Sovereign Immunity Abrogated in Ohio: Krause v. State
The decision thus promulgates three principal rulings: (1) that sovereign immunity does not provide a bar to bringing an action against the State of Ohio, (2) that the state is liable by virtue of the doctrine of respondeat superior for the authorized activities of its officers, employees and other agents, and (3) that freedom of individual agents from civil liability arising out of authorized activities for the state is retained. The effects of these rulings are far from obvious, in large part because of the confused prior state of the law upon which they are engrafted. Furthermore, the grounds given for abrogation of the state\u27s immunity to suit can be subjected to severe criticism. It was to be expected that the events at Kent State in the spring of 1970 would produce litigation which would subject the judicial system as well as other parts of the established order of society to penetrating re-examination. Few could have anticipated the far-reaching changes announced by this decision, which must challenge the record for the number of controlling precedents that would have to be abandoned to sustain it in its entirety. The court was undoubtedly speaking for the people of Ohio in broadening the remedy for injuries resulting from operations of the state and its subsidiaries. The difficulties it encountered in that attempt suggest that the General Assembly would serve the people well by exercising its own more flexible authority in this field
Contributory Negligence of Very Young Children
If in backing your car out of a driveway you look to only one side as you approach the sidewalk, and strike and injure a pedestrian approaching from the other side, who had been so engrossed in conversation with a companion as not to have cast even a glance up the driveway, your liability for his injuries might well depend upon his age. The standard of care required (in most circumstances) of normal adults (and corporations) for the protection of themselves and of others is that they take such care as ordinary prudent persons would take in the circumstances. Little, if any, allowance is made for the deviations of their actual capabilities or experience from those envisioned for the ordinary prudent person. But for children it has long been otherwise
Quantized Roentgen Effect in Bose-Einstein Condensates
A classical dielectric moving in a charged capacitor can create a magnetic
field (Roentgen effect). A quantum dielectric, however, will not produce a
magnetization, except at vortices. The magnetic field outside the quantum
dielectric appears as the field of quantized monopoles
Local/Non-Local Complementarity in Topological Effects
In certain topological effects the accumulation of a quantum phase shift is
accompanied by a local observable effect. We show that such effects manifest a
complementarity between non-local and local attributes of the topology, which
is reminiscent but yet different from the usual wave-particle complementarity.
This complementarity is not a consequence of non-commutativity, rather it is
due to the non-canonical nature of the observables. We suggest that a
local/non-local complementarity is a general feature of topological effects
that are ``dual'' to the AB effect.Comment: 4 page
Pseudorapidity Distribution of Charged Particles in PbarP Collisions at root(s)= 630GeV
Using a silicon vertex detector, we measure the charged particle
pseudorapidity distribution over the range 1.5 to 5.5 using data collected from
PbarP collisions at root s = 630 GeV. With a data sample of 3 million events,
we deduce a result with an overall normalization uncertainty of 5%, and typical
bin to bin errors of a few percent. We compare our result to the measurement of
UA5, and the distribution generated by the Lund Monte Carlo with default
settings. This is only the second measurement at this level of precision, and

Quantum Games
In these lecture notes we investigate the implications of the identification
of strategies with quantum operations in game theory beyond the results
presented in [J. Eisert, M. Wilkens, and M. Lewenstein, Phys. Rev. Lett. 83,
3077 (1999)]. After introducing a general framework, we study quantum games
with a classical analogue in order to flesh out the peculiarities of game
theoretical settings in the quantum domain. Special emphasis is given to a
