    Konflik di Kawasan Hutan Register 45 Mesuji, Lampung pada hakikatnya adalah manifestasi kontestasi akses atas kawasan sumberdaya hutan. Konflik pengelolaan hutan tanaman industri yang berlangsung belasan tahun menjadi silang sengketa antara investor dan masyarakat. Pasang surut konflik juga pada gilirannya melahirkan pengabaian terhadap hak-hak konstitusional warga. Permasalahan dalam penelitian ini adalah (1) Mengapa terjadi pengabaian hak-hak konstitusional yang dilakukan Pemerintah Kabupaten Mesuji terhadap Warga Moro-Moro Register 45, Mesuji, Lampung dan apa dampaknya bagi Warga Moro-Moro? (2) Bagaimanakah akses terhadap keadilan diupayakan oleh Warga Moro-Moro, Register 45 dalam menolak eksklusi dan mendapatkan akses kelola atas hutan? (3)Bagaimanakah model penyelesaian konflik di Kawasan Hutan Register 45 Mesuji Lampung yang berperspektif pada pemenuhan hak konstitusional? Penelitian ini adalah penelitian kualitatif yang menggunakan pendekatan sosio legal dengan paradigma kritikal. Data primer diperoleh dari observasi dan wawancara dengan sejumlah informan baik dilokasi penelitian di Register 45 Mesuji, Lampung maupun informan lainnya yang berkaitan. Sementara data sekunder diperoleh dari proses dokumentasi dan studi pustaka. Data yang diperoleh kemudian divalidasi lewat metode triangulasi sumber data untuk selanjutnya dianalisis dengan teknis induksi-konseptualisasi. Penelitian ini menyimpulkan bahwa Pertama, Konflik di kawasan Hutan Register 45 Mesuji pada hakikatnya adalah manifestasi kontestasi akses pengusahan kawasan hutan antara perusahaan dan masyarakat yang pada akhirnya melahirkan “politic of ignorance” (politik pengabaian) dan eksklusi sosial yang dilakukan baik melalui kekuasaan, regulasi, tekanan dan legitimasi. Kedua, Pasang surut konflik yang terjadi melahirkan beragam cara inovatif dari warga yang berjuang untuk mendapatkan akses terhadap keadilan. Pilihan perjuangan diluar jalur pengadilan yang diambil oleh Warga Moro-Moro pada gilirannya melahirkan sebuah gerakan intelektual kolektif yang turut serta memberi desakan kepada para pengambil kebijakan. Ketiga, Penyediaan akses pengelolaan kawasan hutan lewat model kemitraan partisipatif yang berperspektif pemenuhan hak-hak konstitusional. harapannya dapat menjadi jalan keluar persoalan legalitas akses pengelolaan kawasan Hutan Register 45 sekaligus pemenuhan hak-hak konstitusional warga negara secara berkeadilan. Implikasi teoritis dari studi ini adalah memberikan sumbangan pemikiran terkait pemenuhan hak-hak konstitusional warga negara dan solusi yang berkeadilan bagi penyelesaian konflik di Register 45, Mesuji,Lampung. Secara praktis dari studi ini adalah membangun model kemitraan partisipatif sebagai upaya penyelesaian konflik yang berbasis pada perlindungan hak konstitusional yang berprinsip pada keadilan sosial sebagai amanat Pancasila dan Pembukaan UUDNRI 1945

    Forest conflict Register 45 Mesuji Lampung sticking out the end of the year is a agrarian chronic conflict and widespread impact. A conflict that has lasted more than fifteen years has spawned a variety of violence, evictions and abandonment of the constitutional rights of citizens. This paper uses ethnographic approach that aims to provide an overview of the successful struggle of managing conflict with social intelligence.     Disputes between Law and Justice

    The consequence of identifying justice with law is that seeking justice becomes constrained and it becomes limited only to the formulation of law. Although it is possible to approach justice from the ‘legal-formal’ aspect, justice cannot be reduced to law. Once justice is reduced to law, seeking justice outside the legal system ceases. The assumption that justice is identical to law is misleading, as justice is assumed to be inherent in the law itself. On the other hand, it is dangerous to make a distinct separation between law and justice. Law obtains its validity through its positive form, which is derived from the sovereign authority. The implication of this is that law is the law itself, altogether separate from justice, whereby an emphasis is placed only on its formal manifestation. However, law is not justice. Law is a calculable element, while justice is incalculable in concrete terms. Law is a tool for approaching justice. Therefore, law cannot possibly surpass justice, because assuming that law surpasses justice would be as stating that the tool colonizes its objective. Keywords: law, justice, tools, goals

    Local Communities Empowerment within Coastal Tourism Development in West Coastal District

    Juridical empirical research with the aim finds a model of local communities’ empowerment in coastal tourism development through land tenure arrangements in West Coastal District. The findings of this study states that the district along West Coastal District there are 17 points which have any potential to be developed into coastal tourism. Unfortunately the impacts of coastal tourism development from economic, social and cultural aspects haven’t been enjoyed by the local communities. This happened because the communities are unprepared to welcome tourists, and lack of coordination between local government and tour operator. Rights to land control in the coastal zone within the tourist development dominant with land ownership status, there were indications of land ownership by foreigners who could potentially cause disputes. There are 11 accommodation managed by husband and wife (citizen-foreigner) from 33 accommodation in West Coastal District. The model is offered in the cooperation with foreign parties in the form of granting Use Rights to property, rental property to foreigners, or by getting up operations and transfer (BOT). Hopefully this model will encourage welfare and survival of west coastal communities so they don't become coolies/porters in their own country. Keywords: Coastal Tourism, Foreigner, Empowermen

    Revealing The Myth Of Rule Of Law

    Rule of law, the still existed doctrine or tenet in a modern legal system till now. Rule of law is understood as doctrine in the law (science) which teaches that state should be governed by law and not governed by the one’s rule (rule by man). As the implication, the rule of law doctrine puts law (rule of law) as "supreme commander." All the governmental issues, cases and governance must be based on the rule of law. Rule of law as part of the modern legal system actually does not escapedfrom influence of capitalism which grow in Europe since the 19th century. The rule of law doctrine in Western Europe has given good results since the 19th century for countries which their conditions in accordance with the expected social order to exist in the concept of the rule of law.But it should not be forgotten that the growth of rule of law principle cannot be separated from the patterns of public relations and community movements that places individual liberty as the main basic of community organizing. Rule of law comes from the recognition that individual liberty could be achieved in a society which governed by laws to limit the power of the state and guarantees economic rights. Gerald Turkel (1995) stated that the principle of the rule of law is not really meant to be as means or as instruments to solve the society problems such as poverty. Rule of law intended to create a more stable order for individuals and businesses related to their economic activity. Therefore, the myths about the rule of law must be revealed for the purposes of law enforcement in Indonesia, unless in future Indonesia is projected towards a capitalistic society based on free market mechanisms.     Article Impact Assessment Local Regulations that Pro Poor Character as an Instrument Society Transformation

    Understanding of poverty in this case related to powerlessness, isolation, vulnerability, and safety embody local legal products that pro Poor character is very important to be the policies platform that oriented to the fulfillment of the Poor rights. These conditions become the limiting factor for the Poor to fulfill their basic rights. Ideally, a legal drafter is also required to understand the sensitivity (responsiveness) of the poverty that is formulated within the framework of political economy. The approach that used in this study is a normative approach based law (statute approach). Insight study, clarification of information related to the legislative process of the present day, research team also uses in-depth interviews and Focus Group Discussion with several speakers who are considered competent. The findings of this study, there are some weaknesses in the design of local drafting regulations as stipulated in Law No. 12 of 2011. Weaknesses related to understand the principles of law and the legal use of language make the legal drafter mostly still stuck into the technical sciences of legislation and regulations. The study found a model approach to Article Impact Assessment (AIA) as a model of drafting regulations that pro Poor character. The implication of law resulting product will be pro Poor character.     Kemandegan CSR dan Kontribusinya terhadap Perluasan Konflik Agraria di Kawasan Hutan Register 45 Mesuji

    This paper seeks to examine Corporate Social Responsibility (CSR) in its relations to agrarian conflict that occurred in the Register 45, Mesuji, Lampung. The Joint Fact Finding Team (TGPF) revealed that in 2012, one of the causes for conflict that occurred between PT Silva Inhutani and the community was because the company did not carry out CSR program. This research was conducted through field research with interview and observation as its two main techniques. The result of this research shows that CSR was not implemented seriously. CSR tends to be only a dream instead of an ideal fact. In its relations to agrarian conflict in Mesuji, it was proven that CSR program that executed by the company was unable to contribute to the process of conflict resolution between the company and the society. Although the company has started to carry out CSR program, it did not have much meaning because it was a short term program with a characteristic of charity

Tulisan ini mengambil studi di Kota Metro yang mayoritas masyarakatnya adalah suku Jawa dan juga memiliki beragam pemeluk agama. Filosofi hidup Rumongso Melu Handarbeni yang diyakini oleh masyarakat Jawa dalam prakteknya ikut mendukung berbagai program Pemerintah Kota Metro. Di sisi lain keberadaan berbagai komunitas agama yang ada di Kota Metro sesungguhnya memiliki potesi yang besar dalam mendukung Kota Metro yang berwawasan lingkungan. Agama dengan ajaran tentang kepedulian lingkungan akan dapat menjembatani proses bertemunya modal sosial dan kebijakan pemerintah dalam mengatasi permasalahan lingkungan khususnya sampah di Kota Metro. Agama Islam dan Kristen dapat menjadi prototype dalam membangun kesadaran lingkungan antarpemeluknya. Pada konteks inilah usaha Pemerintah Kota Metro dalam membentuk sebuah produk hukum daerah sebaiknya memperhatikan modal sosial masyarakat.     The constitution has clearly provided legal protection toward rights of citizen. Constitutionalism regime contains the idea of power restriction and secures civil rights through constitution. Nevertheless, some places in which agrarian conflicts occur, the ignorance of civil rights seem to be prominent. People living in the forest area of register 45 Mesuji Lampung is the picture of people who, for more than twelve years, are missing their constitutional rights. Local government does not recognize them as resident just because they occupy forest area which its management is delegated to private party. The critical legal studies perspective is constantly examining legal performance with the authority behind the law and the power within a community.
