    Patentable Subject Matter: Comparison between French and Jordanian Laws

    The purpose of this study is to make a comparison between the patentable subject matter in French and Jordanian law in order to extract the similarities and differences to establish basic principles for Palestine. The Jordanian law is selected as it is in general the law that is applied in Palestine. Palestine is the only country in the Middle East that does not have legislations protecting intellectual property rights. However, there are sporadic laws applied in Palestine, such as the Ottomans' law in 1910 related to copyright law and the Jordanian trademark 1952 and patent law in 1953. In 1995 the Palestinian Authority approved some legislation in the field of private law, such as civil and commercial law, but without including in it intellectual property legislation. The term intellectual property is not popular among Palestinian legislators as there are among them few experts in this field

    Industrial designs are considered the results and creations of the human brain, including innovations in the form of goods and products, and are moral rights that represent a financial value that deserve to be protected the same as the rest of the rights of the industrial property. It gives its owner an exclusive right to face everyone as well as giving him the right of exploitation and the right to prevent anyone from cloning or using without the permission of the original creator. However, this kind of protection is not given to industrial designs and models unless they are officially registered in the competent departments according to the laws of each country. This essay will discuss the subject of legal regulations for industrial designs and models in Palestine in a comparative study with Jordanian and Egyptian legislation

    Le but de cette thèse est de faire une comparaison objective entre le droit de la propriété intellectuelle en France et en Jordanie, afin d'en extraire les ressemblances et les différences et d'en tirer un enseignement qui pourra peut-être permettre la conception d'une loi protégeant la propriété intellectuelle dans les pays qui n'en possèdent pas, en particulier la Palestine.
