Action Coding System

    Although previous studies of horses have investigated their facial expressions in specific contexts, e.g. pain, until now there has been no methodology available that documents all the possible facial movements of the horse and provides a way to record all potential facial configurations. This is essential for an objective description of horse facial expressions across a range of contexts that reflect different emotional states. Facial Action Coding Systems (FACS) provide a systematic methodology of identifying and coding facial expressions on the basis of underlying facial musculature and muscle movement. FACS are anatomically based and document all possible facial movements rather than a configuration of movements associated with a particular situation. Consequently, FACS can be applied as a tool for a wide range of research questions. We developed FACS for the domestic horse (Equus caballus) through anatomical investigation of the underlying musculature and subsequent analysis of naturally occurring behaviour captured on high quality video. Discrete facial movements were identified and described in terms of the underlying muscle contractions, in correspondence with previous FACS systems. The reliability of others to be able to learn this system (EquiFACS) and consistently code behavioural sequences was high—and this included people with no previous experience of horses. A wide range of facial movements were identified, including many that are also seen in primates and other domestic animals (dogs and cats). EquiFACS provides a method that can now be used to document the facial movements associated with different social contexts and thus to address questions relevant to understanding social cognition and comparative psychology, as well as informing current veterinary and animal welfare practices

    Precedent is the cornerstone of common law method. It is the core mechanism by which the common law reaches just outcomes. Through creation and application of precedent, common law seeks to produce justice. The appellate courts\u27 practice of issuing unpublished, non-precedential opinions has generated considerable discussion about the value of precedent, but that debate has centered on pragmatic and formalistic values. This essay argues that the practice of issuing non-precedential opinions does more than offend constitutional dictates and present pragmatic problems to the appellate system; abandoning precedent undermines justice itself. Issuance of the vast majority of decisions as nonprecedential tears the justice-seeking mechanism of precedent from the heart of our common law system
